PROSPECT, ILLINOIS CN TUESDAY, SEPTEMBER 16, 1958 The meetiug was called te order at 8:14 P. M. by President Lams and the Clerk was then directed to call the roll. On roll call, the following trustees answered "PresentU: Airey, Casterlime, Norris, Schlaver and Willer. Absent: Trustee Broad. Ail trustees having previously received copies of the minutes of the meeting held September 9, 1958, it was moved by Trustee Willer and seconded by Trustee Airey that the minutes be approved as submitted. The President put the question and the Clerk called the roll, with the following response: Ayes: Trmstees Airey, Casterline, Norris, Schlaver and Willer. Nays, none. Absent: Trustee Broad. Whereupon the President declared the motion carried and said minutes approved as submitted. It was moved by Trustee Norris and seconded by Trustee Schlaver MFT that the Clerk be directed to open the two s~aled bids for paving of SEC 13~S See-Gwan and various islands as noted in MFT Sec. 13-CS. The President Paving put the question and the Clerk called the roll~ with the following islands and response: Ayes: Airey, Casterline, Norris, Schlaver~ Nays: Willer. See G~uu Absent: Broad. ,The President then declared the motion to open the bids carried. Trustee Willer made the point that he thought it was the policy of the Board not to accept less than three bids, but it was the consensus of opinion, with the advice of Mr. Cadigan of Consoer, Townsend, Village Engineers, that inasmuch as this is a small job it would be unlikely that ar~ more contractors would bid for the work. Mr. Schroeder spoke from the floor, stating that he lived at the conjunction of Busse Avenue and Elmhurst Roadj which is where one ef the islands is to be paved, and asked that this island be left as a parkway. Nis reasons were that he kept the grmmds in good order, and that th~ parkway acted to slow d~wn fast-moving traffic; also that it was useful as a depository for snow in the winter time. The bids were read by the Clerk and the V~llage Engineer retired Bids read with the Village Manager to examine them. Trustee W1~er moved, seconded by Trustee Casterline, to reject Move to both bids. Trustee Schlaver pointed out that even though a change was reject made in the paving of the islands, it was still necessery to pave See Gwu~ bids before the cold weather set in. Trustee Willer then moved, seconded by tabled Trustee Casterline, to table the aforementioned motion, which was carried by acclamation. Trustee Willer then read the following letter from the Plan Commission regarding the proposed plat of Brickman Manor: Brickm~ Presideut & Board of Trustees September 1%, 1958 Manor Land ~illage of Mt. Prospect Dedication Gentlemen: The Plan Commission, to whom the proposed plat of Brickman Manor was referred for stud~ and recommendation, recommends to the Village Board that the proposed plat be approved subject to: "dedication of land for public use as required by Village Ordinance or a contribution in lieu thereof as outlined in the letters to School District Nol 26 under date of September 5, 1958 and to the Mount Prospect Park District under date of September 15, 1958, provided, hewever, that this is acceptable to the Village Board',. Copies of the following letters are transmitted herewith: 1. Brickman Home Builders, Inc. letter to Feehanville School District No. 26 dated September 5, 1958. 2.Charles W. Greengaard Associates to School District No. 26 dated September %, 1958. September t8, 19~S 3.Brickman Home Builders, Inc. to Nount Prospect Park Board dated September 15, 1958. 4.Brickman Home Builders Inc. to President and School Board members of School, District No. 26 dated June 6, 1958. Trustee Willer then read the following letter from the Plan Elk Ridge Commission regarding recommendations for Elk Ridge Villa, Unit #l: Unit #1 September 15, 1958 President and Board of Trustees DiMucci Village of Mt. Prospect Gentlemen: The Plan Commission, to whom the attached proposed plat of Elk Ridge Villa, Unit #1, was referred for stud~ and recommendation, recom~ends that the proposed plat be approved subject to: "proper dedication cf useable land to the extent of 2~ acres, and further that the Village Board designat~ the proper municipality to which such land shall be dedicated as is outlined in the letter dated October 20, 1957 signed by Salvatore DiMucci, together with the furnishing of a plat of survey showing the exact location and dimension of the land to be dedicated". A letter dated Augnst 20, 1958 signed by Salvatore Di~.ucci, together with a plat of survey is also submitted herewith. Respectfully submitted, Mt~ Prospect Plan Co~,~,.~ssion sS// A. C. Case 58~5 Trustee Willer then read the following memorandum from the Holub Board of Appeals: Case 58-15: In this case we recomended -neavorably (subSect to a~nexation) because a Business classification would be, at the present state of planning, spot zoning. ~lso, it would commit the Village to more of the same along Central Road, and thus establish, with Village approval, highly undesirable "strip zoning". Conceivably this evil could develop also along Busse Road. Trustee Willer made the following motion, seconded by Trustee Airey, that the recomendation of the Board of Appeals should be upheld -- and that the Village Clerk be directed to notify the petitioner that his petition has been denied. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Casterline, Norris, Schlaver and Willer. Nays: Hone. Absent: Trustee Broad. Whereupon the President declared the motion carried. Trustee Willer read the followiug memorandum from the Board of Case 58-17 Appeals: Am. Legion Property Case 58-17: In this case a favorable recommendation is made (subject 17OO W. Oentraito annexation) because the property petitioned is flanked on both sides by I-1. Thus the request amounts to up-grading with ~espect to the adjo~n~ ~g property. Trustee Willer made the following motion, seconded by Trustee Schlaver, that the Board of Trustees concur with the recommendation September 16, 1958 of the Board of App~l.~. and that. the..Vfl I-ge. Clark be directed to notify the petitioner that his petition has been approved. The President put the question and the Clerk called the roll, with the following response: ~yes: Trustees Airey, Casterline, Norris, Schlaver and ~11er. Nays: None. Absent: Broad. Whereupon the President declared the motion carried. Trustee Will er, seconded by Trustee Casterline, moved that "the Village Attorney be directed to prepare an ordinance annexing the territory involved in Case 58-17, including the proper zoning-. The President put the question and the Clerk c~11ed the roll, with the following response: Ayes: Trustees Airey, Casterline, Norris, Schlaver and Willer. Nays; None. Absent: Broad. Whereupon the President declared the motion carried. Trustee Willer read the following memorandum from the Board of Appeals: Case 5~18 Case 58-18: This is a variation in land use, although the propossl North Main is for u~-grading. In this case the unfavorable recommendation is Street due to a high degree of land use. This is a +78% intensification over the use permitted by ordinance. We believe that if such a'variation were I.Green permitted, the requirements in our Zoning Ordinance would be meaningless. Also, the Village would bed at 'a disadvantage im opposing future var~tions of land use. The petitioner stated that he was not interested in this property if he could not get the variation for which he was a~king. We also Considered the damaging effect of the petitioned variation on the Route 83 and Lincoln court case. That case is currently in litigation. Trustee Willer, seconded by Trustee Schlaver, moved that the Board of Trustees concur with the recommendation of the Board of Appeals and that the Clerk in*orm the petitioner that his petition has be~m denied. The President put the question and the Clerk called the rol~ with the following response: Ayes: Trustees Airey, Casterline, Norris, Schlaver and Wtller. Nays: None. Absent: Broad. Whereupon the President declared the motion carried. At this point, Village Clerk Reynolds read the following letter from Edward Hofert, attorney for Irving Green: September 16, 1958 Boar8 of Trustees Village of Mt. Prospect Gentlemen: Re: Application for a variation filed by Irviu$ B. Green - Case 58-18 - It has come to mY attention that the Board of Appeals has recommended the denial of this applicatinn to vary the density requirements For apartment buildings from 2400 sq~we feet to 1300 square feet per unit. Should the reason for this denial be based on the question of density alone (the Board of Appeals letter having failed to state an~ specific reason ), then I would suggest a meeting between Mr. Green and such appropriate committee as might look into this question for the purpose of detarmini~g whether a lesser density might prove satisfactory to ~11 concerned. Since the property in question is presently zoned business, and will undoubtedly be used such in the near future, and since such a use could ~ell be detrimental to the Village at this location, I can see benefits derivable to all concerned if such a meeting could be arranged. Since Mr. Green's option, to purchase expires on September 30, 1958, I would suggest an early meeting. Sincerely, S/ Edward C. Nofert President Lams recommended that this letter be put on file. September 16, 1958 Speed Trustee Casterline gave the Police Eepo~t for the month of limit Aug,_st, and mentioned that steps have been taken to adjust the placing signs of 35 mph speed signs by the County Highway near Lincoln School. Postage Trustee Airey-brought up the fact that the recommendation to meter purchase a postage metering machine is still under consideration. Bills Trustee Airey, seconded by Trustee Norris, moved that the bills as of Septemberl6, 1958, in the amount of ~10,875.47 be approved for payment. The President put the question and the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Norris, Schlaver and Willer. Nays, none. Absent: Trustee Broad. Whereupon the President declared the motion carried. Fire & Trustee Schlaver gave the reports of the Fire and Water Committee Water and mentioned the need for another storage reservoir at Well #5, Report recommending also landscaping around this well. He also asked that the Board consider acquiring a pumper truck. Parking Trustee Schlaver also urged that the Board conside~ purchasing lot the parking lot now owned by the Bank for use as a Village parking lot. It was moved by Trustee Willer and s$conded by Trustee Casterline MFT that the MFT discussion be removed from the table. Mr. Cadigan reported 13~S that portions of the work co-~ld be removed from the bid and that if the Parkway Board decided not to pave a particular parkway this could be accomplished. islands Trustee Willer moved, seconded by Trustee Casterline, that the former motion to reject all bids be withdrawn. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Casterline, Norris, Schlaver and Willer. Nays, none. Absent: Trustee Broad. Whereupon the President declared the motion carried. Arcole After much discussion, Trustee Schlaver, seconded by Trustee Midwest Airey, moved that "the bid of Arcole Midwest of Evanston be accepted bid for the sum of $16,752.71, subject to State approval". The President accepted lput the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Casterline, Norris, Schlaver and Willer. Nays, none. Absent: Trustee Broad. Whereupon the President declared the motion carried. It was decided to delete the paving of the island at Busse Avenue and Elmhurst in deference to Mr. Schroeder,s request, and upon the advice of Mr. Cadigan of Consoer, Townsend, the request for deletion will be forwarded to the contractor, who will deduct the amount set aside for that part of the work from the contract. Consider Trustee Norris introduced a copy of the swimming pool ordinance swimming of the city of Park Ridge, asking that such an ordinance be considered pool by the Board to promote health and safety regarding private swi~m~ng ordinance pools installed by home owners. Prospect President Lams reported that the meeting with citizens living Manor on North Prospect Manor was held the previous Saturday as scheduled, elm trees ~ regarding the placing of sanitary sewers by the Metropolitan Sanitary District, and that the Village Manager has prepared a letter to be sent to Mr. Girard of the Sanitary District regarding this matter. He added that the Village hopes to receive a reply in the near future so that the people concerned may be notified. Prospect parks Dear Mr. Reynolds: In~ reply to your letter inviting the Board of Commissioners to meet with the Village Trustees, the Board would be-very happly to oblige. A meeting of this type would be preferable on any Monds~, and upon your advising me when this would be convenient with the Village Trustees, I would be happy to arrange the same with ~y Board. Prospect Park District Trustee Willer, secohded by Trustee Norris, moved that "the Village Clerk inform the Park Board to meet with the Board cf Trustees nexb Monday, September 21, 1958 at 8:30 PM at the Village Hall". The motion was carried by acclamation. Trustee Norris, seconded by Trustee Willer, moved that Meeting with "the Village Clerk ask the Nigh School Board, District #214, if High School- the Board of Trustees may meet with them at their c~nvenience". Land Dedi- This motion was also carried by acclamation, cation Mr. V. T. Budris, 10 North Waveriy, spoke from the floor. Trustee Casterline, seconded by Trustee Norris, moved for adjournment, there being no further business to come before the Board.
