PROSPECT, TUESDAY, APRIL 21, 1959 The meeting was called to order at 8:16 P.M. by President roll call Lams. Upon roll call, the following trustees answered Present: Airey, Broad, Casterline, Norris and Schlaver. Trustee Wlller was still at the polling places checking on the vote, this being election day. Village Clerk Reynolds was busy with the election, so Deputy Clerk Gardner acted as Clerk until his arrival with the returns. All the trustees had previously received copies of the minutes of April 14th. Trustee Airey had two corrections to make. On P. 263, §th paragraph, add the following clause after the word "themselves,: minutes "thus constituting a commercial operation in a residential district". Then Trustee Norris, seconded by Trustee Broad, moved that the minutes be accepted as corrected. The President put the question and the Deputy Clerk called the roll, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris and Schlaver. Absent, Trustee Wilier. Trustee Airey, seconded by Trustee Casterline, moved that the bills for the week ending April 21st be approved as follows: bills General $9,331.86 Garbage 38.70 Library 929.69 Water 5,234.68 Parking Syst. Revenue Fund 2,202.40 $17,737.13 The President ~mt the question and the Clerk called the roll, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris and Schlaver. Absent: Willer. Whereupon the President declared the motion carried. Trustee Airey, seconded by Trustee Casterline, read propo sod Resolntion 14-59 and moved for its adoption: Res. 14-59 A RESOLUTION AUTHORIZING THE TREASURER Luvestment TO ~v~ST MONIES RECElV,:D FROM THE SALE OF FIRE EQUIPMENT B~DS IN U.S. TREASURY BILLS The President put the question and the Clerk called the 'roll, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris, and Schlaver. Absent: Willer. Whereupon the President declared the motion carried and Resolution 14-59 adopted. Trustee Airey read a proposed addition to the zoning ordimance Zoning appeal which would add a golf course classification, and made the following re golf motion: "That the Clerk be directed to publish a notice of hearing course classi. by the Zoning Board regarding this appeal, that the Zoning Board fication be requested to hold such a hearing, and that the Village Attorney be requested to represent the Village at said hearing". This motion was seconded by Trustee Broad. The PresideAt put the question and the Deputy Clerk called the roll, with' the following response: Ayes, Trustees Airey, Broad, Casterline, Norris and Schlaver. Absent, Trustee Willer. Whereupon the President declared the motion carried. Vfllage Attorney Downing was asked if he could appear on behalf of the Village in Zoning Case 59-14, to be heard April 24th, in which the Country Club has put dow~ the deposit for hearing wherein request is being made to change the R-1 classification of the Zoning Code. Mr. Downigg stated that he was booked for that night, whereupon President' Lam~ offered to appear, with perhaps one or two of the trustees . April 21, 1959 ire Equip. Trustee Schlaver stated that he would like to make the Bid - record clear regarding acceptance of fire equipment bid from American American La France Company, and made the following motion, seconded La France by TruStee Casterline: "That the bid for the fire equipment be accepted from American La France Company, and that the Village Manager be directed to place orders for same with that company". The President put the question and the Clerk called the roll, with the following response: Ayes, T~,,_stees Airey, Broad, Casterline, Norris and Schlaver. Absent, Trustee Willer. Whereupon the President declared the motion carried. Trustee Schlaver gave the Fire Department report for the month of March and Trustee Norris reported on the progress of the Board of Health program. Trustee Norris gave a report on the Motor Fuel Tax Program, Motor Fuel listing the following streets to be repaired at this time by Tax program raising and lowering manholes, adjusting curb and gutter end re- surfacing with 1-11. Streets to be Pine St. from Prospect Ave. to Council Trail improved Milburn from Pine to Elmburst Ioka from Prospect Ave. to Council Trail Busse Ave. from Emerson to Wille St. and Northwest Highway East Evergreen from Maple St. to Elm Elm St. from Central Road to Busse Ave. Council Trail from Emerson St. to Elm St. South Main St. from Lincoln Ave. to Shabonee Trail Trustee Norris, seconded by Trustee Airey, moved that the Village engineers be directed to prepare a resolution requesting that the following streets be made arterial streets, and also to direct Consoer, Townsend to prepare plans and specifications providing for the foregoing ~mprovements under~ the MFT program. Absent, Trustee Willer. Whereupon the President declared the motion carried. Discussion arose regarding signs alO~g the road at the edge of town. Trustee Broad mentioned he wo~ld like to see one large, road signs neat sign instead of the several signs put up by various organizations that are there now. There was general agreement by the other trustees. Mr. Appleby stated that Louis Munao has been co-operative and has complied with all Village requirements regarding his subdivision. Trustee Bread agreed that' this was so, making favorable comment, and Louis Munao' s moved that approval be granted to Louis. Munao for installation of First Sub- public improvements in Louis Munao' s First Addition Subdivision division (south of creek) by private contract in accordance with Village. Addition Ordinances, subject to approval of the sewers by the Metropolitan Sanitary District of Greater Chicago, This motion was seconded by Trustee Norris. The President put the question and the Clerk called the fell, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris and Schlaver. Trustee Willer was still at the polls. Whereupon the President declared the motion carried. April 21, 1959 Trustee Broad, seconded by Trustee Casterline, moved that permit be granted to Lawrence Baugh, 410 South Albert, to erect fence an $ ft. fence along the south side of his property in order to permit screen nearby business area from his residential property. The President put the question and the Clerk called the roll, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris, and Schlaver. Na~s, none. Absent, Trustee Willer. Whereupon the President declared the motion carried. Motion was made by T-~rustee Airey, seconded'by Trustee Norris, directing the Village Attorney to incorporate Ordinance No~ 513 into Tree the Municipal Code. This ordinance refers to spraying of trees for ordinance Dutch Elm Disease. The President put the question and the Clerk called the roll, with the followin~ response: Ayes, Trustees Airey, Broad, Casterline, Norris and Schlaver. Absent, Willer. Whereupon the President declared the motion carried~ Trustee Schlaver read the following report from the Board of Appeals: April 21, 1959 Case 59-13 Board of Trustees Petitioner: Re: Hearing on Case 59-13 Chester Date: April 17, 1959 Busse A petition by Chester E. Busse requesting zoning ordinance to change from R-1 to Industrial Lot 1 of the property located at the intersection of Prospect Avenue and Maple Street. Itis the petitioner, s intention to build car washing and grease racks. The Board of Appeals voted to grant this reguest. S/ E. F. Martin, Chairman S. W. Geodenough, Acting Sec'y Trustee Schlaver, seconded by Trustee Norris, moved that the Board of Trustees concur in the action of the Board of Appeals, and that the Village Atto~ey be directed to prepare an ordinance reclassifying this property from R-! to Industrial. The President put the question and the Clerk called the roll, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris and Schlaver. Absent, Trustee Willer. Whereupon the President declared the motion carried. Trustee Willer returned from his duty as watcher at the polls and took his seat at 9:08 P.M. Trustee Schlaver brought up the Boesche matter (ZOning Case 59-1) asking the Board to reconsider its previous action on its zoning Case 59-1 reco~w~endation. Trustee Willer made a motion to this effect, seconded Boesche by Trustee Schlaver, stating that he would rather not have this case come to court. President Lams pointed out that a street outlet at that point is bad~ needed. Mr. Ward, attorney for Mr. Boesche, stated that a street dedication from this property would necessarily co,rise 25% of his client,s area and constituttes a great hardship; that this p~ce of land has been in the Village from the beginning and that Mr. Boesche does not intend to sell or build on this property, but to use it in the same fashion as it is used now. Mr. Downing pointed out that according to Robert's Rules of Order this motion could not be reconsidered, as more than one meeting had passed since action was taken. Trustee Wilier thereupon moved to suspend Section #2.206 of the Municipal Code (Robert's Rules of Order) for this one case, and reconsider the Boesche problem. Trustee Airey seconded this motion. The President put the question amd the Clerk called the roll, with the following response: Ayes, Trustees Airey, Broad, Casterline, Norris, Schlaver and Willer. Nays, none. Whereupon the President declared the motion carried. President Lams thereupon referred the above matter to the Street Committee for further study. Tx"~stee Willer read an ordI~nance amending the salaries of the trustees, allowing $1§- per trustee for each meeting attende~, provided there was no more than one meeting per week. This new ordinance would salar~e~ of trustees April 21, 1959 68 apply only to members of the Board beginning their four-year term at this t{me. He further ~aggested that there be meetings only every other wee~ instead of every week, as it was his feeling that the excessive growth and expansion of the past had slowed down, and that unlike the situation of a few years past, the V~]lage now has the full time services of a Village Manager to keep things going. He also Suggested that the Village Attorney be present at each such bi-weekly meeting. Trustee Willer then moved that the foregoing ordinance be passed. - Thi~as seconded by Trustee Broad. The President put the question and the Clerk called the roll, with the-following response: Trustee Airey, nay; Trustee Broad, aye; Trustee Casterlime, nay; Trustee Norris, nay; Trustee Schlaver, nay; Trustee Willer, aye. The President declared the motion defeat~ed. St.Mark' s Trustee Willer brought up the case of St. Mark's Eutheran Lutheran Church, Case No. 59-2, mentioned in the minutes of April 14, p. 262. Ease 59-2 This was turned over to Attorney Downing for his recommendation for action by the Judiciary Committee. Village Clerk Reynolds took his seat at 9:45, carrying with him the returns of the election. Motion was made by Trustee Willer and seconded by Trastee Norris that the Clerk open and read the return. This motion was Election carried 'by acclamation. April 21, 1959 Trustee Wilier moved, seconded by Trustee Broad, that the Res. 15-59 following resolution, No. 15-59 be approved: Canvassing RESOLUTION DECLARING TH~ RESULTS OF THE REGULAR Resolution ELECTION HELD ON TUESDAY, APRIL 21, 1959 The returns of the election held on the-21st day of April, having been duly made to the village clerk, a~d having been canvassed in open meeting, now, therefor, be it resolved that E. ROBERT REYNOLDS be declared, to be elected Clerk, and that PARKER EERE~, ARTHUR GAW and C~CE O. SCHLAVER be declared to have been elected trustees; also that RUTH ANDERSON And NETA BITTNER be declared to 'have been elected directors of the public library. The President put the question and the Clerk called the roll, with the following response: Ayes: Trustees Airey, Broad, Casterline, Norris, Schlaver and Willer. Nays, none. Whereupon the President declared the motion carried and Resolution #15-59 adopted. Trustee Wilier, seconded by Trustee Broad, moved that the Clerk open and read the returns on the blue ballot referendum. This Blue ballot motion was carried by acclamation. The Proposition and returns were as follows: returns It is proposed to improve Prospect Avenue between Emen~on Street and Pine Street with Motor Fuel Tax funds at no expense to the property owner. A. Shall the trees in the central parkway of Prospect Avenue be left as they now are, amd the street improved by widening the paved roadways and curbing the central parkway? Votes - 1,239 B. Shall the trees in the central parkway of Prospect Avemae be removed and the parkway completely paved? Trustee Willer read the report from the Zoning Board on Case 59-10: · The petition was a request for rezening from E-! to B-B for the Case 59-10 property located on East Northwest Highway between Edward and George Rezoning Streets. Roy Wallen reques~ted rezoning on Lot $ and Roy Collignon requested rezening on Lots 5 and 6. Lots 1 to 4, 7 and 9 have previously beon rezoned to B-3. The Board of Appeals voted to recommend the petition be granted. There were no objections.- Trustee Willer, seconded by Trustee Airey, moved that the recommendation of the Zoning Board Of Appeals be approved and that the Village Attorney be directed to prepare the necessary ordinsmce bringing about the chan~e. April 21, 1959 Trustee Willer read the report from the Zoning Board on Case 59-11: Case 59-11 St. Paul's "This case iuvolved a petition from St. Paul's Lutheran Church, Lutheran asking variation changed frc~ Approved Variation in Case 59-3 to Church allow B ft. more in front of building and B ft. less in back of building. The Board of Appeals voted to grant the request." Trustee Wfller read the report from the Zoning Board of Appeals Case 59-12 regarding Case 59-12: Advertising sign "This involved a request te grant a temporary variation in zoning to allow the erection of a sign on property at 208 West Orchard Place. The petitioner is Orchard Terrace Home Builders from Franklin Park. The Board of Appeals voted to grant this request." Trustee Willer, seconded by Trustee Afrey, moved that the Board of Trustees concur in the recommendation of the Board of Appeals. Trustee Willer read the followi~ letter from Serafine Builders: Serafine - April 21, 1959 liquor President and Village Board licenses for shopping ATTN: Mr. Raymond Willer, Judiciary Committee 'center Gentl omen: lm reference to the Northwest Shopping Center to be erected on Central and Rand Road, I call your attention to the resolutien recently passed whereby the Village Board expressed its intention to provide liquor licenses for Hillman's and Walgreen's if they should become tenants in this shopping center. Please be advised that these companies are about te make application for liquor licenses, and I request that the Board consider action to amend Section 1B.lO? of the Municipal Code so as to increase the number of Class C licenses to permit these two additional licenses to be granted. S/ Dan Serafine Trustee Willer, seconded by Trustee Broad, moved that the Village Attorney be directed to amend that section of the Municipal Code so as to increase the number of Class C licenses for liquor by two, and that the attorney prepare the necessary ordinance. Whereupon the President declared the motion carried. Trinity Trustee Wilier read a petition from the Trinity Methodist Church Methodist for annexation of property at the Southwest corner of Linneman and Golf Church Roads, to be used for church purposes. Upon examinatio~ of the plat by the trustees, however, it was decided that the plat was incomplete and was referred to Village Manager Appleby to see to it that completio~ was made by the petitioner. April 21, 1959 Mr. Ward, attorney for Arthur Boesche, (Case 59-1) arose Case 59-1 and requested a reprieve from the Building Department in view of Boesche the fact that a summons from the Superior court of CooE county has been served on the Village. Mr. Lams assured Mr. Ward that the letter from our Building Department may be considered as having been with- drawn at this time. Trustee Willer, seconded by Trustee Norris, moved that the Village Attorney be authorized to represent the imterests of the Village regarding Case No. 59-S-6257, Arthur a~d Evelyn Boesche vs. Village of Mou~t Prospect, Superior Court of Cook County. The President put the questien and the Clerk called the roll, with the following response: Ayes, Trustees Airey, Broad, Casterlime, Norris, Schlaver and Willer. Nays, none.
