HomeMy WebLinkAbout08/02/1960 VB minutes MINUTES OF THE MEETING OF THE BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT HELD IN TH~ MUNICIPAL BUILDING ON TUESDAY AUGUST 2, 1960 The meeting was called to order at 8:15 P.M. by Phyllis Gardner, roll call Deputy Clerk. Upon roll call, the following answered Present: Airey, Ekren, Gaw, Norris and Schlaver. Absent, Casterline and President Lams. A motion was entertained by the Deputy Clerk to select a President pro tem. Trustee Ekren, seconded by Trustee Gaw, moved that Lloyd Norris act as President during the absence of President Lams. The Deputy Clerk called the roll, with the following response: Ayes, Trustees Airey, Gaw, Ekren, Norris and Schlaver, and Trustee Norris accordingly took the seat of the President. Trustee Gaw, seconded by Trustee Schlaver, moved that the minutes of July 19th be approved as submitted. The President put the question, minutes the Clerk called the roll, with the following response: Ayes, Trustees Airey, Ekren, Gaw, Norris and Schlaver. Absent, Casterline. Whereupon the President pro tem declared the motion carried. Trustee Gaw, seconded by Trustee Ekren, moved that the following bills be approved for the week of A~gust 2, 1960: General $15,072. BI Garble 5,601.27 Parking System bills Revenue Fund BO6.12 Library 792. BB Motor Fuel Tax 502.95 Water 7,281.88 $29,558.86 The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Gaw, Ekren, Norris and Schlaver. Whereupon the President pro rem declared the motion carried. Trustee Schlaver, seconded by Trustee Ekren, moved that Art Lewis of the Village engineers be authorized to prepare specifications for bids Water - and recommendations for cleaning and painting of the overhead water storage Paintin~ tank at Evergreen and Maple Streets. The President pro tem put the of storage question, the Clerk called the roll, with the following~ response: Ayes, tank Trustees Airey, Gaw, Ekren, Norris and Schlaver. Whereupon the President pro rem declared the motion carried. Trustee Ekren explained that due to unexpected difficulties the road leading into the Judith Ann Serafine Apartments on East Lincoln Street had not been finished by the builder, hamperin~ completion of construction, Serafine and the Buildin~ Committee recommended extending the building permit to - Apartment allow such completion. Trustee Ekren, seconded by Trustee Schlaver, moved bldg. that the buildinff~ permit of Serafine Builders be extended to October 1 permit without additional fee, and if construction is not finished by October 1 the fee of $728~ for extension of permit be imposed. The President pro tern put the question, the Clerk called the roll, with the following response: Ayes, Trustees Schlaver, Norris, Gaw and Ekren. Nay, Trustee Airey. Whereupon the President pro tem declared the motion carried. Trustee Norris brought up pavin~ of alley behind duplex apartments on South Elmhurst, stating it had been held in committee pending investi- alley gation of whether paving could proceed without installation of sewer, paving Mr. Cadigan of the Village engineers sta~d that it was their opinion DiMucci apts. that drainage would not be adequate without such sewer. This matter is to be brought up again at the next meeting. Trustee Airey, seconded by Trustee Gaw, moved for passage of proposed Ord. 719 as follows: AN ORDINANCE TO AMEND SEC. 18.202 OF ARTICLE 2 traffic OF CHAPTER 18 OF THE MUNICIPAL CODE OF MOUNT PROSPECT OF 1957 AS AMENDED August 2, 1960 This ordinance sets up one-way traffic around the Lions Park Fieldhouse. The President pro tem put the question and the motion passed by unanimous acclamation. Trustee Airey, seconded by Trustee Schlaver, moved for passage of proposed Ord. ?20 as follows: Ord. 720 AN ORDINANCE TO AMEND SEC. 18.501 ARTICLE V, No parkin2 next to CHAPTER 18 OF THE MUNICIPAL CODE OF Lions Park Fieldhouse MOUNT PROSPECT OF 1957 AS AMENDED Th~s ordinance prohibits parking on the east side of Maple Street between Shabonee Trail on the south and Lincoln Street on the north. The President pro tem put the question and the motion carried by acclamation. Mr. Bill Lambert, 114 N. Kenilworth, arose and read petition Zoning Case from surrounding property owners in the Centralwood Subdivision 60-16, Delgado objecting to the erection of a nursing home at Prospect and North Kenilworth. The Board stated that this petition could not be con- sidered until the report from the Zoning Board on this case was submitted to them. Zoning Case Mr. Salvatore Di Mucci presented petition to the Board of 60-20 Trustees for annexation, contingent upon B-3 zoning, of tract of land Di Mucci at the southwest corner of Golf Road and Highway 83. Trustee Airey read the following letter of petition: August 2, 1960 President and Board of T~ustees Village of Mount Prospect, Ill. Gentlemen: t hand you herewith a Petition to Zone and a Petition to Annex the followin~ property: Lots 4, 5, 8 and ? in Juhnke's Subd'ivision of that part of the East 8~.?0 feet of the Northeast 1/~ of Section 14, Township 41 North, R-11, lying South of the Center of Golf Road, situated in the Town of Elk Grove, County of Cook, State of Illinois You will note that the petition for annexation is filed subject to your grantin~ the Petition to Zone the property as requested in the said Petition. If the annexation and zoning are completed in accordance with the Petitions, then it is my intention to convey to the Village a tract of land 50 ft. x 125 ft. along the west line of Lot ?, where I choose. This tract is to be used exclusively for a well or a water reservoir and I will give you access to the well or reservoir. I shall have the right to run a 8-inch main from the present lineowned by the Village in Golf Road, to provide water for the property described above. You will give me permission to tie in to the sanitary line on Golf Road. I shall also be permitted to run any storm water from the property described above into the drainage ~itch along Golf Road down to the Candota Avenue culvert, following the natural flow of the water without my bein~ required to construct any further facilities for storm water. I also agree to convey to the Village a portion, approximately 80 ft. x 120 ft. of Lot ~ in Juhnke's Subdivision above described, on the understanding that the Village shall use the said parcel exclusively for the erection of a fire station. If the Village shall not erect a fire station on said property within 5 years, then I shall~ have the option to purchase the said parcel from the Village, free and clear of all taxes and other liens, for the sum of $5,000. In the event tb~t I shall re-acquire the said parcel from the Village, the said parcel shall be zoned "B-I". Board that their questions be answered by Mr. Di Mucci in another room so as not to prejudice the decision of the Board, which was done. Trustee Norris read report dated July 29th from Wm. Cadigan Sewers - of Consoer, Townsend & Assoc., Village Engineers, regarding study made Ran~view of Flooding conditions in Randview Highlands. After cleaning of sewers, Highlands it was found that substantial flow comes overland from the High School into Forest Avenue, and drainage connection was made from the football field into the Highland Avenue sewer. It was agreed that discussion should be held with the High School authorities to discuss re.diversion of water run-off and report should be made at the next meeting. Trustee Airey, seconded by Trustee Gaw, moved for passage of proposed Ordinance #722: Ord. #721' Zoning AN ORDINANCE GRANTING A VARIATION FROM THE VILLAGE C~ MOUNT PROSPECT ZONING ORDINANCE AS AMENDED This ord~uance rescinds Ord. 693 which allowed erection of dental offices, and allows erection of building for professional office purposes. The President put the question, and the motion carried by acclamation. The President pro tern declared the motion carried and Ord. #721 passed. Trustee Ekren, seconded by Trustee Airey, moved that the Village Manager be authorized to represent the Village at hearing of the Cook County County Zom_ing Board on August 10th, regarding petition to rezone from z°n~ng R-4 to B.2 area at Dempster, Busse and Algonquin Roads, 2½ acres in size. This motion carried by acclamation. Trustee Airey, seconded by Trustee Ekren, moved for passage of Ord. #722: Ord. ?22 AN ORDINANCE O~ANTING A VARIATION FROM THE Zoning ~i~.LAGE ~F MOUNT PROSPECT ZONING ORDINANCE Dooley AS ANENDED This ordinance allows R. E. Doe!ey to build au addition to the present structure en East Northwest Highway. This motion carried by acclamation. When Central Road is widened it will be necessary to move Traffic existing traffic controls back. Trustee Schlaver, seconded by Trustee controls Norris, moved that the Village Manager be authorized to engage Consoer, MAin & Townsend & Associates to engineer the reeving of traffic control signals Central at Central and Nsfn Street, cost of their fee not to exceed $500.. Whereupon the President pro tern declared the motion Trustee Sob_laver, seconded by Trustee Ekren, moved for the ~ adoption of Res. #19.60: Res. 19-60 August 2, 1960 A RESOLUTION FOR IMPROVEMENT CF PINE AND OTHER STREETS UNDER T~ MOTOR FUEL TAX LAW Res. 19-60 Street Improvement The President put the question: the Clerk called the roll, with the following response: Ayes, Trustees Airey, Gaw, Norris, Ekren and Schlaver. Absent, Casterline. Whereupon thePresident pro Rem declared the motion carried and Res. 19.60 adopted. Trustee Schlaver, seconded by Trustee Airey, moved that the Tree stump Village Manager be authorized to emplsy Otto Georgi to remove tree removal stumps in parkways and village.owned land at a price not to exceed 505 per diameter inch, 6-7 inches below grade. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Gaw, Ekren, Norris and Schlaver. Absent, Casterline. Whereupon the President declared the motion carried. Zoning Trustee Airey referred again to Mr. Di Mucci,s petition for Case 60-20 annexation and made the following motion, seconded by Trustee Ekren: Di Mucci That the plat of ~nexa~ion and petition to annex area at Go2f Road and Highway 83 be referred to the Clerk for filing end that the petition to zone ~his property, together with the proposed development plan, be referred to the Zoning Board of Appeals for publication and hearing. This motion carried by acclamation. Trustee Schlaver, seconded by Trustee Gaw, moved that the dates of October 9-24 inclusive be granted to the Combined Appeal campaign Charities orgainization of Mount Prospect for their charity drive. This motion carried by acclsmation. -- It was mm~ounced that bids will be taken at the August 16th meeting for surfacing of streets in Northwest Meadows. ~- 6 Trustee Airey, seconded by Trustee Gaw, moved that appeal be Case 56-, 122~Bmade to the Supreme Court ~rom the decision of Judge Roberts in Court Case 56-C.12263, Cosmopolitan National Bank of Chicago vs. Village of Mount Prospect. The President put the question, the Clerk called the roll, with the following response: Ayes, Trustees Airey, Gaw, Ekren, Norris aud Schlaver. Absent, Casterline. Whereupon the President declared the motion carried. Trustee Airey, seconded by Trustee E~ren, moved that ps~nment of fees of Master.in. Chancery be authorized, not to exceed $2,176o12, upon direction of the Clerk (of the Court), or such lesser sum thereof as may be agreed upon by the parties. The President put the question, the Clerk called the roll, with the fellowing response: Ayes, Trustees Airey, Gaw Ekren, Ne~is and Schlaver. Absent, Casterline.
