HomeMy WebLinkAbout02/24/1959 VB minutes MINUTES OF A REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES HELD IN THE ~fJNICIPAL BUILDING, VILLAGE OF MOUNT PROSPECT, '~'u~SDAY, FEBRUARY 24, 1959 The meeting was called ~o order a~ 9:00 P.N. by President Lams. Upon roll call by Clerk Reynolds, the following trustees answered present: Airey, Broad, Norris, Schlaver and Willer. Absent: Casterline All trustees having previously received copies of the minutes of February 17th, Trustee Norris, seconded by Trustee Broad, moved that the minuted be approved as submitted. The minutes President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris, Schlaver and Willer. Nays, none. Absent: Trustee Casterline. Whereupon the President declared the motion carried. Trustee Airey moved for the approval of the bills for the period ending February 24th as follows: General $5,~84.04 Water ~ bills ~ $3,858~26 Trustee Norris seconded this motion. The President put the question, the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris, and Willer. Nays: Schlaver. Absent: Casterline. The P~s'ident declared the motion carried. Trustee Schlaver questioned the chargmng of automatic letter opener and sealer to the Water Department(S342.27); Manager Appleby answered that the reason was because the larges~ use was for the Water Department. ,.~ Discussion was held regarding repair of streets after placing Street repai~ of sewers by Santucci Construction Company under the direction of the Metropolitan Sanitary District. Agreemenm was general that by Metropolitan certain repairs made by the Village Street Department should be Sanitary District reimbursed by the Sanitary District. A meeting regarding this is to be held on February 25th. The members of the Board fel~ that a written agreemen~ should be secured from the Metropolitan Sani~$ry District spelling ou~ those repairs that will merit reimbursement. Trustee Airey, seconde~ by Trustee Broad, moved that the Treasurer's TreasUrer's Report for the month of January, 1959, be approved Report - Jan and placed on file. Case 59-3 AN ORDINANCE G~ANTING A ZONING VARIATION ON SETBACKS TO ST. PAUL'S LUTHERAN CHURCH TO ALLOW THE ERECTION OF A NA~ BUILDING. Trustee Broad seconded this motion. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris, Schlaver and Willer. Nays, none. Absent: Trustee Casterline. Whereupon President Lams declared the motion carried and Ord. #657 passed. Trustee Willer read proposed Ordinance No. 658 and moved Ord, 658 for its passage: Gillespie- AN ORDINANCE ANNEXING PROPERTYHELD IN TRUST Moellenkamp FOR R. GILLESPIE AND OTHERS, LOCATED BETWEEN GOLF ROAD ON THE SOUTH AND LONNQUIST PAPJCNAY ON THE NORTH, AND COUNTRY CLUB TERRACE SUB~ DIVISION ON THE WEST AND GOLFHURST ESTATES ON THE EAST. February 2¢, 1959 Trustee Broad seconded this motion. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, B~oad, Norris, Schlaver and Willer. Nays, none. Absent: Trustee Casterline. Whereupon President L~ms declared the motion carried and Ord. #658 passed. Trustee Willer read Case 58-16, annexation of Serafine's Shopping Center proper~y. Case 58-16 This resolution approves plans and covenant with regard to this property. The Board asked for recommendation of this resolution from Village Attorney Downing, which will be forthcoming short%y. Discussion was held regarding zoning hearing held by the -- Case 59-2 Board of Appeals on January 2?th, zn particular Case 59-2 St. Mark's St. Nark's Lutheran Church. Trustee Willer read the following Lutheran letter of opinion from Village Attorney Downing: Church February 20, 1959 H. G. Appleby, Village ~nager Mount Prospect, Illinois Pear,ir. Appleby: Reference is made ~o the action of the Village Board at the February lOth meeting requesting that we prepare the necessary ordinance in connection with Zoning Case 59-2. We call your attention to the fact that the notice as origi- nally filed pertained To a notice for a hearing regarding a "variation". The minutes show that the request was amended during the hearing an "amendment". We have always held that it is contrary ~o best legal principles to permit such an action and sngges~ it would not be with our approval that an ordinance be passed under such circumstances. In other words, it is our recommendation that a public hearing be held as ~o the proposed amendment. We also call your attention ~o the question of whether or not an amendment in this area would crea~e any precedent with respect possible "spot" zoning. If there are any questions concerning our position we would be glad to discuss the same. Sincerely, S/ Robert J. Downing This ma~er was referred to the Judiciary Committee for study and recommendation. Nr. Stamis, as spokesman for property owners on Maple Street Maple Street improvements opposite Lions Park, stated that they wished ~o proceed with the sewer and wa~er improvements on a private contracz. He offered a private proposal in writing from a contracting firm, and asked that the ~ont?act · Village ac~ as agen~ for all parties involved, pro-rating costs and ~ collecting monies. Village Attorney Downing recommended such apportion- ~ ment on a straight front foot basis. The Village is willing ~o do this, and a meeting by all parties concerned will be held shortly. water supply Nr. William Mott of the Water Commission reported that they __ were securing propositions from various sources and that a recommendation would be made to the Board. He said that it might take ten years complete the matter because of a number of legal suits from various States. He felt that another well should be sunk for the present.
