HomeMy WebLinkAbout02/10/1959 VB minutes MINUTES OF A P~GULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES HELD IN THE MUNICIPAL BUILDING, VILLAGE OF MOUNT PROSPECT, TUESDAY, FF~t~.UARY t0, 1959 The meeting was called to order at 8:04 P.M. by President ~'~ Lams. Trustee Airey, seconded by Trustee Norris, moved that Phyllis Gardner, deputy clerk, be appointed Village Clerk Pro Tern in absence roll of Mr. Reynolds, who was ill. This motion was carried by acclamation, call Mr. Lams then directed the Clerk Pro Tern to call the roll. Present: Trustees Airey, Norris and Schlaver. Trustee Broad arrived a minute later. Absent: Trustees Casterline and Willer. All trustees having previously received copies of the minutes of February 3, 1959, Trustee Airey, seconded by Trustee Norris, moved that the minutes be approved as submitted. The President put the question and the Clerk called the roll, with the following minutes response: Ayes: Trustees Airey, Broad, Norris. Pass: Schlaver. Nays, none. Whereupon the President declared the motion carried. It was moved by Trustee Airey and seconded by Trustee Norris that the list of bills for the period ending February 10, 1959 be approved for payment in the following amounts: ~ General $4 610 24 Garbage 4,898.58 bills Water 4,765.95 $14,274.77 The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris and Schlaver. Nays, none. Absent: Trustees Casterline and Willer. Whereupon the President declared the motion carried· Trustee Schlaver mentioned that the legal action necessary for the bond issue for fire fighting equipment is being studied by Bonds for Chapman & Cutler. Mr. Downing has been contacted to give an opinion Fire Fight whether it is permissible to use certain monies from the Water Fund ing Equip. to purchase these bonds. We hope for a favorable opinion. Trustee Schlaver, in absence of Trustee Willer, gave the report from the Board of Appeals. Zoning The first memorandum was as follows: Case 59-1 Boesche Date: Feb. 9, 1959 To: Board of Trustees Re: Petitioners Arthur & Evelyn Boesche, Case 59-1 The petition, originally filed as a request for a change in zoning from R-1 to I, was amended during the hearing to request s change in zoning from R-1 to I-1. The properties involved'are located along Prospect Avenue between School and Maple Streets. ~'~ The Board of Appeals voted 6-0 to recommend that the petition be granted as amended. '- Signed, E. F. February 10, 1959 Eoning The second memorandum was as follows: Case 59-2 St. Mark's Date: Feb. 9, 1959 To: Board of Trustees Re: Petitioner St. Mark's Lutheran Church, Case 59-2 The petition, originally 'filed as a request for a variation in zoning from R-1 to P-l, was amended during the hearing to request a change in zoning from R-1 to P-1. The phoperty involved is located at 201 South Wille Street. The Board of Appeals voted 6~O to recommend that the petition as amended be granted. Signed, E. F. Martin, Chairman Malcolm Young, Acting Sec. Trustee Schlaver, seconded by Trustee Norris, moved "that the Village Board concur with the recommendation of the Board of Appeals on Case 59-2, and that the Village Attorney be directed to prepare the necessary ordinance". The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris and Schlaver. Nays, none. Absent: Casterline and Willer. Whereupon the President declared the motion carried. The third memorandum was as follogs: Zoning Case 59-3 Date: Feb. 9, 1959 St. Paul's To: Board of Trustees Re: Case 59-3, Petition, St. Paul's Lutheran Congregation The petition is a request for a variation in the bu&ldilng line from 30 feet to 14 fett, 5 inches in front, and from the required 25 feet to 13 feet in the rear. The property involved is located on Busse Street between School and Elm Streets. The Board of Appeals voted 6-0 to recommend that the petition for variation be granted. No objectors appeared before the Board during the hearing on this case. There was no evidence that granting of the petition will impair an adequate supply of light and air to adjacent property, increase congestion in public streets unreasonably, increase the hazard of fire, endanger the public safety, diminish or impair the values of property within surrounding areas, or in any other respect impair the public health, safety~~ come, crt, morals and welfare of the c0mmuuity. Trustee Schlaver, seconded by Trustee Broad, moved that "the Village Board concur with the recommendation of the Zoning Board of Appeals granting this variation and that the attorney be directed to prepare the necessary ordinance in conformance therewith." The President put the question and the Clerk called the roll, with the following 'response: Ayes: Trustees Airey, Broad, Norris and Schlavero Nays, none. Absent: Casterline and Willer. Whereupon the President declared the motion carried. The fourth memorandum was as follows: Case 59-5 Date: Feb. 9, 1959 Carson Pirie To : Board of Trustees Re : Case 59-5, Petitioner, Carson, Pirie Scott & Co. This petition is a request for the rezonlng of acreage from R-1 to B-3 upon annexation to the Village. The property involved is located to the east of the property recently annexed, south of Euclid Avenue and north of Foundry Road. The Board of Appeals voted 6-~ to recommend that the petition be granted. Signed, E. F. Martin, Chairman Malcolm Young, Acting Sec. ~eh. lC, 1959 Case 59-5 was referred to the Judiciary Committee for stud~ and recommendation. Trustee Schlaver brought up petition for annexation of territory containing approximately 11 acres of farmland Gillespie- lying between Golf Road on the south, Lonnquist Parkway on the Moellenkamp north, and between Country Club Subdivision on the West and petition for Golfhurst Estates on the East. The Chicago Title & Trust Co. annexation is trustee, with Richard Gillespie as beneficiary. This property will be known as the Gillespie-Moellenkamp property until further notice. This petition has been referred to the Village Att~ny, and returned by him with letter of February 5th stating that it is in order. Trustee Schlaver, seconded by Trustee Broad, then moved that "the Village Attorney be instructed to prepare an ordinance for annexation of land under Trust No. 37503 of Chicago Title & Trust Company". The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris and Schlaver. Nays, none. Absent: Trustees Casterline end Willer. Whereupon the President declared the motion carried. Trustee Schlaver brought up Foreclosure Suit #59-S 18h8, Foreclosure and made the following motion, seconded by Trustee Norris: Suit #59-S 18h8 "that the said case be referred to the Village Attorney to represent the interests of the Village in court". The President put the question, the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris and Schlaver. Nays, none. Absent: Casterline and Willer. Whereupon the President declared the motion carried. Trustee Norris brought up Proposed Resolution 6-59: Res. 6-59 A RESOLUTION ASKING THE AUTHORITIES IN SPRINGFIELD Speed zones close TO AMEND THE STATE LAW TO SET SPEED ZONES NEAR to schools SCHOOL~ TO 15 MILES PER HOUR AND TO ALLOW SPEED LIMITS INSIDE VILLAGE LIMITS TO BE SET BY THE VILLAGE. Trustee Norris, seconded by Trustee Broad, moved for the passage of Resolution 6-59. The President put the question and the ~Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris and Schlaver. Nays, none. Absent: Trustees Casterline and Willer. Whereupon the President declared the resolution adopted'. President Lams read his appointment of Howard J. Wilson to Howard make~assessment of the cost of constructing sidewalks and improvement Wilson of Foundry Road and other streets. Trustee Airey, seconded by Trustee Commissioner Broad, moved to concur in the appointment of Howard J. Wilson as sidewalks Com~Lissioner of Sidewalk Assessment. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Norris and Sch/aver. Nays, none. Absent: Casterline and Willer. Whereupon the President declared the motion carried. Discussion was held regarding the County Zoning hearing that was held on January 29th, and it was generally agreed that County zoning it would be of benefit to all for United Airlines to be made a part hearing for of Mount Prospect. With this in mind, Trustee Schiaver, seconded air lines site by Trustee Broad, made the following motion: "that this Board instruct the Village Manager to invite s representative of United Airlines to meet with this Board at an informal meeting to be held in the near future in order to discuss the possibility of annexation". The above motion was carried by acclamation. President Lams referred to the letter sent to the Chicago & Northwestern Railway along with copy of Resolutin ~-~9 asking that Res. h-59 the depot in town be repaired, and read a reply from the railroad Depot repair stating that survey had been made and listing ~he repairs which they proposed to do. February 10, 1959 ake Michigan President Lams read a letter dated February ~th from water supply Co W. Klassen of Sanitary Engineering from Springfield, dis- cussing the use of Lake Michigan water by the entire Chicago area, expressing hope that a working arrangement can be made for utilizing Lake Michigan water for domestic water supply not necessarily predicated on its return as sewage effluent to the lake. President Lams read a letter from William Mortimer of the Department of Highways, stating that a public hearing will be held in the Village Hall at Arliington Heights regarding the widening of Palatine Road. Trustee Bread, seconded by Trustee Airey, moved to a~ourn, and the meeting was regularly adjourned at 9:14 P.M. This motion was carried by acclamation.
