PRESIDENT AND BOARD OF TRUSTEES HELD
IN THE MUNICIPAL BUILDING, VILLAGE OF
MOUNT PROSPECT, TUESDAY, FEBRUARY 17, 1959
~-~ The meeting was called to order at 8:09 P.M. by President
Lams. Upon roll call by Village Clerk Reynolds, the following roll call
Trustees answered present: Trustees Airey, Broad, Norris, Schlaver
and Will~r. Absent: Trustee Casterline.
All trustees having previously received copies of the minutes
minutes of February 10th, Trustee Airey, seconded by Trustee Norris,
moved that the minutes be approved as submitted. The President put
the question and the Clerk called the roll, with the following response:
Ayes: Trustees Airey, Broad, Norris and Schlaver. Trustee Wil~er
passed because of absence on that date. Nays, none. Whereupon the
President declared the motion carried.
A discussion was held regarding the village streets and
~ the need for repairs in the spring. Mention was made of the Street paving
%0 possibility of putting up a snow fence opposite the 500 block on Central
~ Forest next year. Paving of Central Road was brought up, where-
~ upon Trustee Wilier made the foIbwing motion:
~ ~that the ViL~ge Manager be directed to send a letter to the County
Highway Department asking that, with the approval of the County
Board, Central Road be improved as soon as possible".
Trustee Schlaver seconded this motion, and it was carried by
acclamation.
Trustee Schlaver brought up the subject of the Fire Bond
Referendum and the sale of said bonds, then read the following
letter of opinion from Village Attorney Downing:

Dear Harold:
Reference is made to your inquiry as to whether or not fnnds from
the waser account might be used in connection with the issuance of
the $75,000 Obligation Bonds to be issued by the Village.
You have made available to us Ordinance No. 435, a water bond revenue
ordinance. By virtue of this ordinance, all of the revenues from
ar~ source whatever der~ved from the operation of the waterworks shall
be set aside as collected and deposited in a separate fund. The
various'funds are designated within the lar~uage of the ordinance.
Section (e) of the Ordinance provides that after various accounts
have been credited, all moneys remaining in the water fund may be
divided 50% to the Bond Redemption Account and 50% to a Surplus
Account. An additional amount may be credited to the Bond Redemption
Account and a corresponding reduction from the Surplus Account if it
is so desired.
The amounts credited to the Surplus Account may be used or accumulated
for the repair, improvements and enlargement or extension of the
waterworks system or for an~ oth~.r, proper corporate purpose.

The amounts set aside in the other accounts required to be kept
pursuant to this ordinance may be invested from time to time "in
direct obligations of the United States Government ~at~ning in not
more than ten years after the purchase date thereof, and be sold
from time to time pursuant to resolution of the President and Board
of Trustees as funds may be needed for the purpose for which the
accounts have been created".
It would appear if funds are available in the Surplus Account it --
would be a corporate purpose to use said funds for the purchase of
the $75,000 Fire Fighting Equipment Bonds - assuming such money is
available.
Balances existing in the other accounts are restricted by Section 8
(f) and m~y be invested only in direct obligations of the United
States Government. That Section does not authorize the use of such
b~iances for purchase of any part of the $75,0000 Bonds.
The foregoing opinion is based upon Ordinance No. 435 and it is
assumed that no subsequent ordinance modifies the provisions set
out therein. We are returning herewith the copy of said ordinance.

Trustee Schlaver stated that inasmuch as only $BO,O00 could be used
for the purchase of the Fire Bonds, in his opinion it wotLld be
better to offer the entire amount of $75,000 to the lowest bidder
and perhaps use the $30,000 for another purpose, such as a new well.
Trustee Schlaver then introduced Resolution 7-59 and moved for its
adoption:

Trustee Norris seconded this motion; the President put the question
and the Clerk called the roll, with the following response: Ayes,
Trustees Airey, Broad, Norris, Schlaver and Willer. Nays, none.
Absent: Casterline. Whereupon the President declared the resolution
adopted.
Fire Dept. Trustee Schlaver also mentioned that the new station wagon given
wagon to the Village by the Fire Department for emergency use will be
delivered shortly.
Trustee Ai~ey read proposed Resolution 8-59 and moved
for its adoption:

Trustee Broad seconded this motion. The President put the question,
the Clerk called the roll, with the following response: Ayes:
Trustees Airey, Broad, Norris, Schlaver and Willer. Nays, none. --
Absent: Trustee Casterltne. Whereupon the President declared the
motion carried.
Trustee Aireymoved for the approval of the bills for the
Bills period ending February 17th, stating that the only out-of-the-ordinary
bill was for the newly installed accoustical ceiling tile.

Trustee Wilier seconded this motion, the President put the question,
the Clerk called the roll, with the following response: Ayes:
Trustees Airey, Broad, Norris, Schlaver and Willer. Nays: none.
Absent: Trustee Casterline~ k~ereupon the President declared the
motion carried.
Trustee Willer read a petition for annexation of a farm area
lying west of Sunset Heights, signed by Herman Busse, Mathilde Busse,
Harry Rascher, Julia Rascher and Berwyn Rascher, and then read the Busse
~-- following letter of opinion from Village Attorney Downing: Rascher

Returned herewith are the copy of petition to annex and the copy of
plat forwarded by your letter of February 13, 1959.
The documents appear to be in order, assuming that the territory
is in fact contiguous to the present Village limits, a matter which
you should ascertain from Village records.

Trustee Willer, seconded by Trustee Airey, then moved that "the
President and Clerk be authorized on behalf of the Village to sign
the petition for annexation and that the Village Attorney be directed
to prepare an ordinance to annex said property".

and Willer. Nays, none. Absent: Trustee Casterline. Whereupon the
President declared the motion carried.
Trustee Wilier, seconded by Trustee Norris, moved for the
passage of Ordinance $656:

This property, to be known as Louis Munao's First Addition, lies on 1st Addn.
the south bank of the creek to Lonnquist Blvd. east of the center llne
of Emerson Street extended. The President put the question and the
Clerk called the roll, with the followin~ response: Ayes: Trustees
Airey, Broad, Norris, Schlaver and Willer. Nays, none. Absent:
Trustee Casterline. Whereupon the President declared the motion
carried.
Trustee Willer, seconded by Trustee Airey, then moved tha~
"the Plat of SubdiviSion of Louis Munao's First Addition be submitted
to the Plan Commission for study and recommendation".
The President put the question and the Clerk called the roll, with
the following response: Ayes: Trustees Airey, Broad, Norris, Schlaver
and Willer. Nays, none. Absent: Trustee Casterline. Whereupon the
President declared the motion carried.
Trustee Willer, seconded by Trustee Airey, mpved that the County Zoning
Village Manager represent the interests of the Village at the Our Case 58-15
hearing to be held by the County Zoning Board of February 26th.
This concerns property at the Southwest corner of Busse and ~Central
Roads, formerly appealed under our Case # 58-15. This motion passed
by acclamation.
Trustee Airey read a letter from William A. Wille dated
February 12th, as follows:

Mayor Lams:
This letter is to request to obtain a six month option to purchase
Village owned real estate, approximately four one/half (4½) lots,
located East of Pine Street and any available Village owned real
estate West of Pine Street subject to the vacating of Pine Street.
Pine St. Method of payment could be in cash or in like kind property.
Property The latter method is preferred. --

Trustee Willer, seconded by Trustee Schlaver, moved that all of
the Village holdings on the East side of Pine Street be sold by
public bid and that hearing be set in order to dispose of this
property.

the following response: Ayes: Trustees Airey, Broad, Norris,
Schlaver and Willer. Nays, none. Absent: Caste~line. Whereupon
the Pmesident declared the motion carried.
Trustee Willer also made the following motion, seconded by
Trustee Norris: "that it be established as a policy of this Board
that in the event this Board chooses to accept a bid for the purchase
of the Village's holdings on the east side of Pine Street, the
Village will consider the vacation of those portions of Pine Street
that apply to the subject property, with the provision that access
b~ easement to the Village,owned property o~ the west side
of Pine Street would be granted".
The President put the question and the Clerk called the roll, with
the following response: Ayes: Trustees Airey, Broad, Norris,
Schlaver and Willer. Nays, none. Absent: Casterline. Whereupon
the President declared the motion carried.
Trustee Willer, seconded by Trustee Airey, moved for~
adjournment. The motion carried by acclamation and the meeting
regularly adjourned at 9:10 P. M.
