467 MINUTES OF A REGULAR MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES, HELD IN THE VILLAGE HALL, MOUNT PROSPECT, ILLINOIS, ON THE 3RD DAY OF JULY, 1945 A.D. President called the meeting to order at 8:10 P.M. The roll being called the following Trustees responded: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. The minutes of the regular meeting of June 5th and the special meeting of June 27th were read and approved upon a motion made by Trustee Lams and seconded by Trustee Hartwig. Motion carried. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. No nayes. It was moved by Trustee Kirchhoff, seconded by Trustee Hartwig that the special assessment report be placed on file. Motion carried. A motion was made by Trustee Mott and seconded by Trustee Hartwig, that the bills, as approved by the Finance Committee be- approved for VD payment. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. No nayes. -t-, Bids for painting the highway lights, traffic signals and control ,- W box were then opened and read - by the Clerk with the following result: + The Meade Electric Co. bid $218.00; the H & H Electrid Co. $21 ©00; and "-ri the Peterson Electric Co. $228.00. It was moved by Trustee-Kirchhoff, seconded by Trustee Mott that the bid of $210100 by the H & H Electric Co. ba aedepted, and that:the resolution"as..required by the State of Illinois Division of Highways, be adopted. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. No nayes. A motion was made by Trustee Wax and seconded gy Trustee Hartwig that one thousand (],000) water ledger sheets be purchased from the Qadwallader and Johnson Co. for $29.80. Ayes: Hartwig, Kirchhoff, Lams, [:: Mott, Wax and Welsh. No nayes. It was moved by Trustee Mott and seconded by Trustee Hartwig that the Mt. Prospect Fire Dept. be given permission to hold their carnival at the intersection of Maple and Evergreen Streets from July 25th to the 28th inclusive. Motion carried. After reporting on unpaid water bills, a motion was made by Trustee Wax and seconded by Trustee Lams that the water deposits be deducted from the uncollectSble water accounts, and that the Board approve the write -off in the amount of $33.69 as uncollectsble. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax and Weida. No nayes. Proposed agreements in the case of the Village of Mount Prospect vs. Christian D. Busse, et. al. presented by Mr. William Busse, Jr. and the Hoists Trust were read. After discussion by the Board, Trustee Welsh read a resolution, prepared by the Village Attorney entitled "RESOLUTION - AUTHORIZING SETTLEMENT OF CASE OF VILLAGE OF MOUNT PROSPECT VS. CHRISTIAN D. BUSSE, ET. AL., NO. 40- S- 16457. President Pendleton then called a ten minute recess and upon resuming, Trustee Welsh read the following letter of transmittal& July 2, 1945 Mr. Fred Welsh Chairman, Judiciary Committee 1:: Mt. Prospect, Illinois Dear Mr. Welsh: I am enclosing herewith draft of resolution authorizing settlement of the case of the Village of Mt. Prospect vs. Christian D. Busse, et al., No. 40 -8- 16457. I have made a very careful study of the facts and the law relating to this litigation and I am of the opinion that the settlement proposed by the sureties is fair and one that should be accepted by the Board of Trustees. Nickel Village Attorney 4O It was moved by Trustee Lams and seconded by Trustee Kirchhoff that the resolution entitled "RESOLUTION AUTHORIZING SETTLEMENT OF CASE OF VILLAGE OF MOUNT PROSPECT VS. CHRISTIAN D. BUSSE, ET AL." bjadopted and placed on file.- Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. No nayes. Trustee Welsh reported on Mr. J. P. Moehling's request to amend the liquor'ordinance increasing the number of taverns to four, and read a letter of opinion by Mr. Henry 0. Nickel, Village attorney. After dis- cussion,-it was unanimously agreed that three taverns in the Village were sufficient. It was moved by Trustee Welsh, seconded by Trustee Lams that the Judiciary Committee Chairman notify Mr. J. P. Moehling of the Board's decision and opinion in this matter. Motion carried. The.Clerk then read a petition signed by twenty -two citizens, relative to the filling of an excavation at 214 N. Maple Street. President Pendle -, ton instructed the Committee in charge to proceed with the necessary steps to remedy the condition.stated,.in the petition. The annual levy ordinance was then read. It was moved by Trustee Welsh, seconded by Trustee Wax, that 'THE ANNUAL LEVY ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, PROVIDING FOR THE LEVY AND ASSESSMENT OF TAXES FOR THE FISCAL YEAR BEGINNING MAY 1, 1945 AND ENDING APRIL 30, 1946 ", be passed. Ayes; Hartwig, Kirchhoff, Lams, Mott, Wax and Welsh. No nayes. It was moved by Trustee Mott, seconded by Trustee Lams, that the Mount Prospect State Bank and the First National Bank of Chicago continue as depositories for the funds of Fred G. Willa, Village Treasurer and collector. Ayes: Hartwig, Kirchhoff, Lams, Mott, Wax, and Welsh. No nayes. There being no further business to come before this meeting, it was moved by Trustee Kirchhoff and seconded by Trustee Lams that the meeting be adjourned. Motion carried.
