HomeMy WebLinkAboutOrd 5205 08/07/2001 ORDINANCE NO. 5205 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 305 DOUGLAS AVENUE PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES THE 7TM DAY OF AUGUST, 2001 Published in pamphlet form by authority of the corporate authorities of the Village of Mount Prospect, Illinois, the 8th day of August 2001. w,I 7/26/01 811101 ORDINANCE NO. 5205 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 305 DOUGLAS AVENUE WHEREAS, Donald Craig (hereinafter referred to as "Petitioner") has filed a petition for a Conditional Use permit with respect to property located at 305 Douglas Street (hereinafter referred to as the "Subject Property") and legally described as follows: Lot 2 in Craig's Subdivision Phase 3, being a Subdivision of part of the West ½ of the SW ¼ of the SE ¼ of the NW ¼ of Sec. 10, Township 41 North, Range 11 East of the 3rd Principal Meridian in Cook County, IL. Property Index Numbers: 08-10-114-141 08-10-114-142 and WHEREAS, the Petitioner seeks a Conditional Use permit to construct a circular driveway; and WHEREAS, a Public Hearing was held on the request for a Conditional Use permit, being the subject of ZBA Case No. 17-01, before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of July, 2001, pursuant to proper legal notice having been published in the Mount Prospect Journal & Topics on the 11th day of July, 2001; and WHEREAS, the Zoning Board of Appeals has submitted its findings and positive recommendation to the President and Board of Trustees in support of the request being the subject of ZBA 17-01; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use permit would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. age 2/2 305 Douglas Street SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use permit, as provided for in Section 14.203. F.7 of the Village Code, to allow the construction of a circular driveway, as shown on the Site Plan, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A." SECTION THREE: Prior to the issuance of a building permit relative to the Conditional Use permit, the following conditions and/or written documentation shall be fulfilled: 1. A Plat of Subdivision shall be accepted by the Village Board and recorded with the County; 2. If the subject property is subdivided at a future date with the north portion of the lot having a frontage of less than 150 feet, the circular driveway will be removed by the petitioner; 3. Brick pavers shall be used to construct the driveway. SECTION FOUR: That the Village Clerk is hereby authorized and directed to record a certified copy of this Ordinance with the Recorder of Deeds of Cook County. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
