HomeMy WebLinkAbout04/11/1961 VB minutes MINUTES OF REGULAR MEETING OF THE BOARD OF TRUST,S MELD IN MUNICIPAL BUILDING ON APRIL 11, 1961 President Lams called the meeting to order at 8:10 P.M. with roll call the following trustees present: Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Absent, none~ Trustee Ekren, seconded by Trustee Airey, moved that the minutes minutes of the preceding meeting of April 4th be approved as submitted. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. Trustee Gaw, seconded by Trustee Casterline, moved that the following bills for the week ending April llth be approved as follows: General - $ 8,233.69 bills Garbage - 3Q. O0 Library - - 375.76 Water, operation- 5,991.04 Water Bond & Int. 1960 10,507.50 $25,137.99 The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. The following letter was presented: Park District Mount Prospect Park District re Country Club Lions Memorial Park April 11, 1961 President & Trustees of Mount Prospect Village Board 112 East Northwest Highway Mount Prospect, Illinois Gentlemen: You are hereby notified that the Board of Commissioners of Mt. Prospect Park District, Cook County, Illinois, duly authorized its legal council to proceed as soon as possible to take all steps that may be necessary and desirable for the acquisition of the M-P Country Club and a portion of the subdivision known as Northwest Heights by condem- nation and to employ an associate council for these purposes as in his discretion deemed necessary. I am advised, as of this date, that preliminary~steps have been taken to this end. Under the circumstanc~es of the mandate of the electorate of the Park District and in vie~ of imminent acquisition of these properties by the Park District, it is deedmed by the Board of Commissioners of Mt. Prospect Park District that it is necessary and desirable and in the best interest of the community that the Board of Trustees of the Village of Mount Prospect pass and adopt an ordinance reducing the number of Club liquor licenses by one and that no Club liquor license be issued to the present owners of the M,P Country Club, Inc. Boddy, President Mount Prospect Park District April 11, 1961 Trustee Ekren, seconded by Trustee Norris, moved for the passage of proposed Ord. 754: Ord. 754 AN ORDINANCE TO AMEND SECTION 13.107 OF Class B THE MUNICIPAL CODE OF MT.PROSPECT OF 1957 liquor license AS AMENDED This ordinance reduces the number of Class B liquor licenses in the Village by one. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the President declared the motion carried. This ordinance was passed and approved at 8:20 P.M. Trustee Gaw read proposed Ordinance #755 which would raise !~Discussion the salaries of the Board of Trustees~ President and Clerk. Discussion re salaries of ensued, wherein Trustee Airey moved, seconded by Trustee Caster- Board, Pres. & Clerk line, that the attorney be authorized to prepare an ordinance providing that the President and Board of Trustees shall serve without any compensatien Whatever; that theseoffices be considered a public service and position of public trust; and further, that the President and Board of Trustees keep records of expenses incurred for reimburse- ment by the'Village. Thereupon Trustee Norris, seconded by Trustee Ekren, moved to amend the foregoing motion to include the Clerk serving without compensation, a~se. The President called for roll call vote first upon the amend- ment to the motion regarding service without compensation, in which the Clerk was also to give service only as a public trust. The Clerk called the roll, with the followingresponse: Ayes; Trustees Airey, Casterline, Ekren. Nays, Trustees Gaw, Norris and Schlaver. President Lams voted nay, and this motion was declared defeated. The Presidenb ~he~eupen took up the motion regarding service without pay for the President and Board, The Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline and Ekren. Nays, Gaw, Norris and Schlaver. President Lams voted nay, and this motion was declareddefeated. The Presidentthen took up the motion for the passage of Ordinance #755, which would raise the salaries of the Board members from $5 to $10 per meeting, the President from $20 to $25 per meeting and the Clerk from $600 to $750 per year, and called for a vote. ~ Ord. 755 AN ORDINANCE TO AMEND SECTIONS 1.004, Salary change for Board 2.102 and 3.113 OF THE MUNICIPAL CODE members, President & OF MOUNT PROSPECT OF 1957 AS AMENDED Clerk The Clerk called the roll with the following response: Ayes, Trustees Ekren, Gaw, Norris and Schlaver. Nays, Trustees Airey and Casterline. The President then declared Ord. #?55 passed. Meeting dates Trustee Airey, seconded by Trustee Casterline, moved to take of Board from the table the motion of March 28th which would set the Board of Trustees' meetings for the first and third Tuesdays of each month instead of the first four Tuesdays as now held. The President put bhe question, the Clerk called the roll, with the fol~owing response: Ayes, Trustees Airey, Casterline, Norris. Nays, Trustees Ekren, Gaw and Schlaver. President L~ms voted aye, and decl~ed the motion carried. Pres. Lams President Lams voluntarily left the meeting for a few minutes se~ed sumEons at approximately nine o'clbck and upon his' return he stated that he 61-S-6934 had just been served with a summons and a copy of the complaint in M-P Country Club, Inc. vs Theodore Lams as liquor commissioner, Court Case 61-S-6934. Meeting dates Trustee Airey, seconded by Trustee Casterline, moved that the of Board Village Attorney be directed to prepare an ordinance which would set (cont'd) the meeting nights of the Board of Trustees at the first and third Tuesdays of each month, amending Sec. 2.10B ~of the Code. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Gaw. Nays, Trustees Ekren, Norris and Schlaver. President Lams voted aye, and the motion was declared carried. Trustee Gaw, seconded by Trustee Ekren, moved that the next Postpone next regular meeting of the Board of Trustees be postponed one day, to Board meeting Wednesday, April 19th, to allow for election to be held on Tuesday, April 18th. The President put the question, the Clerk called the roll, as follows: Ayes, Trustees Airey, Casterline, Ekren, Gaw and Norris. Nay, Trustee Schlaver. Whereupon the President declared the motion carried. Trustee Airey, seconded by Trustee Ekren, moved for passage of Ord. #756: Ord. #756 - ~.~ AN ORDINANCE GRANTING A VARIATION FROM Zoning Var. THE VILLAGE OF MOUNT PROSPECT ZONING Case 61-8 ORDINANCE AS AMENDED Williams-Gra) This grants variation to the Williams-Gray Company to erect an office building for non-manufacturing purposes in property zoned I-1. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. Whereupon the President declared the motion carried and Ord. 756 passed. L~ Trustee Airey, seconded by Trustee Gaw, moved that the M.P.Country Club ~ Village Attorney be authorized and directed to represent the vs ~ Village in Superior Court Case 61-S-6934, M-P Country Club, Theodore Lams re ~ plaintiff, vs Theodore A. Lams, Liquor Commissioner of the Villageliquor.61-S-69B4 ~E: of Mount Prospect. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris and Schlaver. Nays, none. whereupon the Presidaent declared the motion carried. Trustee Airey read letter of transmittal from the Home Builders Association of Chicagoland, Technical & Codes Committee, in which they Bldg. Code enclosed report of survey taken of building codes used by local suburban communities. Trustee Airey noted that the above committee rated the Mt. Prospect Building Code as the only code on which the comment "Good Code" is made. It was decided that Trustee Gaw is to appear on behalf of the Zoning hrng Village at the Zoning Board hearing of April 28th regarding rezoning Library of Library property (Case 61-lB) to B-2. The Board requested Village Manager Appleby to appear on behalf County of the Village at County Zoning hearing of April 26th in regard to Docket Zoning #179, rezon~ng from R-4 to M-1 four acres on west side of Busse Road 1250 feet south of intersection of Busse Rd. and Algonquin Road.
