Pear,ir. Appleby:
Reference is made ~o the action of the Village Board at
the February lOth meeting requesting that we prepare the necessary
ordinance in connection with Zoning Case 59-2.
We call your attention to the fact that the notice as origi-
nally filed pertained To a notice for a hearing regarding a "variation".
The minutes show that the request was amended during the hearing
an "amendment".
We have always held that it is contrary ~o best legal principles
to permit such an action and sngges~ it would not be with our approval
that an ordinance be passed under such circumstances. In other words,
it is our recommendation that a public hearing be held as ~o the
proposed amendment.
We also call your attention ~o the question of whether or not
an amendment in this area would crea~e any precedent with respect
possible "spot" zoning.
If there are any questions concerning our position we would
be glad to discuss the same.
Sincerely,
S/ Robert J. Downing
