PROSPECT, ILLINOIS ON TUESDAY, SEPTEMB~ 23, 1958 The meeting was c~11ed to order at 8:31 P. M, by President Lams and the Clerk was then directed to call the roll. On roll call, the following trustees answered "Present,: Airey, Broad, Casterline, Norris, Schlaver and Willer. Absent: None. Ail trustees having previously received copies of the minutes of the meeting held September 16, 1958, Trustee Schlaver asked that the minutes be corrected as follows: Deletion of that part of the sen- tence mentioning funds from Civil Defense being used as part of the purchase price of a new pu~oer truck. He had not made this particular suggestion. With this correction in mind, Trustee Norris moved and Trustee Broad seconded that the minutes be accepted as corrected. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Casterline, Norris, Schlaver and Willer. Nays: None. Whereupon the President declared the motion carried and said minutes approved as corrected. ~ It was moved by Trustee Airey and seconded by Trustee Broad ~ that the bill, s for the week of September 23, 1958 in the amount of Bills hO $1,132.42 be approved for payment. The President put the question and ~ the Clerk called the roll, with the following response: Ayes: Trustees ~ Airey, Broad, Casterline, Norris, Schlaver and Wilier. Nays: None. ~ Whereupon the President declared the motion carried. Clerk Reynolds then read the following memo to the members of the Board: High School "In reply to the invitation of the Board of Trustees to Board re ~-. the Board of Education, High School District #214, Land ~ Mr. Schlichenmeyer, President of the Board of Education, Dedication asks if this bod~ could meet with the High School Board on Monday evening, October 13, at 7:30 P. M. in the Board Room of Arlington High School". This invitation was accepted by the members, and the Clerk was directed to so notify Mr. Schlichenmeyer. Trustee Norris of the Street Committee reported that Raymond Rs~Umond Rosene has agreed to take care of his own paving, no special assessment Rosene to be levied, and will ~abmit either cash escrow or paid receipts on work done. Trustee Airey moved and Trustee Casterline seconded the Treasurer's motion that the Treasurer's report of August 31, 1958 be approved amd Report for placed on file. The President put the question and the Clerk called AugUst the roll with the following response: Ayes: Trustees Airey, Broad, Casterline, Norris, Schlaver and Willer, Nays: None, Whereupon the President declared the motion carried and the Treasurer's report approved. Trustee Willer read the following report from the Board of Appeals: Sept. 18, 1958 ~'~ Board of Trustees Case Village of Mt. Prospect Serafine Gentlemen: Case 58-16 This case concerns the 60 acres located on the northeast corner of Rand and Central Roads. The petition is for rezoning from R-1 to B-1 upon being annexed to the VLllage. The Board of Appeals voted 5 to 2 to recommend that the petitioned rezoning be ~110wed s/ F. MartZn Chairman, Board of Appeals September 23, 1958 Trustee Wilier, seconded by Trustee Broad, thereupon moved that "the Board of Trustees do hereby concur in the recommendation of the Board of Appeals on Case No. 58-16 as set forth in a letter from said Zoning Board of Appeals dated September 18, 1958, and direct that the Village Attorney be instructed to prepare the necessary ordinances for ~n~exation of the property legally described in the petition to annex said property; and that said property be zoned in accordance with the recommendation of the Board of Appeals, subject to the condition that the owners of said property submit to the Village Attorney satisfactory evidence of a covensnt running with the land or some similar legal restriction, wherein if a building permit for substanti~ly the same development as has been proposed in public hearing before the Mt. Prospect Board of Appeals and reported to the Village Board of the Village of Mt. Prospect in Case 58-16 has not been issued for said propeirby on or before three years from the date of the adoption of said annexation ordinance, the owners of the properby, their successors or assigns agree that proper action may.be taken to rezone said property to the R-l, Residence, classification". The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Casterline, Norris, Scblaver and Willer. N~ys: None. Whereupon the President declared the motion carried. Golfhurst Trustee Willer then read the following letter from the Plan Subdivsion Commission: Recommendation September 15, 1958 President and Board of Trustees Village of Mt. Prospect Gentlemen: The Plan Commission, to whom the proposed plat of Golfhurst was referred for stud~ and recommendation, recommends to the Village Board that the proposed plat be approved upon: "the addition to the plat of a covenant providing no direct access to Golf Road from the lots abutting thereo~, except Lot 22 as shown on the plat submitted and subject to dedication of land for public use in accordance with the Village Ordinances". Respectfully submitted, sS// A. C. Dresser, Chairman H. G. Appleby, Secretary Mr. Appleby pointed out that the owner of the land in question was Moellenkamp, and Semmerling the builder. This letter was referred to the Judiciary Committee for stud~ and recommendation. Trustee Willer reported that all of the m~mbers of the Board of Park Board Trustees were present at the meeting with the Park Board September 22, and that they have no recom~endation to give at the present time. Foreclosure Trustee Willer, seconded by Trustee Nor~s, moved that "the suit, Case Village Attorney, Robert Downing, be authorized to represent the Village 585S-13302 of Mt. Prospect in a foreclosure suit, Case 58-S-13302". The President put the question and the Clerk called the roll, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris, Schlaver and Willer. Nays: None. Whereupon the President declared the motion carried. Trustee Willer, seconded by Trustee Broad, moved that "the Elk Ridge two plats of survey submitted by Di Mucci for the land dedication of Villa ~ Elk Ridge Villa be referred to the Plan Commission for stud~ and Di Mucci recommendation',. The President put the question and the motion was carried by acclamation. September 23, 1958 Trustee Airey read proposed Resolution 20-58: Res. 20-58 A RESOLUTION RESCINDING RESOLUTION 15-57 WHICH DEALS WITH SIDEWALK SPECIFICATIONS Trustee Airey moved and Trustee Broad seconded that Resolution 20-58 be adopted. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Casterline, NGrris, Schlaver and Willer. Nays: None. Whereupon the President declared the motion carried and Resolution 50-58 adopted. Trustee Airey then read Proposed Resolution 21-58: Resolution 21-58 Sidewalk A RESOLUTION OF THE PRESIDENT AND BOARD OF TRUSTEES Specifications OF THE VILLAGE OF MT. PROSPECT CONCERNING SIDE~ALE SPECIFICATIONS Trustee Airey moved, seconded by Trustee Casterline, that the Resolution 21-58 be adopted. The President put the question auH the Clerk c~lled the roll, with the following response: Ayes: Trustees Airey, Broad, Casterline, Norris, Schlaver and ~ille~. Nays: None. Whereupon the President declared the motion carried and Resolution 21-58 was adopted. Trustee Willer moved that the conditions and proposals outlined in Resolution #21-58 be incorporated as an ordinance of the Village in order that the ordinances of the Village shall contain the same specifications for sidewalks as said Resolution, and that Sidewaks the Village Attorney be ~irected to propose such an ordinance. This motion was not seconded. Village Attora~y Downing stated that the experience in other towns showed that it was not necessary to do this, and legally just as defensible, to allow such a resolution to stand alone. Trustee Schlaver then moved, seconded by Trustee Broad, that "the Recommendation, Ordinance, Specifications of Proposed Sidewalk ~blication Assessment and Certificate of Clerk be published and that the Sidewalk Sidewalks Committee report on October 14, 1958". The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Casterlime, Norris, Schlaver and Willer. N~ys: None. Whereupon the President declared the motion carried. Trustee Norris reported that certain side streets are being Street heavily traveled by trucks as a short cut between highways, that Chief signs Whittenberg suggested posting Load Limit signs. The Street Committee has as yet no recommendations to make on this matter, n~ on the matter of elimination of septic tan~. Trustee Norris then read a memo from Village Manager Appleby to the Street Committee, dated September 19th: Tree trim This week Nels Johnson, Harry Miller and I looked over some of Dutch Elm the trees in the area where the trimming project started. There is disease some dead elm wood in these trees, and since the elimination of dead elm wood is the first defense against Dutch Elm disease, Mr. Johnson recom- mended that it be removed. We estimate that there are 7000 elm trees in the Village. This year, the third in which Dutch Elm disease has been identified here, we have had only lO infected trees out of almost 100 from which samples were sen~ in for analysis. Our loss from Dutch Elm disease is still only about l/lO of 1% of our tree population. This is an enviable record and is much better than our surrounding communities. It can be maintained only by constant observation, removal of dead elm wood, and spraying. The area that should be gone over now is generally the northeast quarter of the Village. This is where the program started. In our opinion it is impractical to survey the entire area to arrive at a close estimate of the work to be done. Our rough estimate is two months ($30O0-$3500). September 23, 1958 Inasmuch as our experience ~ith Mr. Johnson over the past 3 years has shown us that on a time basis we have no been overcharged; inasmuch as he has offered to do this work at the same price we were charged before, namely $3.~0 per hour; inasmu~ch as Mr. Johnson is recognized by the State of Illinois as one of the lea~ing tree men of the state; smd inasmuch as we have learned from our associations with him that he is able, honest, and above reproach, we recommend that we be authorized to hire him on a time basis to remove the dead elm wood in the area described. --~ At the time the appropriation ordinance was adopted this work was not anticipated. However, adjustments in the sppropriation can be made to cover this program if it is approved by the Board. Trustee Norris then gave the recommendation of the Street Committee: That in View of the amount of money spent so far for this work, the Committee feels it unwise to discontinue at this time. Trustee Norris, seconded by Trustee Broad, m then moved that "the Village Manager be authorized to e~loy NelS Johnson to trim the trees in the Northeast section of the Village for a sum not to exceed $4,000". The President put the question and the Clerk called the roll, .with the following response: Ayes: Trustees Air*y, Broad, Casterline, Norris, Schlaver and Willer. Nays: None. Whereupon the President declared the motion carried. Trustee Schlaver of the Fire and Water Committee reported that Wells work on the wells is proceeding so that the two major wells will continue to operate even in the event of power failure through regular chsnnels. Village Manager Appleby read the following letter from Consoer, Townsend & Associates, dated September 18, 1958~. MFT 13-CS Re: MFT Sec. 13-CS, Resurfacing of See Gwun Avenue & paving of Various ~-~ Center Parkways C.T. & A. #58-145 Dear Mr. Appleby: The State requires but ~oes not furnish to municipalities the services of design, control and testing of concrete and bitumiuous mixtures. It is customary for municipalities to hire a comgetent testing laboratory for this work, which includes testing materials and designing the mixtures, taking concrete cylinders, test-breaking these cylinders and furnishin~ reports to the State. We estimate from available information that the cost of the services for the referenced project will be approximately $200. This cost is eligible for payment from motor fuel tax funds. Inasmuch as the servides are professional, the State does not require bids. It is respectfttlly maquested that we be authorized to retain a testing laboratory for these purposes. Whereupon the President declared the motion carried. Village Manager Appleby reported that the contracts on MFT 13-CS Paving Project 13-CS had been signed and sent to Springfield, and approval should be imminent. September 23, 1958 Mr. Appleby also reported that the project of widening Central Road was also under way. Mr. Donald A. Willis, ~21 N. Emerson, representing the North- Willis - east Homeowners Association, raised the question from the floor as to shopping why both shopping centers could not be submitted and decided Epon at centers the same tine. The publication requirements were pointed out, and it was also mentioned that each case should be acted upon as presented. The approval of one shopping center does net preclude the possible approval of others. Mr. Mokate ef Northwest Homeowners questioned the legality of Mokate the votes of the Zoning Board of Appeals. This vote was 5 - 2 even questions though only six members were present. The Village Attorney stated that Zoning Bd. a member can vote even though not present at the hearing as long as a meeting was held for this vote. Mr. Hal Eoss of 517 N. Emerson, member of Board of Appeals, said that the vote was taken ~y telephone conversation. Mr. James Viger, 940 E. Northwest Nwyo, raised two points from Sidewalks the floor which dealt with sidewalks and trees adjacent to the Culligan Culligan Soft Water Building. Both were referred to a joint committee of Streets Co. and Sidewalks. Mr. J. Gibfried of 516 So. WiLliam presented a petition signed Weller Cr. by 33 homeowners asking that Waller Creek be fenced because it is an fence attractive nuisance to children. Mr. Dan Serafine, speaking from the floor, thanked the Village S~rafine Board and Board of Appeals for approving ~s petition to annex the Cae 58- 16 property at Rand and Central, Cas~ 58-16, and said, "We do plan to build this shopping center regardless of what other shopping centers will pop up in the ViLlage". The Board of Trustees received a card of thanks from the Winkelman fmmily for expression of sympathy regarding the passing of Clarence Winkelman. Trustee Willer, seconded by Trustee Norris, moved for adjourn- ment, which was carried by acclamation, and the meeting regularly adjourned at 9:45 P. M. Respectfully submitted, E.
