The meeting was called to srder at.8:30 p. M. by President
Lams. Motion was made by Traatee Wilier and seconded by Trustee
Bread to appeint Phyllis Gardner as acting clerk until ~lerk
Reynolds &~:~-ived. This .motion was carried by acclamation.

of the President, with the following responses Present: Trustee roll call
Broad, No-.:~.is, Schlaver and Wilier. Absent: Casterline and Airey.
All trustees having previously received copies of"the
minutes ef March 3rd, Trustee Broad, seconded by TrUstee Norris,
moved that the minutes be approved as submitted. The President minutes
put the question and the Clerk called the roll, with ~h8 following
reSponse: Ayes.- Trustees Broad, Norris and Schlaver. Trustee
Willer passed because he was absent the previous week. Where.
Upon the President declared the motion carried.
In the absence of Trustee'Airey, Trustee Schlaver moved,
seconded by Trustee Norris, for the approval of the bills for the

Trustee $chlaver of the Fire & Water Committee reported Bids - Fire
that bids for the new fire fighting equipment will be received in Ecuipment
two weeks. Also that a possible site for a new well on the Carson
Pirie property was indicated along Foundry Road.

Avenue from Emerson 3freer te Pine Street, using MFT funds, and of
necessity removing trees in said parkway?,,
The President put the question, the Clerk called the roll, with the
following response: Ayes: Trustees Broad, Norris, 3chlaver and
Willer. Na~s, none. Absent: Casterline and Airey. WhereUpon the
President declared the motion carried. The Glerk was directed to
secure approval on'the wording of ~his ballot from the Tillage Attorney.
Trustee $chlaver felt that the angle parking should be re.
stored at certain places on Northwest Highway because of the heavy
need fer more parking facilities. Trustee Norris indicated his
opposition to angle parking because ~f the increased danger of

accidents. Trustee Willer expressed the feeling that unless
additional parking was found for the central business section
that this area will die as a business center.
Resignation of Trustee Broad stated that Mr. HerBert Simpson, Bnildingfcr a

Herb Simoson - Inspecto , had given his resignation, and was leaving
Bldg. Sup. similar job in ~orthbroek; The Trustees expressed regret at
this, agreeing that Mr. Simpson had done a very good job for
the Village. Trustee Bread then moved that a letter be directed
to Mr. Simpson thanking him for his ~tl igent services and wishing
him well in his new position. Trustee Willer seconded this motion, __
which was carried by acclamation.

Trustee Willer read the report from the Board of Appeals
regarding Case 59-4 as follows:

Petitioner requested a variation to allow buil2i~§ line l0 feet
closer iu front and l0 feet closer in back for property on north
side of Central Road near Rand Road.
On this request the Beard ef Appeals voted 6-0 to grant the
requested variation.
After reading the memorandum on this case from the Board of Appeals
Trustee Willer, seconded by Trustee Broad, moved that the Village
Board concur in the recommendation of the Board of Appeals in
Case 59-4 and that the Village Attorney prepare an ordinance to
bring about the variation.
$om~ discussion concerning the history of this case followed, during
~fmich a Mr. Kitzing of the Northeast Homeowners League arose amd
read a letter-of protest over the placing of these homes on Central
Road. The President restated the question, the Clerk called the roll,
with the following response: Ayes: Trustees Broad, Norris, Schlaver
and Willer. Nays, uone. Absent: Airey and Casterline. Whereupon
the president declared the motion carried.

Trustee Willer, seconded by Trustee Norris, moved that the
Village Beard concur with the recommendation ef the Board ef
Appeals and that the petitioner be notified ef the denial of
his request. The President put the question and the Clerk called

Trustee Wilier read the following letter from the Plan
Commission to the Board:

Gentlemen:
Garden Subdv.
The Plan Commission had reviewed a proposed plat of
Garden Subdivision which was referred to it by the Board for study
and recommendation an~ recommends to the Board that the proposed
plat be approved subject to dedication of land for public use.
This dedication under the ordinance should be .2466 acres, ten
per cent of the area of the subdivision.

This donation is made in connection with the "Garden s
Addition" subdivision plat which was considered by the Plan
Commission at the March 9, 1959 meeting.
I believe it is onlyfatr and fitting that the members of
the Board of Trustees should know that Mr. Dan Serafine is co-
operating in this donation, since he is the contract purchaser of
Lot 2 of this subdivision.
We trust our offer of cash donation will meet with your
approval, since it has been previously established that this would

Louis Munao's Trustee Willer stated that Er. Louis Munao is willing to
improve parts of Lonnquist and Emerson with street, curb and gutter

Dear Sirs:
Please be advised that I hereby agree to install the street, curb,
and gutter in the area dedicated for public use on the north half of
Lonnquist Boulevard, running westerly from Emerson Street, for
approximately three hundred seventy-eight lineal feet. The width of
the street to be approximately sixteen foot. I will do the above so
that it joins the other improved street west of this property on
Lonnquist Boulevard, according to the plat submitted to the Village
of Mount Prospect and known as Louis Munao's First Addition.
The approximate cost of this improvement and the ground should run
between eight and nine thousand dollars, which will be in the form
of a donation to the Village of Mount Prospect, Illinois.

Trustee Willer read the following letter from the Plan Commission:

Gentlemen:
The Plan Commission to whom the proposed Plat of Louis Munao's
First Addition was referred for study and recommendation, recommends
that the proposed plat be approved subject to dedication of land for
public use as determined by the Village B~ard, which dedication,
according to the ordinance, should be .? acres.
The subdivider has indicated a willingness to dedicate .43 acres for
public use in what would be the north half of Lonnquist Boulevard
from the center line of Emerson Street west 378.97 feet as shown on the
proposed plat of subdivision, and has verbally agreed that he will
fully improve this portion of Lonnquist Boulevard at his own expense
in lieu of the .7 acres for public use. He stated that this offer
would be submitted to the Village Board in writing.

Mr. Munao arose from the audience and stated that he will
post bond for this paving as soon as the 14 acres in the plat are
approved. This was agreeable to .the Board. Trustee Willer, seconded
by Trustee Broad, moved that the President and Clerk be directed to

sign the plat of Louis Munao's First Addition, concurring with the
recomnendation of the Plan Commission, subject to compliance with
all the ordinances of the Village of Mt. Prospect. The President
put the question and the Clerk called the roll, with the following
response: Ayes: Trustee Broad, Norris, Schlaver and Willer. Nays,
none. Whereupon the President declared the motion carried.
Trustee Schlaver made the following motion, seconded by
Trustee Norris, regarding improvement of Highland Avenue: Highland
"In accordance with recommendation of the Mount Prospect Paving
Board of Local Improvements made at meeting of March 10th, that
the Village President and Clerk be directed to sign and execute
agreement for paving of Highland Avenue as set forth in letter
from Joseph M. Brickman, dated March 10th, said letter to be
inserted in the minutes as part of this motion".

Gentlemen: Re: Highland Avenue
We agree, at our own expense, to supply all labor and material to
install the paving on Highland Avenue and the north and south
intersections of Highland Avenue at Eastwood Avenue, Prospect Manor
and Fairview Avenue, (except the two-inch (2") 1-11 topping) as
follows:
(a) The work we are to do will improve all of Highland
Avenue and the above intersections from a point
lB2' west of Elmhurst Avenue running west to the
easterly line of Forest Avenue;
(b) We will excavate to grade as established by the
Village Engineers, and
(c) Install concrete curb and gutter, and
(d) Necessary stone base, and
(e) Storm sewer inlets, and
(f) Do all other work and provide all other material
(except the topping) for the paving as prepared by
Village Engineers;
(g) We will also install public walk on the north side
only of Highland Avenue parallel to this paving.
The width of Highland Avenue, to be installed by us, is to
be the same width as Highland Avenue as now existing at the east side
of the improvement we are to make.
This work will be done simultaneously with the improvement
of other streets in our Rand View Highlands Subdivision and will be
completed during the sum~er months.
You agree, at your own expense, to install the two-inch (2")
1-11 topping on all of the paving that we are to do in accordance
with this letter. There shall be no permit, engineering or
inspection fees ~hargeable to us for this work. This understanding
is binding only in the event the Village shall indicate its
acceptance and agreement within five (5) days by excuting its
approval on bhis letter.
Upon completion of the work we are to do, you will give
us a written acceptance of said work. ~You will also install the
topping within one (1) year and provide us with a final acceptance
of the street and sidewalk.

President Lams stated that the Illinois Range Company on
Police Central Road purchased for the Police Department metal signs Police
signs stating "Police" to be attached to the hood of two of the now
cars. Trustee Willer, secundedby Trustee Broad, moved to send Signs
a letter of thanks to Illinois Range for providing these signs.
This motion carried by acclamation.
Village Manager Appleby brought up our former Case 58-15
and read draft of letter protesting petition for business zoning
to the Cook County Board of Commissioners as follows: Case

Hearing on the petition for rezoning of approximately two acres
at the southwest corner of Busse Road and Central Road described as:
"The North 2 acres of Lot "E" (except that part lying north
of a line 50 feet south of and parallel to the north line of
Section l0 in Kirchoff's Subdivision, being a subdivision in
Section l0 and ll, Township 41 North, Range ll, East of the
Third Principal Meridian, according to the plat recorded May 22,
191? in Book 152 of Plats, Page 15, in Cook County, Illinois"
Hearing of rezoning of the two acres from the F (Farming) District
to the B-1 (Business) District was held by the Zoning Board of
Appeals of Cook County on February 26, 1959. The subject property
is within one and one-half miles of the Village of Mount Prospect.
The Village of Mount Prospect objects to the rezoning of this
area on the basis that:
1. A petition requesting annexation of the subject
property if zoned for business was denied by the
Village on September 16, 1958.
2. It is spot zoning.
S.Such zoning is not in the public interest of the
Village of Mount Prospect.
The protest is made pursuant to direction of the President and
Board of Trustees at their regular meeting held March S, 1959.

Trustee Willer, seconded by Trustee Broad, moved that the Board of
Trustees concur in the letter of protest to be sent to the Cook
County Board of Commissioners under date of March 10, 1959. This
motion was carried by acclamation.
Discussion was held regarding sale of certain property
Pine Street owned by the Village on the east side of Pine Street between North-
property west Highway and Central to the highest bidder as required by law.
Village Attorney Downing is preparing notice of sale and a question
arose regarding easement allowing access to property owned by the
Village on the west side of the street. Trustee Broad stated that
he felt that the property owners on this block should be notified
of the Village's intention re this property. Trustee Willer expressed
the thought th~bimmediate steps should be taken to implement the
Kincaid Report.

President Lams presented a letter to the Board from himself Appointment
appointing Nmi A. C. Dresser to make assessment of costs on Naple of Dresser
Street paving. Trustee Broad, seconded by Trustee Norris, moved to as assessor
concur in this recommendation, whereupon Trustee Willer stated that Maple Street
he held Nrc Dresser in the highest regard, but questioned whether it paving
was in order to appoint a person who holds so high a position with
the Village as does Nm. Dresser. Trustee Broad withdrew his motion
amd Trustee Norris his second, and it was agreed to bring the ma~er
up a~ the nex~ meeting, after consultation with Attorney Downing.
Nm. Alan Bloch, representing Brickman Home Builders,
addressed the Board on the subject of Lot 3 in Naplecrest Sub- Maplecrest
division, which is next to Lot 4, deeded to the Village of Water Deposi
Mount Prospect. This had to do with planning of Lot 3 in such
a way that one meter, privately owned, measures the flow of wa~er
~o the multiple dwelling units therein, and that a private road,
not ~o be kept up by ~he Village, will be maint&ined by the builder.

as the Village may require.
We further agree ~o maintain and repair said private road
and parking areas and remove, or cause ~o be removed, snow and
ice therefrom as necessary.
We hereby deposit with you the sum of $500.00 to be
retained by the ~illage as security for the maintenance of said
private road and parki~ areas, which you may retain for as long
as you, ~n your discretion, deem it necessary to properly secure

The undersigned, Nanor Service Company, a public utility
organized under the laws of the State of Illinois and operatin~
by virtue of a certificate issued by the Illinois Commerce
Commission, agrees with the Village of ~ount Prospec~ as follows:
That in the even~ sewer and w~ter lines and appurtenances
thereto are installed in any partof Lot 3 in ~aple Crest Sub-
division, being a subdivision of
Part of the Northeast Quarter of Section 34,
Township ~2 North, Range ll, East of the
Third Principal ~eridian in Cook County~ Illinois~

which water lines may be connected to the water system of the
Village of Mount Prospect and the sewer line connected to the
sanitary sewer on Highland, that this Company will maintain,
repair and operate all of such lines, pipes and appurtenances
contained within said lot.
Maplecrest This Company further agrees that it will pay for all water
Water Deoosit delivered to the said lot, or any structure thereon, by the Village
of Mount Prospec~ and that for that purpose will install a master
water me~er at the connection to the water main operated by the
Village of Mount Prospect, in accordance with the regulations and
requirements of the Village of Mount Prospect and will pay for such
water at the customary retail ra~e therefor. This Company will then
distribute said water to any buildings located on Lot 3, or persons
living thereon, in accordance with its certificate issued by the
Illinois Commerce Commission and in accordance with the regulations
of said Commission.
To guarantee the payment of all water bills to the Village
of Mount Prospect, this Company does herewith deposit with the
Water Department of the Village of ~lount Prospec~ the su~ of $1,000
which said Village shall hold as security for the paymen~ of water
bills ~util such time as the Village, in its discretion, may see fit
~o relinquish the same To this Company; said $1,000 shall also
constitute security for the proper maintenance and service of said
water and sewer lines installed in said lot.
This Compar4v further agrees to save the Village of Mount
Prospect harmless against any claim by any person that may be
asserted because of the alleged failure to properly maintain and
service said lines, or to supply w~ter, provided the Village of
Mount Prospect shall be able and ready to deliver water ~o the
connection at which the master meter is provided.

motion:
"To accep~ the $1,000 deposit tendered by N~NOR SERVICE CO~ANY
in accordance with its letter dated March 10, 1~59 and ~o accept
the sum of $500 tendered by BRICKNAN HO~E BUILDERS, INC. in
accordance with its letter dated ~arch 10, 1959, and
Further, to direct and authorize the President of this
Village to execut an ~greemen~ with the other ow~ers~:of~re~ord of
the subdivision known as ~ple Crest Subdivision, being a sub-
division of part of the Northeast Quarter of Section 34, Township
42 North, R~auge ll, East of the Third Principa~ Meridian in Cook
Co~_uty, Illinois, ~o abrogate, cancel and declare void a certain
restraint and restriction, being in words and numbers as follows:
Lot 3 shall not be alienated, transferred, devised,
bequeathed or assigned in any fractional share thereof
or to more than one grantee or assignee thereof ~n any
part it being understood this restriction runs with the
land and shall bind all grantees, assignees or successors
in title to said Lot 3".
which restriction and restraint is contained in plat of said
subdivision, recorded as Document No. 17360466 in the Office of the
Recorder of Deeds of Cook County, Illinois, and that the attorney
for this Village be ~nstructed and directed to prepare and pass upon
such agreement, it being the intent and purpose of this agreemen~ ~o
remove and nullify the aforesaid restriction and restraint."
Nr. Alan Bloch explained that the sums of $500- and $1,000
were to be held in perpetual escrow, and if these monies are used,

To be replenished by the parties responsible. If the Village at a
later date wishes To re~urn this money, it may do so.
The President directed the Clerk to call the roll on Trustee Willer's
motion, and response was as follows: Ayes: Trustees Broad, Norris,
Schlaverand Willer. Nays, none. Absent: Airey and Casterline.
Whereupon the President declared the motion carried.
~r. Appleby referred To letter of February 24, 1959 from
.Consoer, Townsend, which set forth proposed sewers in Northwest Sewers in
Meadows Subdivision, on Forest Avenue and between Lots 7 and 8, Northwest
Block 8, and in Northwest Highway. ~r. Cadigan, representing Meadows
C.T. & A., stepped forward and showed proposed plan on m~p,
explaining routing and consideration of future improvements.
~r. Parker Eken took part in this discussion, as President
of Northwest Meadows Home Owners Association. The plans were
~en~amively approved in mos~ respects, and plans with revisions
will be submitted later.
Trustee Broad, seconded by Trustee Norris, moved to adjourn,
and the meeting was regularly adjourned by acclamation a~ ll:15 P.M.
