Upon roll call, the following trustees answered Present: Trustee Airey, roll call Casterline, Ekren, Caw, Norris and Schlaver. None were absent· Trustee Casterline, seconded by Trustee Norris, moved that the minutes of February 18, 1980 be approved as submitted. The President minutes put the question· the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekre~, Caw and Norris. Pass, Schlaver. Whereupon the President declared the motion carried. Trustee Caw, seconded by Trustee Ekren, moved that the bills for the week of February 2B, 1960 be approved as follows: General $10,088.04 Garbage 15.50 Park. System Revenue 40.00 Library 386.84 bills Motor Fuel Tax 2,472.94 Fire Equip. Bond & Interest 1959 47,950.00 Water 4 071 30. $65 024 62 The President put the question, the Clerk called the roll, with the fellowiag response: Ayes· Trustees Airey, Castertine, Ekren, Gaw, Norris and Schlaver. Nays, none· Whereupon the President declared the motion carried. Trustee Gaw, seconded by Trustee Casterline, moved that the January financial report for the month of January, 1980 be approved and placed financial on file. The President put the question, the Clerk called the roll, with report the following response: Ayes· Trustees Airey, Casterline, Ekren, Caw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Schlaver of the Water Committee reported that a Well ~6 decision had not yet been made in the awarding of Contract #3 on Well #8, stating that it was expected to be awarded at the next meeting. Trustee Schlaver referred to memo from the Village Manager dated February 18th regarding additional material needs for Well #B. He then Well #B made a motion, seconded by Trustee Norris, that the expenditure of repairs $$,900.25 be authorized for the completion of emergency repairs at Well #B in accordance with the recommendations of the Village Manager. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Caw, Norris and Schlaver. Nays, none. ~hereupon the Presideat declared the motion carried. Trustee Schlaver read the following letter from Nascc Construction CO.: February 4, lgSO 915 Rand Rd., Mt. Prospect Mr. Harold Appleby, Village Manager Village of Mount Prospect Prospect Plaza Shopping Center Dear Sir: Re: Mt. Prospect Pl.aza Water & Sewer We are submitting herewith (2) two copies of our plan for the Water, Storm Sewer and Sanitary Sewer installation on the abe~e referenced proJect. February 23, 1960 Cont' d ~e cost of this entire installation will be paid for by the developer of the Mt. Prospect Plaza Shopping Center. Mt. Prospect Plaza Shopping Center The developer of the Mt. Prospect Plaza Shopping Center agrees Rand & Central to turn over the Water Main f~tallation, upon completion, to the Village of Mt. Prospect; and f~rther agrees to grant reasonable easement rights to the Village of Mt. Prospect for the proper main- tenance and function of the Water Main installation; in consideration for the turning over of the Water Main installation and the granting of the easement, the Village of Mt. Prospect agrees to maintain said Water Main installation at its own cost and expense. We would appreciate your approval, and/or corrections, on this entire installation. Prospect Plaza We hereby request permission to start the wa~er main installation within the property limitations on the above referenced Center. We ~uderstand that we are not tostart this installation (when permission of request has been granted) until we receive the approval of the layout from the Village of Nt. Prospect, Mt. Prospect, Ill., and the State of Illinois. It is also understood that the Village of Mt. Prospect, Mt. Prospect, Ill., will not be requested to bear the cost of this water main extension to the Village water system. It is expressly understood that this cost will be absorbed by others. We would appreciate it very much if you would be good enough to notify us Just as soo~ as Village and State approval has been made. We would like to get started as soon as possible. Zobay Vice President Trustee Schlaver read the following letter from Consoer, Mt.prospect Townsend & Associates: Plaza Shopping February 22, 1~0 -- Center Mr. H. G. Appleby, Village Manager water mains Municipal Building, Mt. Prospect Dear Mr. Appleby: We have received from the office of Emil Gruenberg & Associates, who are engineers for NASCO Construction Co., a revised plan, dated February 17, 1980, showing water mains to serve the proposed Mount Prospect Plasa Shopping Center. We believe that a similar plan was sent to your office. February 2B, 1980 his plan has been revised to show the additional valves and revised routings of the water maims as requested by this c~fice. The plan also nee shoes, more correctly, the two proposed off-site water connections to the present Village system. Proper notes specifying types of pipe, hydrants, etc. to conform to standard Village practice have also been made to the plan. We therefore recommend approval of this plan by the Village. It is our understanding that the Owner of the Center is to furnish easements to the Village for operation and maintenance of these mains. We suggest that this be done after installing the mains. In a project of this type, practical considerations during constrmction sometimes dictate a revision in the alignment of underEround lines which could req~uire redrafting of easements, if such easements were made at this time. You will note that this plan makes no provision for the two (2) off- site water connections required. A plan for the proposed connection at Henry Street is being sent under separate cover. To help in the processing of these plans, we have prepared and enclose three (3) copies of the standard certification required by the State in connection with approval cf these plans. This form should be signed and forwarded to NASCO Construction Co. after Village approval. We have requested additional copies of these plans from Emil Greenberg & Associates. Trustee Schlaver, seconded by Trustee Casterline, made the following motion: "That approval be made on plans for water mains as shown on Drawing ~PP-!-a dated 11-20-59 and checked 1-13-60 revised February 17, 1960 for Mt. Prospect Plaza prepared by Emil Gruenberg & Associates, consulting engineers and subject to: (1) Approval by the State Board of Health of this plan and and plans for connection of this systemto the Village system. (2) Constraction inspection by Village Engineers, which inspection is to be paid for by Nasco through an escrow established with the Village for that purpose, and with the understanding that a. The mains shall be completed with proper easements and turned over to the Village and b. The Village reserves the right.not to provide water service if the system and connections are not built in accordance with Village recfaireme~ts, the easements are not provided as agreed, an~ the water hook-on fees as provided by Village Ordinance.arc.not paid. February 25, 1960 Clerk Reynolds read proposed Ordinance #706, which ordinance adopts the use of the National Building Code, which shall be ~n effect except where it conflicts with the code of the Village: Ord. #706 AN ORDINANCE TO AMEND CHAPTER I OF THE MOUNT Building Code PROSPECT BUILDING CODE OF 1957 AS AMENDED Trustee Ekren, seconded by Trustee Schlaver, moved for the passage __ of Ord. #?06. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Caw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried and Ordinance ~?06 passed. Trustee Airey referred to the report cf the Zoning Board re Zoning Case 60~3 mentioned in the minutes of 2-9-60, and stated the cemmittee Case 60-B wished to hold this matter over for further study. Mr. Ed Busse, one of the petitioners, arose from the audience and stated that they had purchased this land in the belief that it was zoned for business, with the idea of erecting a building for rental purposes; in this way they could control the tenants next door to them. Trustee Casterline brought up the subject of traffic ~around the Traffic new bank building, and discussion was held regarding the various pro- posals for rel~wving congestion. It was agreed to try no parking in a certain area for a limited time to see if this would work out. There- fore, Trustee Casterline, seconded by Trustee Airey, moved that the unwidened portion of Busse Avenue next te the bank on the south side be marked "No Parking" until May 1, 1960, or until this portion is widened according to existing plans prepared by Sonsoer, Townsend & Associates. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Caw, -- Norris and Schtaver. Nays, none. Whereupon the President declared the motion carried. It was suggested that traffic coming out of the bank on Emerson be routed to the right to relieve the bottleneck caused by traffic flowing south amd opposing cars turning north. The Village Manager was directed to discuss this question with the Bank. Trustee Airey read proposed Ord. #707, wSich grants variation to Schuham Hardware for erection of sign in parking area -- Ord. #707 Zoning Case 59-25 AN ORDINANCE GRANTING A VARIATION FROM THE Schuham Hardware VILLAGE OF MT. PROSPECT ZONING ORDINANCE AS AMENDED Trustee Airey, seconded by Trustee Schlaver, move~for passage of Ordinance #707. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Caw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Airey, seconded by Trustee Norris, moved for the passage of proposed Ord. #708: Ord. ~708 AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE Zoning Case 60-1 OF MT. PROSPECT ZONING ORDINANCE AS ANENDED -- Thom McAn This refers to zoning Case 60-1, Thom McAn, for erection of a sign in parking area. Ord. #709 PROSPECT ZONING ORDINANCE AS AI~NDED Industrial Distri ct This ordinance amends the zoning ordinance in regard to the Industrial District. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Airey, seconded by Trustee Casterline, moved that the Village Attorney be authorized to represent the Village in Court Case Superior~ Court Case 60-S-3211, Iversen vs Village of Mount #60-S-B211 Prospect. This refers to island of land on Rte. 83. The Presi- Iversen dent put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. Trustee Gaw, seconded by Trustee Schlaver, moved for repayment of $15,000 by the General Fund to the Water Fund. This advance Repayment of was made in Becember, 195y. Trustee Gaw, seconded by Trustee Ekren, moved that an advance be made from Special Assessment Funds 5, 6, 16 and 48 to the General Advance of Fund in the amount of $1,779, and that this advance be permanent, funds This amount covered the bill for the special audit made of Special Assessment funds in July 31, 1938. Trustee Gaw, seconded by Trustee Ekren, moved to employ the firm of Ernst & Ernst to do the complete Village audit for the year ended April 30, 1960. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. Mr. Dan Congreve, President of Northwest Meadows Homeowners Association, referred to the fact that Rossetti Construction Co. Northwest was currently digging ditches on one side of the streets to lay Meadows S~wers sewer tile. In the process, drain tile of all sizes and lengths is being dug out and hauled away. To save this assemblage of drain tile and replace it would be expensive as well as unnecessary. He suggested that this tile should not be replaced. Once curb and gutter are installed ts draiu water into the sewers there will be no further need for this patchwork cf field tiles Mr. Congreve did ask for assurance that curb and gutter installation would be made when possible. Trustee Norris, seconded by Trustee Airey, moved to authorize the Village Engineers to prepare a preliminary estimate of curb and Northwest Moa- gutter and rehabilitation of existing streets in Northwest Meadows dows curb and Subdivision. The President put the question, the Clerk called the gutter roll, with the following response: Ayes, Trustees Airey, Casterline, Ekre~, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried. February 23, 1960 ~ ~ ~ Mr. Michael Mokate arose from the audience. He complained Side~a!k on ~f ~ack of sidewalk on Elmhurst Avenue Just north of Central. The N. Etmhurst Ave. Board explained that this matter had been gone into th~noughly and told him the results, (minutes of Nov. 24, 19§9) which were that no land had been dedicated for public sidewalk on either side of the street. ~omes of residents on the west side of the street face the other way, their side-walks being on Ridge Avenue. TheY are not interested in sidewalks along the rear of their property. The cemetery and business on the east side w~uld have to dedicate land. The only other way would be f~r the Village to institute condemnation proceedings, which would be a very serious matter. Mr. Mokate could offer no petit~w- from residents requesting this sidewalk. President Lams said that he would make personal inquiry of Mr. Haberkamp and the cemetery association and report back to our Board.
