President Schlaver called the meeting to order at 8:15 P.M. roll call
Upon roll call, the following answered Present: Bickley, Bruhl, Caster-
line, Ekren and Gaw. Absent, Trustee Phillips.
Trustee Bickley, seconded by Trustee Casterline, moved for approval
of the minutes of the previous meeting of May 17th. The President put the minutes
question, the d~p. uty clerk called the roll, with the following response:
Ayes, Trustees Nmckley, Bruhl, Casterline and Ekren. Pass, Gaw. Absent,
Trustee Phillips. Whereupon the President declared the motion carried.

third Tuesday of June (June 20), the form of notice to be approved by
Counsel. The President put.the question, the deputy clerk called the roll,
with the following response: Ayes, Trustees Bickley, Bruhl, Casterline,
Ekren and Gaw. Absent, Trustee Phillips. Whereupon the President declared
the motion carried.
Discussion was held regarding pending sales tax legislation ~n State sales
Springfield. Trustee Casterline, seconded by Trustee Bruhl, moved that tax
the Village Attorney be authorized to prepare a resolution, copy to be
passed to State legislators, opposing any increase in sales taxes. The
President put the Question, the deputy clerk called the roll, with the
following response: Ayes, Trnstees Bickley, Bruhl, Casterline and Ekren.
Nays, Trustee Gaw. Absent, Trustee Phillips. Whereupon the President
declared the motion carried.

This restricts speeds on Highland Avenue to 20 mph. The President put

Dear Sir:
The Police Magistrate's Court in Mount Prospect is indisputably
a traffic court. As such, those who are charged or those who come into
this Court not being charged but just as visitors, see in action perhaps
the only Court they know anything about. This first-hand experience
leaves an indelible impression upon those people who come and sit in this
courtroom. They observe the condition of the' courtroom, the manner in
which the procedures are carried out, the demeanor of the Judge and
attaches of the court and the time perhaps one has to wait in order to
have the case called.
There is no more important court in this country, because here
and in courts of s~mflar jurisdiction the great majority of traffic cases
are tried. Here is where respect or disrespect for law, for order, for
the Courts and for government are fostered. By fair, impartial and
expeditious handling of traffic cases these courts can become a bulwark
in our democratic system or they can sow the seeds of discontent and
cynicism when discourtesy, sloppy procedures and understaffing exist.
It is understaffing in this Court to which I direct your
attention. When the court has to act in the dual capacity of prosecutor
and judge we have an embarrasing and intolerable situation not only for
the court but for the defendant and his counselor. To facilitate the
handli~ of traffic cases inthis court and to greatly improve its
procedures, I respectfully ask for the appointment of a prosecutor.

Village AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MT. PROSPECT
Prosecu~br of 1957 BY ADDING TO CHAPTER 4, ARTICLE II THEREOF
SECTIONS 4~206 and 4.207
This sets up the office of Village Prosecutor, who will prosecute~cases
on behalf of the Village during proceedings of the Police Nagistrate or
Justice of the Peace. The President put the question, the Clerk called
the roll, with the following response: Ayes, Trustees Bickley, Bruhl,
Casterline, Ekren and Gaw. Whereupon the President declared the motion
carried.
Recommendation was made that the Judiciary Committee receive
applications for the post of Village Prosecutor.
Trustee Ekren referred to Zoning Case 61-4, Zbnith Radio Corp.,

Hearing on January 27, 1981
Through its attorney, G. F. Sletteland, the petitioner requested
a rezoning from R-1 to B-3 of property at Central and Rand Roads. This
property is now occupied by a siugle-family residence and the radio towers.
There were no objectors present.
= The Board of Appeals voted 6-0 to deny the petition.

Trustee Ekren thereupon gave the opinion of the Judiciary Committee as
follows: The Judiciary Committee agreed with the Board of Appeals in its
findings. We also found that the petitioner would not disclose the reason
for rezoning or the planned use forthe property after zoning. The Judiciary
Committee believes that the business zoning as requested would depress the
adjoining residential property values and further, the Committee believes
thmt the position of the Village of Mount Propsect is defensible.
Trustee Ekren, seconded by Trustee Casterline, thereupon moved that the
Board of Trustees of the Village of Mount Prospect concur with the opinion
of the Board of Appeals to deny the petition far rezoniug in Case 81-4.
The President put the question, the deputy clerk called the roll, with the
following response: Ayes, Trustees Bickley, Bruhl, Casterline, Ekren and
Gaw. Whereupon the President declared the motion carried.
Trustee Ekren reported that an opinion had been handed down Di Nucci case
from the Supreme Court by Judge Hershey in Case 80-S-B8151, Pioneer
Trust & Savings vs Village (Di Mucci - donation of land by ~ubdivider),
and that this opinion was against the Village. After Trustee Ekren read
aloud the opinion of the Court, discussion was held as to desirability of
appeal for re-hearing; it was pointed out that any appeal must be made
within the next two weeks. The President referred this matter ~ob the
Judiciary Committee.
Trustee Ekren gave statement regarding the zoning of certain
property: Zoning -
Cases 80-12 &
WDuring the past two years the Board of Appeals of the Village has 81-9
heard two petitions for rezoning several parcels of land along Northwest
Highway from Dale to Evanston Avenue. (Cases 80-12 and 81-9)o This property'
is presently zoned R-1 and both of the petitions have asked for B-B use.
The Board of Appeals has on both occasions unanimously denied the petitions
for rezoning. We, the Board of Trustees, have concurre~ with this opinion
of the Board of Appeals."
Trustee Ekren, seconded by Trustee Bickley, moved that the Village petition
the Hoard of Appeals for zoning change, from present R-1 to B-2, of Lots
through 21 inclusive, in Northwest Heights Subdivision, ALSO unsubdivided
area bounded on South by Northwest Highway, on East by Lots 8, 9, 10 and 11,
on the North by Lots lB, 14 and 15, and on the West by Lots 18, 19 and 20,
all in BI. 8 in A.C. McIntosh's Northwest Meadows; to be heard at the
regular June BO meeting; further, that all persons affected will be notified
of this petition.

Village Manager Appleby will be in possession ef the engin-
eering specifications for the development of this area by
Monday, May 29, 1961, according to Mr. Cadigan of Consoer,
Townsend, the Village Engineers.. Action should be taken
soon inasmuch as this Board will net meet again until
June 6th and this development work is dependent on good
weather and an early planting.
Trustee Bruhl, seconded by Trustee Casterline, moved that
Village Manager Appleby be given authority to place such contracts to
perform the development work in accordance with the engineering
specifications.

Trustee Bruhl read the following report from the Finance
Special Committee:

program "On May 16, 1961, this Board approved the establishment of a special
committee for the purpose c~f reviewing the Village Insurance Program
for the coming year. The Finance Committee is happy to report that a
distinguished group of residents were recommended by the various civic
organizations. The Finance Committee met ~ith this group and accordingly
recommend their appointment. They are aware of the fact that there will
be no compensation for their services and that their appointment will
automatically exclude their participation in any way in insurance
placement. They are present this e~ening and are most anxious to get
on with the assignment.
Mr. President, in view of the impending time schedule, the Finance
Committee respectfully requests that you make the appointments at
this meeting."
Trustee Bruhl, seconded by Trustee Gaw, moved that the following
citizens be appointed to the Special Committee for Village Insurance
Program:

Pierce Rose Clement-Ward
William Wilson
The President put the question, the Clerk called the roll, with the
following, response: Ayes, Trustees Bickley, Bruhl, Casterline, Ekren
and Gaw. Absent, Trustee Phillips. Whereupon the President declared the
motion carried.
Mr. Myer Engler of Consoer, Townsend return6d with the bids on
MFT 16CS MFT 16CS and recommended award to the lowest bidder. Trustee Gaw,
bids seconded by Trustee Bruhl, thereupon moved that contract for MFT 16CS
be awarded to Allied Asphalt Paving Company of Hillside in the amount
of $94,144.82;subject to the approval of the. Illinois Division of High-
ways; that the President and Clerk be auth~ized to sign the contract
with Allied Asphalt; and that bid check of the highest bidder, Rock
Road Construction Co., be returned to them.

Trustee Casterline read memo to the new Chairm~n of the Police Police
Committee, giving past history and various documents in cnnnection Committee
with its operation, stating he ~ould be willing to answer a~yquestions
his previous experience would allow.
Trustee Bickley accepted with thanks, then reported that investi-
gation of the Kantsr homicide case was csntinuing, involving help from
two men from downtown and investigation out of state. Trustee Bickley also
reported that former Officer Ed Haehmeister is returning from leave of absence
granted a year ago, that the Department would welcome hisreturn. Inasmuch
as a new man had been hired meanwhile, thus filling the quota, Trustee Bickley,
seconded by Trustee Casterline, moved that the Village Attorney prepare
resolution increasing the number of personnel of the Police Department by
one patrolman, and that Ed Hachmeister be re-instated and paid at the present
scale for patrclmmn. The President put the question, the deputy clerk call%d

In accordance with our conference on Tuesday, May 16, 1961, this
is ~ advise you that this office will continue to handle the processing of
the papers necessary for completion of this project upon authsrization by
the Board of Trustees to so do.
It is Understood that our fee for such work shall be on the basis
of the time spent for such work at the rate of $25- to $30- an hour,
depending upon who is working on the project.
Would you kindly advise when the authorization ~as been made.

continue to handle the processing of the papers necessary for completion
of the Mount Prospect Library bond issue at a rate of $25 to $30 per hour,
and that bill for said project be accompanied by a time sheet.

Police Chief Whittenberg asked for Village representation in Village Atty.
the case of Village of Mdunt Prospect vs Ratkay, to be heard before
Justice of the Peace Georgen cn June 7th. Trustee Casterlime, seconded
by Trustee Bickley, moved that Village Attorney Hofert represent the Village
in this case.
