MINUTES OF REGULAR MEETI-NG OF THE BOARD
OF TRUSTEES HELD ON AUGUST 1, 1961
President Schlaver called the meeting to order at 8:15 P.M.
with the following trustees present: Casterline, Bickley, Bruhl, Caw,
Ekren and Phillips.
Trustee Casterline, seconded by Trustee Bickley, moved that the
minutes cf the previous meeting sf July 18%h be approved as submitted, minutes
The President put the question, the Clerk called the roll, with the
following response: Ayes, Trustees Bickley, Brubl, Casterline, Ekren,
Gaw and Phillips. Whereupon the President declared the motion carried.
Trustee Bruhl, seconded by Trustee Gaw, moved for approval of
bills for the week of August 1 as follows:

This is a request for rezoning to B-I, B-2 and B-3
various parcels of land, contingent upon annexation,
on the north side of Fcundry Road at Rte. 83 and
Rand Read.
The Hoard of Appeals voted 4-0 to approve of the rezoning
contingent upon the annexation of land and dedication of
one-half street, Elmhurst St., adjacent to the proposed
B-1 zontng.

of Appeals in regard to Case 61-20:

This petition involves three parcels of land to be annexed and then
rezoned:

9.915 acres bordered on the west by Elmburst St.; on the north
by Rand Road; on the east by Parcel #2 and on the south by
3.864 acres now zoned County B-2, which property fronts 559.05
feet on Feundry Road.

(Cont'd) An irregular piece with 350 ft. fronting on Rand Rd. and a
maximum depth of 453 ft. to the south with Parcel #1 to the
west and Parcel #3 to the south. On the east, the E1 Rands
property.
Parcel #3:B-2 Zoning
200 ft. fronting on Foundry Road, with a depth of 300 ft. '-~
bsrdered on the north hy Parcel #2; on the east by the
E1 Rands property; on the west by a piece of property now
zoning B-2 by the County, which property fronts 559.05 ft.
on Foundry Ed., and 300 ft. on Elmhurst St.
The petitioners say that they will erect a shopping center on
Parcel #1; a furniture store on Parcel #2 and a Medical Center on
Parcel #B.
T here were approximately BO objectors present, and one individual
represented that he was an officer of a Community Civic Association
of 1BO members that objected te the annexation and rezoni~. However,
he did not preseht any petition or documents certifying to that fact.
The presentation by the attorney for the petitioners was confused,
and poorly organized. This confusion was reflected in the audience,
and it did bring out, eventually, the admission that the vehemence of
some ef the objectors was personal.
The meeting was rather lengthy because of listening and trying to
reason with the objectors and attempting tn crystalize the real issue.
Their objections were as follows:
1. Will this set a precedent for the parcel that is now __
County B-2 and is not included in this petition.
2. Objections to a Shoppers World with its high and
bright sign and bringing undesirables into the area.
B. Possible sewer trouble, together with water demands.
4. Additional traffic.
5. The proximity of the high school to the west.
As the hearing progressed, the atmosphere changed from the heated
objections prevailing at the outset to an atmosphere where the question
to be answered was whether it would be better for Mount Prospect to
annex the property and therefore control same through our police
department and other municipal government, or whether it would be
better to leave it with the County with its police force and its less
restrictive B zoning.
Some objectors then spoke and reversed their prier statements and said
that they would rather have the land annexed so th~t our village would
have the control. Their opinions were not agreed to by all of the
objectors, but their statements were not, on the other hand, objected
to with fervor.
It was the impression of the Board of Appeals that those present
tempered their prior objections when they realized what the members
of the Board were pointing out; that is~ %hat the question of control
of the land was the all-important question to be decided, and that it
was to the good of the Village to annex and rezone rather than to
leave it with the County and their B zoning.
The Chairman pointed out to those present that it was always the
objectors who came to the meeting, and therefore one could say
that those in favor of the petition would not attend. This does
not mean that all of those not present are in favo~ of the petition,
but it certainly did point out a very pertinent observation.

The Board, in its deliberations, considered the all-important
question of control of the land involved° Re Parcel #1; if it Memo (continued)
were to be sold in small parcels the result might be small stores, Zoning Case 61-20
with the. possibility of then creating a strip zoning area.
The decision of the Board of Appeals was 4-0 in favor of the rezoning,
contingent upon the annexation of the property.
Title to the property in the names of the petitioners was not proven
to the Board. Rowever, the attorney for the petitioners assured the
Board that he had proven to our Village Attorney that title was held by
the petitioners. It is not our policy to take a petitioner's affirmation
of title.

Trustee Ekren, seconded by Trustee Phillips, moved that the
Village Board concur in the recommendation of the Board of Appeals regarding
the zoning contingent upon annexation of said property at Foundry R~ad,
Rand Road and Elmhurst Street.
Objectors arose, stating that they objected to the type of business being
allowed to go in this property. They were Mrs~ Evelyn Nelson of Yll North
Russell, Mrs. Dorothy Oberhard of ?08 North Russell and Mrs. Philamine
Scervinc of 622 North Russell. It was explained that these objections
should have been voiced at the hearing of the Board of Appeals on July 21,
that in any event if the property were not annexed the property owners
would be allowed busines~s zoning under the County ordinance, and there
would be no control by the Village; further, that there was large latitude
allowed under the business zoning and the property owners must be allowed
to get the best use of their property.

At the time of the zoning board hearing with regard to the above
matter, the owners of the above development were requested to erect a
fence on that portion of the property contiguous to Elmhurst Road (after
dedication of BB ft. of such property to the Village of Mount Prospect for
road and highway purposes).
Confirming such representation, the undersigned owners have agreed
to const~ct such fence, which will be a solid stockade wooden fence for
the entire distance of such property (some ?00 ft.) of at least 5 ft. in
height so as $o serve as a clear demarcation line with regard to such
property.

Shopping Center MOUNT PROSPECT BY REZONING CERTAIN PROPERTIES
LOCATED AT RANE AND FOUNDRY ROADS.
This ordinance allows B-1 zoning for Parcel #1, B-3 zoning for Parcel #2,
and B-2 zoning for Parcel kB, heard by the Zoning Board of Appeals as
Case 61-20. The President put the question, the Clerk called the roll,
with the following response: Ayes, Trustees Casterline, Bickley, Bruhl,
Ekren, Gaw and Phillips. Nays, none. Whereupon the President declared
the motion carried.
Atterney Edward C. Hefert announced that he was in receipt of
a deed from the owners of Parcel fl dedicating 33 feet along the western
side thereof as Elmhurst Street, for street purposes, to the Village.

Temporary advance temporarily from the Water Deposit Fund to the Library Building

passing the Tax Levy Ordinance. This motion passed by acclamation.
Trustee Phillips stated that he had received the engineers'
Well #6 report regarding Well #6 and was referring it te his committee.

Extending our maximum corporate purpose rate of .2399 on an
estimated assessed valuation of ~,000,000 - $158,334.00
The ~56,000,000 estimated assessed valuation is very con-
servative. If it should be higher, the tax rate extended
will be proportionately lower
A Street & Bridge levy high enough to collect our maximum

Paving Trustee Gaw, seconded by Trustee Bruhl, reported that the
MFT 1961 Street Program is progressing satisfactorily, and moved that
plans and specifications for curbing around center parkway un
West Prospect Avenue between Pine andIoka be approved as an
addition to the current MFT program. The.President put the question,
the Clerk called the roll, with the following response: Ayes,
Trustees Bickley, Bruhl, Casterline, Ekren, Gaw and Phillips.

Zoning hearing Trustee Ekren, seconded by Trustee Bickley, moved that the
Village-owned Board of Appeals be directed to hold a hearing regarding changing
property at of zoning from I-1 to B-B of property owned by the Village in
Well #3 along Block 1 of Busse & Wille's Resubdivision in the West half bf
Central Rd. Section 12, Township 41, described as fellows:

IRandhurst The question of master water meters vs. individual meters
water for Randhurst Corporation was referred to the Water Committee for
further consideration.
Trustee Bruhl, seconded by Trustee Bickley, moved that the
following be added to the Salary schedule adopted July lSth:

$4,485.00
This provides for increases according to the schedule under which
Miss Joan HuJanen was hired, plus the $360- granted to all policemen.

Mr. Appleby read letter from C. Stamis & Company, Inc. of Paving, etc. o~
July 5th requesting permission to install pavement, curb and gutter, WaPetla and
drainage structures and sidewalks to serve six lots on WaPella and Manawa by
Manawa Trail, to become the property of the Village at no expense to C. Stamis & Co.
the Village.
Trustee Gaw, seconded by Trustee Ekren, moved that C. Stamis & Company
be granted permission to install pavement as outlined in letter of
July 5th upon establishment of necessary escrows and bond and insurance
coverages. The President put the question, the Clerk called the roll,

Village Manager Appleby read the follewing letter from
Mr. C. Stamis:

Gentlemen:
On July 5, 1961, the Mount Prospect Park District and I requested
permission to install pavement, curb and gutter, drainagestructures
and sidewalks to serve six lots on WaPella and Manawa Trail as per copy
of enclosed letter.
The total cost of said improvement is $11,361.95 and we had agreed to
pay $609.13 to the Village Engineers for reviewing plans, supervision
and inspection of the work. Mr. Appleby has brought to my attention
that a fee of one per cent of the construction cost, payable to the
Village is due in addition to the above cost. However, he suggested to
me in a note written in March, 1961, that usually this fee is waived on
jobs of this size. As a result I had not.made arrangements with the
Park District for this additional expense. Inasmuch as this street improve-
ment has certain public use benefits (the children going to Sunset School
will be using it), and one-third of the street improvement faces a public
park, I feel that this fee should be waived. However, I will abide by
your decision.

Mr. ~ppleby brought up the County Zoning Dockets #234, 239, 246 County
and 227, mentioning that the Board miSht be interested in #227, re Zoning
.7 acres located on the southwest corner of Central Road and Busse Road
in Elk Grove Township, asking for zoning change from R-5 General Eesidence
to B-2 Restricted Service. President Schlaver turned this matter over to
the Judiciary Committee.

Illinois, asked me to write a letter in regards to a
fence he built on his property.
The fence is attractive, well constructed, and does not
interfere with me or my family in any way. Therefore,
I have no objection to it staying as it is.

Annexation of President Schlaver recommended that the Judiciary Committee
territory meet with members of the Board from Des Plaines regarding disposition
of territory south of Golf Road. It was agreed that tentative date
be set as of next Friday.
Fire Siren President $chlaver announced that the Fire Siren will no
longer be used for fire calls after September 15th; that thereafter it
will be used for warning signal for Civil Defense.
Tag day Trustee Ekren, seconded by Trustee Caw, moved that the
Illinois MAssionary Childrens' Home be allowed to hold Tag Day during
the third we&k in August, with the provision that.there be no door-to-
door soliciting. This motion carried by acclamation.
American Trustee Casterline commented upon letter from Miss Bertha T.
Security Ehard protesting the act by the Village of joining the American Secut~y
Council Council on July 5th. The Beard felt that Miss Ehard did not understand
the set-up, which is mainly a subscription to printed information and
right to use the services cf the Council upon requests Attorney Hofert
gave the opinion that the Village's subscription to the services was
legal. Trustee Casterline was asked to explain this matter to Miss Ehard.
Trustee Ekren read the following letter from the Plan Commission:

This ordinance removes respOnSibility for weed cutting in Vacant lets
from the~Health Department and places it in the Village Manager's office.

CODE 1957" Chap. III, Sec. B3.2, RELATING TO
DEPOSIT GUARANTEEING DAMAGE AGAINST PUBLIC PROPERTY
This ordinance raises the deposit fee from $i00 to $200 for guarantee
against broken sidewalks, etc. for builders. The President put the
question, the Clerk called the roll, with the following response:

Whereupon the Presidaent declared the motion carried.
August 1, 1961
Trustee Ekren referred to request from Bell Telephone Company Bell Telephone
in former meeting (June 20th) asking to be allowed to set up private Special Uses
garages and parking for their vehicles in industrially-zoned area north
of West Central Road. Trustee Ekren, seconded by Trustee Bickley, moved
that the Board of Appeals be requested to conduct a hearing on the question
of amending the Municipal Zoning Code re Special Uses. The President put
the question, the Clerk called the roll, with the following response: Ayes,
Trustees Bickley, Bruhl, Casterline, Ekren, Gaw and Phillips. Whereupon
the President declared the motion carried.

Village Attorney Hofert reported that the M.P. Country Club M.P. CO~TRY
had filed suit of mandamus again and motion to strike has again been Club
filed by the Village. Liquor suit

its form of operation from a partnership to a corporation. It is important
in making this change that we reduce our outstanding accounts to a minimum.
For this reason, we are calling your attention to the unpaid statements
listed below and asking your co-operation in completing payment thereof.

If payment is not made at this time, we would sincerely appreciate
being advised when payment may be expected, together with the reason for
the delay. If payment is in question, we would appreciate being advised
of this fact, together with your reasons for same.
We regret the necessity to write you on this matter, but believe

Mr. and Mrs. Mike Lcmbardo, 108 West Northwest Highway, were present with Lombardo
their attorney, Mr. Klingler, who requested that a committee from the
Village Board meet with him and Custer Construction Co. attorney, Mr. Mackay,
regarding alleged damage to the Lombardo property. President Schlaver stated
that the Village will see to it that any proper adjustments are made through
the correct channels.

A SUPPLEMENTAL RESOLUTION PROPOSING IMPROVEMENT OF W. Prospect
WEST PROSPECT AVENUE AS PART OF MFT-16-CS
The President put the question, the Clerk called the roll, with the
following response: Ayes, Trustees Bickley, Bruhl, Casterline, Ekren,
and Phillips. Whereupon the President declared the motion carried.
Trustee Gaw, seconded by Trustee Ekren, moved that Louis Munao Louis Munac
(Construction Co. - subdividers) be authorized to proceed with paving and 1st Add'n
improvement of streets and sidewalks in Louis Munao's First Addition Sub
Subdivision. This motion carried by acclamation.
Augdst 1, 1961
aving - Manager Appleby reported that paving for East Highland
E. Highland Avenue (recently dedicated) has been approved by the State, and
N. Forest that a promise that the paving of North Forest between Highland
Avenue and Foundry is gsing ahead has been made.
