Upon the absence of the Village Clerk. President Besander appointed Fred G.
`Mille to at as temporary Clerk.
The meeting was called to order by President Besander. The Roll being called
the following Trustees were found to be present: Greinke, Haas, Haberkarnp,
LeMay and :Mille. Trustee Mortimer being absent.
The minutes of the previous meeting were read and it was moved by Trustee
LeMay seconded by Trustee Greinke that the minutes be accepted as read.
Motion carried.

Treasurers report be accepted as read. Motion carried.
It was moved by Trustee Wille seconded by Tags -Mille seconded by
Trustee Haberkamp that the Special Assessment report be placed qn
file. Motion carried.
Mr. Dovale inquired as to the possibility of having Sha -Bonee Trial in the
Prospect Park Country Club Subdivision partially barricaded to check the speed
of the added traffic on this road due to the opening of the Golf season. After
some discussion the Board decided that Mr. Willson Manager of the MorthWest
Hills Country Club be permitted to erect a sign at the corner of Sha-Bonee Trail
& Elmhurst Road directing traffic to the Golf Course on Council Trail. Also
likewise to direct traffic from the Golf Course on Council Trail.

It was moved by Trustee Haberkamp seconded by Trustee Hass that the
Bills be approved far payment. Ayes Greinke, Haas, Haberkamp,LeMay
and Wille.No Nays.
It was moved by Turstee Wille and seconded by Trustee H aas that the
temporary Building Permit issued to S. W. Burda for the premises
. described as 10 East Northwest Highway be extended for one more year
. ending January 30, 1 943, said permit to be non - transferable.
Ayes; Greinke, Haas, Baberkamp, LeMay and Wille. No nayys.
It was moved by Trustee Haas seconded by Trustee LeMay that the following
resolution be passed.

WHEREAS,. R. E. Gould, Police Magistrate of the Village of Mount
Prospect, has brought to the attention of the Board of Trustees of
• said Village that by reason of recent ligislation of the General
Assembly of the State of Illinois question has arisen as to the proper
disposition of fines collected for traffic violations; and
WHEREAS, under certain acts of the Legislature the Police Magis-
trate and other officials whose duty it is to collect such fines are
subject to penalties for the improper disbursement of such moneys; and
WHEREAS, the siad Police Magistrate has collected sums of money

paid for fines for traffic violations of the ordinances of the Village
of Mount Prospect; and .
WHEREAS, the said Police Magistrate, in order to avoid future liability
by reason of paying said fines to the Village Treasurer desires the protection
of the Board of Trustees for making such payments;and

WHEREAS, the moneys collected by the said Police Magistrate as fines
for the violation of Village ordinances is needed to pay salaries of the
police and other expenses of the *aid Village; and

WHEREAS, the Board of Trustee desires to meet the request of the Police
Magistrate to protect hin in the event of any litigation against the said
Police Magistrate because of his having paid these moneys over to the Village
Treasurer;
NOV , THEREFORE,BE IT RESOLVED by the President and Board of Trustees of
the Village of Mount Prospect:
FIRST; That the Police Magistrate be, and he is hereby, instructed to pay
to the Treasurer of the Billage of Mount Prospect the moneys collected by him
as fines for the violation of the traffic ordinances of the Village of Mount
Prospect, and that such moneys be paid into the general corporate fund of the
Village.

SECOND: That all moneys now held and collected by the Village Treasurer
in payment of fines for violations of traffic ordinances and heretofore
deposited with the Treasurer by the Police Magistrate and which have here-
tofore been set aside'shall now be paid into the general corporate funds of
the Village.
THIRD: That if by reason of any future litigation the results of which
shall require the payment of any fines collected by the Polies Magistrate
Cr*:) and paid to the Village Treasurer to be paid over to some other official,
then and in that event the Village of Mount Prospect shall, and does hereby
W agree to pay_auch moneys to such officials as may be adjudged by a court of
competent,jurisdiction to be entitled thereto, and the said Village of
Mount Prospect does hereby agree to indemnify. the said R. E. Gould, Police
Magistrate, and save him harmless from any,cause of action, claim or lia-
bility whatsovefe which may be adjudicated against him by reason of his
paying to the Village Treasurer the aforesaid fines now inr,his custody or
such fines which he may hereafter collect and pay over to the Village
Treasurer.
FOURTH: That the Village Treasurer be and he is hereby instructed to
deposit all moneys received from the said R. E. Gould, Police Magistrate,
P*" which said Police Magistrate has collected as fines for the violation of the
traffic ordinances of the Village of Mount Prospect in the general corpo-

Ayes; Greinke, Haas, haberkamp, LeMay and Willa. No nays.
It was moved by Trustee Greinke seconded by Trustee k 'aberkamp that the
request of free water for School District #57 would have to be
denied. Due to the fact that the taxing area of District #57 extends
beyond the incorporated limits of the Village and a grant of free water
would be an added•burden to the Taxpayers of the Village of Mount Prospect.
Treasurer Ville reported that Trustee Mortimer has asked to be excused
from the -ensuing two meetings in compliance to Doctors orders.
Trustee LeMay reported that the sidewalk on Emerson. Street between the
Rail Road property and the Northwest Highway, is to be improved.
In regards to the requested street light at I lWitreet and Fairview
Avenue Mr. P. N. Collins was informed that due to the recent Federal
restrictions no individual service could be extended beyond 250 feet, and
no street light would be forth coming. at the present time.
There being no further business to come before the meeting the same was
