PRESIDENT AND BOARD OF TRUSTE~ HELD
IN TH~ MUNICIPAL BUILDING, VILLAGE OF
MOUNT PROSPECT, TUESDAY, APRIL 14, 1959
The meeting was called to order at 8:30 P.M. by President Lams.
Upon roll call, the following trustees answered Present: Airey, roll call
~.~ Broad, Casterline, Norris and Schlaver. Absent, Willer.
All trustees having previously received copies of the minutes
of April ?th, Trustee Airey, seconded by Trustee Broad, moved that the
minutes be accepted as corrected. The correction is the insertion
of Trustee Broad's name instead of Trustee Willer's on Page 255, minutes
wherein mention was made of reading of letters of reply. The President
put the question and the Clerk called the roll, with the following
response: Ayes, Trustees Airey, Broad, Casterline, Norris, and
Shhlaver. Nays, none. Absent, Willer. Whereupon the President
declared the motion carried.
Trustee Airey, seconded by Trustee Casterline, moved that bills
the bills for the week ending April 14th be approved as follows:

The President put the question and the Clerk called the roll, with
the following response: Ayes, Trustees Airey, Broad, Casterline,
Norris, Schlaver. Na~s, none. Whereupon the President declared
the motion carried.
~-~ Trustee Airey, seconded by Trustee Casterline, moved bhat Treasurer's
the Treasur~er's report for the month of March, 1959, be approved Report for
and placed on file. The President put the question and the Clerk March, 1959
called the roll, with the following response: Ayes, Trustees
Airey, Broad, Casterline, Norris and Schlaver. ~nereupon the President
declared the motion carried.
Trustee Airey mentioned the fact that even though the County
tax bills will be brought out late, the Village will not have to Taxes
issue Tax Anticipation Warrants, as it is in good financial shape.
President Lams mentioned the fact that hearing was held in
court on April 1Bth, the previous day, on Sidewalk Assessment No. 59 Sidewalk
and asked Village Manager Appleby to report on the proceedings that Assessment
took place. No. 59
Mr. Appleby reported that the sidewATk hearing was before
Judge Otto Kerner. Judge Kerner raled that protests in written form
could be submitted by April 24th. Quite a number of people ex-pressed
willingness to put in sidewalks at this late date if they ~ould not
also be assessed for same by the Village. Judge Kerner stated that
this was all right with the court if it were also all right with the
Village, providing the walks were in or escrows filed before the last
day for filing of objections. The Board discussed this, and Trustee
Airey then made the following motion: That the Board is in accordance
with Judge Kerner's suggestion that the Village accept escrow agreements
for installation of sidewalks on a private basis up to and including
April 23rd, and also that escrow fee of $10- per case be submitted with
the escrow to cover handling costs.
Trustee Schlaver seconded the above motion. The President put
the question and the Clerk called the roll, with the following response:
Ayes, Trustees Afrey, Broad, Casterline, Norris and Schlaver. Nays,
none. Absent, Willer. Whereupon the President declared the motion

Trustee Casterline gave the monthly Police Report and then
stated that a survey had been made with the idea of establishing
Through through, or arterial, streets. Mr. Appleby displayed a map of the
Streets Village which indicated with colored pins where most accidents take
place. The Director of the Safety & Traffic Engineering Department
of the Chicago Motor Club wrote as follows:
"Upon receipt of your letter pertaining to a comment on
your proposed through street program, we assigned one of
our engineers to make a study. Following is a summary
of our findings: ·
(1) The suggested through streets are residential in
nature and consist of local traffic. These streets
carry a low volume count.
(2) The sight distances at the approach to the inter-
sections on these proposed through streets were generally
very good.
(B) It was noted that there were many 20 ~oh speed limit
signs posted as well as 4-way and 2-way traffic sign
controlled intersections.
"It is our recommendation that these streets continue as resi-
dential in character and, consequently, Dot face the problem
of increased speeds which is typical of a designated
through street. The number of present through streets
should be adequate to handle any through movement in your
municipality".
Mr. Appleby made the following recommendations:
Safety Drive
1. That a concerted drive be continued by the Police Department to
slow down traffic in all residentia! areas.
2. That the Police Magistrate be urged to levy heavier penalties
for traffic violations in residential areas.
3. That while stop signs are not intended to slow down traffic,
that 4-way stops be installed on a trial basis at Gregory and Maple
Streets (Chief Whittenberg has this in his monthly report also)
and at Gregory and Elmhurst. These, may jar day-drean~ing drivers
awake or slow down recklessly rushing motorists. Slow signs should
be placed along Gregory Street by Fairview School.
4. That Paddock Publications be urged to continue their articles
on traffic safety, and
5. That divic clubs be urged to cooperate in making the slogan
"Slow Down and Live" a rule for driving in Mount Prospect.
Trustee Casterline, seconded by Trustee Broad, then moved
"that the Board concur with the recommendations as outlined by the
Village Manager on his memorandum dated AprS_l lC, 1959". The President
put the question and the Clerk c~led the roll, with the following
response: Ayes, Trustees Airey, Broad, Casterline, Norris and Schlaver.
Nays, none. Absent, Willer. Whereupon the President declared the
motion carried.
Ethel Busse Trustee Airey then read the following letter from the Plan
Subdivision Commission in regard to the Ethel Busse Subdivision:

Village Board, Mount Prospect
Gentlemen:
In the interest of saving time, the Plan Commission has
studied the attached plat of Ethel Busse~s Subdivision, which sub-
division contains approximately 4.43 acres, prior to the referral
April 14, 1959
of said plat to the Plan Commission by the Village Board.

The Plan Commission recommends to the Village Board that Subdivision
the attached plat of Ethel Busse's Subdivision be approved subject to:
1. The extension of the west half of Maple Street
BB ft. in width, Southward to East Lincoln Street.
2. Showing of 30 foot building setback lines as required
by ordinance.
3. Public utility easements being shown as required by
ordinance.
4. Dedication of land for public use as required by
ordinance.

A discussion was held with Mr. Chester Busse, who stated that this
plat had been approved by the Board before, in 1956, but never was
recorded with the County. He said that if he were required to dedicate
land or put up cash in lieu of dedication he co~d not afford to use
part of the land for a parking lot,as it now is; that he would have
the whole tract zoned industrial. He also brought out that he was not
previously required to dedicate land for street.
The following is an excerpt from the minutes of December 18, 1956,
beginning on Page 224, Book No. 4:
"The following communication was then read:
November 2, 1956
President and Members of the Board
of Trustees of the Village of Mt. Prospect
Gentlemen:
Attached hereto is a print of Ethel Busse's Subdivision plat
which was heretofore referred to our commission for stud~. Upon exam-
ination of said plat we feel that the Subdivider should dedicate a full
33 ft. street on Maple St. in lieu of a partial dedication of 327.66 ft.
This should be done in order to have proper ingress and egress to the
surrounding area and-to have the required continuity of full streets
and to eliminate hazardous jogs. Lot 2 shown on the plat would still
have sufficient frontage after the dedication is made.
"We recommend that the plat be rejected for the reasons above
stated.

"A motion was then made by Trustee Wilier to concur in the recommendations
of the Plan Commission and that the Village Clerk be instructed to inform
the owner of the rejection of the plat. ~nere was no second to this
motion.
/"A motion was then made by Trustee Willer, seconded by Schlaver, to
approve the plat of Ethel Busse's subdivision as submitted. The President
put the question, the Clerk called the roll, with the following response:
Ayes, Trustees Airey, Schlaver, Viger, Wier and Willer and Wilson. Nays,
none. 'Thereupon the President declared the motion carried."

Subdivision After further discussion, Trustee Airey, seconded by Trustee
Schlaver, made the following motion: "In view of the previous action
by the Board and in consideration of ~he present use of the land,
that the plat of Ethel Busse Subdivision be approved by the Board
showing the building setback lines and public utility easements
alread shown thereon~.
The President put the question and the Clerk called the r Oll, with
the following response: Ayes, Trustees Airey, Casterline, Norris,
Shhlaver. Nays, Broad. Absent, Wilier. Whereupon the Presiden~
declared the motion carried.
1st Addn. to Trustee Airey read the following letter from the Plan
Moehling's Commission re First Addition to Moeh~g's Pleasant Dale Subdivision:

Gentlemen:
The Plan Commission to whom was referred the attached plat
of the First Addition to Moehling's Pleasant Dale Subdivision recommends
that the plat be approved subject to the dedication of land for
public use and compliance with all Village Ordinances thereto
appertaining.

Trustee Airey read the report from the Board of Appeals on
Case 59-9 Case 59-9, Doyno Motors as follows:

Motors ~This petition is a request to rezone propertz known as Lot 12,
Block 22 in Prospect Manor Subdivision, located i~uth~ 500 block
on Northwest Highway, from R-1 to B-B, As this is the only R-1
left in this block, the Board of Appeals voted 6-0 to recommend
that the petition be granted."
Trustee Airey, seconded by Trustee Norris, made the following
motion regarding this case: "That the Board concur in the recommendation
of the Zoning Board of Appeals and that the Clerk be directed to call
the attention of Doyno Motors to the use of the land, Which is to
p~ovide customer parking; also that the Village Attorney be directed
to prepare the necessary ordinanc~ changing the zoning."
The President put the question and the Clerk called the roll, with
the following response: Ayes, Trustees Airey, Broad, Casterline,
Norris and Schlaver. Absent, Willer. Whereupon the President declared
the motion carried.
Trustee Airey read the following letter from the Board of

There is no finding of fact; the Board of Appeals recom~.~ends
that if this cam~ is considered a variation, the case should be
denied.
It is unfortunate that the petitioner was advised by the
Village to ask for a variation for parking and playground when in fact
the record shows that the primary purpose is for off-street parking
and the incidental use is for basketball. We respectfully suggest
that we have a zoning classification for off-street parking. T,t is
for that principal use that the Board of Appeals made their favorable
recommendation.

Trustee Broad, after giving the monthly Building Report, read
~roposed Ordinance #665 and moved for its passage. Trustee Airey
seconded this motion. Ordinance #665
Swimming Pools
AN ORDINANCE TO AMEND THE MT. PROSPECT BUILDING CODE
BY ADDING A CHAPTER TO PROVIDE FOR TH~ CONSTRUCTION,
¥~INTENANCE AND OPERATION OF PRIVATE SWIMMING POOLS
LOCATED WITHIN THE VILLAGE LIMITS AND TO PROVIDE FOR
PERMITS FOR SAME.
The President put the question and the Clerk called the roll, with
the following response: Ayes, Trustees Airey, Broad, Casterline,
Norris and Schlaver. Absent, Willer. Whereupon the President declared
the motion carried.
Trustee Broad, seconded by Trustee Norris, moved that a building
permit be granted to Edward Busse to build a demonstration swimming swimming pool
pool at the Northeast corner of School Street and Northwest Highway, building permi~
subject to Ordinance #665. The President put the question and the
Clerk called the roll, with the following r&sponse: Ayes, Trustees
Airey, Broad, Norris and Schlaver. Nays, Casterline. Absent, Willer.
Whereupon the President declared the motion carried.
Trustee Airey stated that he had thought over the motion of
the previous week regarding Country Clubs (p. 252) and had decided Country Club,
that the club as now used is not actually a private club as it is Golf-course
owned by interests who collect dues from meJmbers and is not ~ by Zoning
the members themselves, thus constituting a commercial operation in
a residential district, and therefore put forth the following motion:
"That the Village Attorney be directed to prepare an amendment to the
Zoning Ordinance creatiAg a golf-course zoning classification, upon
which a hearing will be held".
The President put the question and the Clerk called the roll, with the
following response: Ayes, Trustees Airey, Broad, Casterline, Norris
and Schlaver. Absent, Willer. Whereupon the President declared the
motion carried.
A short discussion of the Kincaid Report was held. The Kincaid Report
vacation of Pine Street between Northwest Highway and Central Road Pine St.
was brought up, and Trustee Airey, in accord with several of the property
Board, suggested that the Village Manager ask for a plan of developments
by Wille Lumber Company as such plans might affect Pine Street.

Trustee Airey brought out the fact that the ordinance
Parking covering parking meters was adopted at the time the Municipal Code
Meter was-being printed and was not included therein. He then made the
Ordinance following motion: ~That inasmach as it is better to have all
regulations in one book, iS is requested that the Village Attorney
be directed to prepare an ordinance putting t~ese regulations into
the Municipal Code?
The President put 'the question and the Clerk called the roll, with
the following response: Ayes, Trustees Airey, ~road, Casterline,
Norris ~ud Schlaver. Absent, ~Willer. Whereupon the President
declared the m~tion carried.
Mttuao Bros. After perusal of memorandum by Village Manager Appleby with
1st Addu. regard to Munao Bros. 1st Addition, Trustee Broad, seconded by
Trustee Schlaver, moved that Munao Brothers~ request for permission
to install public improvements be granted, subject to compliance
with Village Ordinances, said improvements to be under the super-
vision and inspection of the Village Engineers.
The President put the question and the Clerk called the roll, with
the following response: Ayes, Trustees Airey, Broad, Casterline,
Norris and Schlaver. Absent, Willer. Whereupon the President
declared the motion carrie~:.~
Trustee Norris, seconded by Trustee Casterline, moved that
the arrangements outlined in memorandum to the Board re Munaoe Bros.
First Addition ~ritten by the Village Manager and dated April 10, 1959
be approved.
The President put the question and the Clerk called the roll,
with the following response: Ayes, Trustees Airey, Broad, Casterline,
Norris and Schlaver. Nays, none. Absent, Willer. Whereupon the
President declared the motion carried.
Discussion was held regarding Brickman Manor First Addition
Brickman situated east of the Carson property, which has an appeal before the
property County for zoning for single family dwellings and apartment buildings.
east of President Lams asked Dave McCoy~ attorney for Er. Brickman, whether
Carson, Pirie he thought the Brickman interests woul~ ask for annexation to
Mt. Prospect in the future. Mr. McCoy stated that he could not
answer for Mr. Brickman, who is currently away, but he had found that
it is always more desirable for a subdivision to be part of an
~ucorporated territory because of benefits for fire protection, water,
police, etc.
Trustee Bread, seconded by Trustee Airey, moved for adjournment,
and the meeting was regularly adjourned at ll:15 P.M.
