The minutes of the nular meeting of September 7, 1943 were read. It was moved by Trustee Kirchhoff, seconded by Trustee Wax they be accepted as read. Motion carried. . Ayes: Greink®, Haas, Kirchhoff, Mott, lax and Wine. No Nayes. Trustee Greinke brought to the attention of the Board, the need for an auxiliary gasoline engine for the water pump to be used in emergencies created by the failure e^ of the electric power. After discussion, President Besander suggested that the gas - oline engine now on the unused concrete mixer be used for this purpose and instruct- +..4• ed Wm. Mulso to determine if it would be practical to do so. . It was moved by Trustee Kirchhoff and seconded by 'Trustee Wax that the Village Clerk write to the Chicago and North Western Railway, requesting they repair the burned depot on the South platform and to replace the damaged sidewalk on Emerson St. between the railroad tracks and the Northwest Highway; also, that some action be taken in regard to the installation of crossing gates on Emerson and Main Ste. Motion carried. In the absence of Mr. Henry Nickel, Village Attorney, Trustee Mott reported on the present Liquor Ordinance and informed the Board the Ordinance could not be revised to reduce the number of licenses issued until April 1944, at which time one of the Liquor Licenses expires. Trustee Mott also reported on the cost of setting up new records relative to the Special Assessment warrants of the Village. It was moved by Trustee Mott, seconded by Trustee Kirchhoff that the President of the Board of Trustees be and he is hereby authorized to employ an accountant for the purpose of opening up new records relating to all of the Special Assessment 'Warrants of the Village of Mount Prospect, and that the compensation to be paid said account- ant shall be 61.25 per hour. Ayes: Greinke, Haas, Kirchhoff, Mott, Max and Wills. No nayes. Trustee Mott read the following report of the Judiciary Committee: REPORT OF THE JUDICIARY COMMITTEE REGARDING THE LONNQUIST GARDENS PLAT PRESENTED TO THE VILLAGE BOARD ON JUNE 22', 1943 On August 3, 1943, the Board of Trustees referred to your Judicial.* Committee a plat designated as the Lonnquist Gardens, which involved the following described property, to -wit: A Subdivision of part of the North East Quarter (N.E 4) of Section Fourteen (14), Township Forty -one ( 41 ) North, Range Eleven (11), East of •`, the Third Principal Meridian; also a letter from the Plan Commission dated July 28, 1943, to who the Board had previously submitted the Lonnquist Gardena Plat for its recommendations. The Plan Commission in its letter recommended that the plat be rejected by the Village Board 386 and gave its reasons therefor. Your Committee, after careful investigation of the facts, ascer- tained the following to be true: Om August 5, 1941, the owners of the above described property submitted to the Village Board of Trustees a plat duly executed by the owners of the porperty and dated July.28, 1941. The original plat submitted, in addition to other items, included a building restriction on single family dwellings on each lot in the sum of $5,000.00. After a general discussion regarding the amount of restrictions to be placed on the lots and other.mattera relating to the plat, the Village Board referred this plat to the Plan Commission for further study. The Plan.Commission, after reviewing the plat, recommended that minimum building restrictions be $7,500.00 per single family dwelling. At a subsequent meeting of the Village Board, an• agreement was reached with the owners of the property pursuant to.dis- cussiona had at previous meetings that the lots in said plat be restricted to.one single family dwelling on each lot costing not leas than $7,500.00 on•Lota 1 to 4 in Block 1, and Lots 1 to 5 in Block 2, and not leas than $6,000.00 on all residence lots.. Lot 11 in Block 4 could be used for either business or residence. This plat with the Egreed to corrections was accepted by the Village Board, and signed by I. E. Besander, President of the Village Board, and attested thereto by S. V. Burda, Village Clerk. The plat has never been withdrawn. It is the opinion of your Committee that under the circum- stances the plat accepted at that time is binding upon the owners of that property as well as the Village. The plat conforms substantially to the Official Plan of the Village of Mount Prospect, which clearly indicates that the matter was fully gone into by the Plan Commission and the Village Board before its acceptance. The plat submitted by Mr. Lonnquist on June 22, 19 is a plat relating to the identical property. It seeks to eliminate some of the covenants and agreements of the earlier plat, has changed the boundaries of the individual lots, and in numerous other respects is different from the plat that has been officially accepted. In view of the fact that the Village has already accepted and approved the plat which conforms to the Official Plan of the Village, it is the recommendation of your Committee that the plat submitted on June 22, 1943 be rejected. It was moved by Trustee Wax and seconded by Trustee Kirchhoff that the following resolution be adopted: RESOLVED, that the report of the Judicary Committee regarding the Lonnquist Gardena Plat be and the same is hereby accepted, approved and adopted by this Board; and BE IT FURTHER RESOLVED, that the Lonnquist ` Gardens plat presented to the Village Board on June 22, 1943, be and the same. is hereby rejected for the '"�"" reasons stated in the said report. BE IT FURTHER RESOLVED, that the Village Clerk notify Mr. Lonnquist of the Board's action. Ayes: Greinke, Haas, Kirchhoff, Mott, Wax and Ville. No Nayes. It was moved by Trustee lax, seconded by Trustee Ville that an order be placed with the Skokie Valley Asphalt Company to purchase 800 gallons of crack filler at Sixteen Cents (16¢) per gallon to be used for the repair of streets. Ayes: Greinke, Haas, Kirchhoff, Mott, Wax and Ville. No Nayes. Trustee fax reported the absence of two sewer gratings on Mille Street in 3c-?7 the 400 Block and two on Gregory Street between Mille and Main Streets. President Besander instructed km. Mulso,,Supt. of Streets, to notif7 Mr.Wolf of the Ne11 Construction Co. to install the necessary gradings upon penalty of being fined, as this condition is a hazard to public safety. It was moved by Trustee Wax, seconded by Trustee Haas that a two hour parking limit be established on Emerson Street, between the Northwest Highway and Busse Avenue; and on Busse Avenue, between Main and Emerson Streets,& Chief of Police, George lhittenberg be instructed to have the signs erected. It was moved by Trustee Kirchhoff, seconded by Trustee Ville, that the bills be approved for payment as read. Ayes: Greinke, Haas, Kirchhoff, Mott, flax and Ville. No nayes. It was moved by Trustee Mott, seconded by Trustee Greinke, that the Village obtain the services of Albert L. Roderick, Certified Public Accountant, for the sum of Seventy Five Dollars ($75.00),to make the semi..annual audit andreport for the first six months of the Dater forks System fiscal year, ending October 31, 1943. Ayes: Greinke, Haas, Kirchhoff, Mott, Wax and Mille. No Nayes. A letter from the Lions Club of Mount Prospect was read in regard to the trimming of trees in the Village. After discussion it was referred to Trustee lax for investigation. There being no further business to come before this meeting, it was moved by Trustee Mott, and seconded by Trustee Haas that the meeting be adjourned.
