AND BOARD OF TRUSTEES HE~D IN THE MUNICIPAL BLDG.,
Mr. PROSPECT, ON TUESDAY, NOVEMBER ll, 1958
The meeting was called to order~ at 8:27 P. M. by President
Lams and the Clerk was then directed to csll the roll. On roll c~1 l,
the following trustees answered Present: Trustees Airey, Casterline,
Norris, Willer and President Lams. Absent: Broad aud Schlaver.
~11 trustees having previously received copies of the minutes
of the meeting held November 4, 19~8, Trustee Airey, seconded by Trustee
Norris, moved that the minutes be approved as submitted. The President
put the question and the Clerk c~]led the roll, with the following
response: Ayes: Trustees Airey, Casterline and Norris. Willer passed
because he was absent the previous meeting. Nays, none. Absent: Broad
and Schlaver.
It was moved by Trustee Airey and seconded by Trustee Casterline
that the bills for the period ending November ll, 1958 be approved for
payment in the amounts of General Fund, $2,597.85, Water, $10,514.19,
Motor Fuel Tax, $2, 268.60, totalling $15,380.64. The President put the
question and the Clerk cslled the roll, with the following response:
Ayes: Trustees Airey, Casterline, Norris and Willer. Nays, none.
Absent: Broad and Schlaver.
~ Trustee Airey as chairman of Public Building & Grounds Committee,
~ reported on negotiations for land belonging to the bank for use as public public
~. parking lot. Some discussion followed, in which it was felt more desirable parking
to submit a referendum to the voters for the purchase of property for lot
off-street parking, rather than to buy such property on contract.
Trustee Casterline of the Police & Light Committee gave a traffic island
progress report which mentinned installing an island at Northwest Highway,
Busse and Wille Streets in order to change traffic pattern and secure
better control of traffic. I~provement of street lighting at Emerson
and Prospect, and Main and Prospect Avenue was also discussed. Village street
Manager Appleby w~11 discuss this possibility with the Public Service lights
~llan Bloch, attorney for Serafine, explained that a mistake
had been made in the legal description of the Serafine Sheppd_ng Center Serafine
property, which inadvertently annexed property on the West side of Shopping
Rand Road as well as that on the East. He thereupon submitted a corrected
plat to take the place of the former, which is that same as the first Center
except that it omits the property on the West side of the road. Vii]age
Attorney Downing explained that if the Board wished to amnex okly the
portion which was originally meant, an amendment ordinance must be
passed. Mr. Bloch at this time also submitted the letters req,~wed
previously, mentioned in the minutes of October 21st, pertaining to
reversion of the shopping center to the highest residential classifi-
cation, R-l, as it will exist in November, 1961, and also cogent to
disaunexation if the shopping center does not mmterialize on or before
November of 1961.
Trustee Willer thereupon made the following motion, seconded
by Trustee Airey: Serafine

~.~ the Village Attorney is directed to cause whatever modi-
fication need be made in order that the property to be
annexed under Ordinance #632 be the same as that shown
on the Plat of S~rvey by Anton J. Adams dated October 31,
1958, known as his Order #2560".
The President put the question and the Clerk c~11ed the roll,
with the following response: Ayes: Trustees Airey, Casterline, Norris,
and Wilier. Nays, none. Absent: Broad and Schlaver. Whereupon the
President declared the motion csrried.

Trustee Wilier made the following motion, seconded by
Trustee Norris:
"regarding the petition which resulted in Ordinance #633,
the Village Attorney is directed to cause whatever modi-
fication need be made in order that the property to be
zoned under Ordinance #633 be the same as that shown on
the Plat of Survey by Anton J. Adams dated October 31,
1958, known as his Order #2560".
Allan Bloch Attorney Bloch stated that he is willing to pay an~ additional
legal fees necessary to make these changes and w~ll pay such bills
submitted to him.
Trustee Wi 11 er requested Village Clerk Reynolds to read the
following letter f~om attorneys representing Martha Burmeister, owner
of the 80-acre tract known as Carson Shopping Center property.

AMENDED PETITION
To the President and
Board of Trustees of
the Village of Mt. Prospect:
1. Your Petitioner, Martha Burmeister, is the owner of record of the
real estate in Cook County, Illinois, legally described as follows:
The West half of the Southeast Quarter of Section 27,
Twp. 42 North, R ll EPM, except that part of said tract
falling in a lO0-foot strip, the center line of which
tis demcribed as follows: Beginning at the Northwest
corner of the Southeast Quarter of Section 27; thence
East along the North line of said Southeast Quarter a
distance of 550 feet to a point of curve; thence in a
generally Easterly direction along a curved line tangent
to said North line of the Southeast Quarter, convex to
Northerly, and having a radius of 24555.35 feet a distance
of 1028.57 feet to a point of taugency; thence in a
general Easterly direction along a straight line tangent
to the last described curved line · distance of 165.03
feet to a point of curve; thence in a general Easterly
direction slong a curved line tangent to the last described
straight line, convex Southerly and having a radius of
24555.35 feet for a distance of 1028.57 feet and also
except that part of said West Half of the Southeast
Quarter lJing Southerly and Westerly of the Northeasterly
line of the right of way of Rand Road.
2. Your Petitioner, Martha Burmeister, further states that the afore-
described lands owned by her are contiguous to the Vill age of Mount Prospect.
3. Your Petitioner further states that the only electors residing on
the sforesaid land are Edward F. Lewis mud Louise C. Lewis, tenants
of your Petitioner, Martha Burmeister, and that all such electors residing
thereon, namely Edward F. Lewis and Louise C. Lewis, join in this petition.

lands hereinbefore described and owned by Martha Burmeister into the
Village of Mount Prospect.

Sidley, Austin, Burgess & Smith explaining the reasc~ for the filing
of the above amended petition.
Trustee Willer, seconded by Trustee Airey, then made the petition
following motion: "that the Amended Petition of Martha Burmeister, accepted
E. F. Lewis and Louise Lewis be accepted as of November 10, 1958".
The President put the question and the Glerk called the roll,
with the following response: Ayes: Trustees Airey, Casterline, Norris,
and Willer. Nays, none. Absent: Trustees Broad and Schlaver. Whereupon
the President declared the motion carried.

Village Attorney Downing stated that letter and covenant as requested
in the minutes of October 21 (p. 150-151) had been submitted and were
acceptable. The President thereupon put the question, the Clerk c~d
the roll, with the followLug response: Ayes: Trustees Airey, Caster~ne,
Norris, Willer and President Lams. Nays, none. Absent: Trustees Broad
and Schlaver. Whereupon President Lams declared the motion carried and
Ordinance #639 passed.
Trustee Wilier, seconded by Trustee Casterline, then moved
for the passage of Proposed Ordinance #640:

The President put the question and the Clerk called the roll, with the

President Lams. Nays, none. Absent: Trustees Broad and Schlaver.
Whereupon the President declared the motion carried and Ordinance #640
passed.
Trustee Willer, seconded by Trustee Airey, then moved for
the adoption of Resolution 24-58: ~es. 24358

The President put the question and the Clerk called the roll, with the
following response: Ayes: Trustees Airey, Casterline and Willer, also
President Lams. Nays, none. Trustee Norris passed, stating that he
wanted to be consistent in his views in regard t~ the roads annexation
(Ord. #636, Nov. 4~. Absent: Trustees Broad and Schlaver. President
Lams explained that a 3-0 vote adopts a resolution.

This case concerns Lots 193-207 located on the
east side of Main Street between Central Road and Henry Street.
The Petition is a request to change the zoning
from R-1 to B-1.
The Board of Appeals voted 5 to O to recommend
that the petition for rezoning be denied.

Trustees Willer read the following memorandum from the Board
of Appeals:

Bolger - M~in and Central
This case was published for hearing August 14, 1958 and was
continued to the October 31 hearing.
The petitioner's proposal is by his own admission approximately
the same as he had previously made. This previous proposal, which was
offered a few years back, was denied by the Trustees. This denial was
u~held by the Supreme Court. The petitioner mistakenly referred to the
development on the west side of Main Street as evidence of ~ change of
conditions. There has been no change of conditions. There has bean no
business zoning change north of Central Road since the said court case.
The Board of Appeals found that there was again a lack of
evidence to support a rezoning request, aud that there was a noticeable
disregard of Village Zoning regulations.
The Presid~ht of the School Board reiterated his Board's
position in regard to business zoning immediately to the north of
Central School as creating a safety hazard to school children attenSing
Central School.
You will notice that the Board of Appeals cast a vote of
5 to O for e~anial. All seven members heard this case, with one member
disqualifying himself prior to the hearing. The other member excused
himself near the end of the meeting for personal reasons and was not
present when the vote was called.

This case was referred to the Judiciary Committee for study
and recommendation.
United Village Manager Appleby stated, regarding Northwest Meadows'
Fu~d. United Fund Drive (minutes, Nov. 4) that the Village msy approve such
Drmve action, but by such approval, the Village would not guarantee that
solicitors for individual d~ives would not solicit in Northwest Meadows.
A confirming statement will be made later.
Village Manager Appleby mentioned that it is desirable to
auditing select an auditing firm before the end of the fiscal year in order that
firm some of their detail work can be done during their slack per~ods, making
the audit reports available sooner. This matter was referred to the
Finance Committee.

Trustee Airey brought up the subject of installing a
switchboard in the Municipal Building. Mr. Appleby answered that
data is being acquired and conferences held with the telephone co~pany.
President Lams mentioned the revision of the Building Code Revision of
and appointed Trustee Broad as chairman of the committee, with Building
Trustees Willer and Airey as members. Code
Trustee Norris, seconded by Trustee Casterline, moved that
the Village Attorney be instructed to prepare an ordinance amending Daylight
the M, ml cipal Code changing the Daylight Saving Time to conform with Saving Time
the existing practice of Metropolitan Chicago. The President put the
question and the Clerk c~11ed the roll, with the following response:
Ayes: Trustees Airey, Casterline, Norris and W~ller. Nays, none.
Absent: Broad and Schlaver. Whereupon the President declared the
motion carried.
Trustee Norris, seconded by Trustee Airey, moved to adjourn.
The President put the question and the motion carried by acclamation.
The meeting was regularly adjourned at 9:50 P. M.
