HomeMy WebLinkAbout07/26/1945 VB minutes 4O MINUTES OF A SPECIAL MEETING OF THE PRESIDENT AND BOARD OF TRUSTEES, HELD IN THE VILLAGE HALL, MOUNT PROSPECT, ILLINOIS, ON THE 26TH DAY OF JULY, 1 945 A.D. The meeting was called to order by President Pendleton at 8:20 P.M. and upon calling of the roll the following Trustees responded: Hartwig, Lams, Mott and Welsh. Trustees Kirchhoff and Wax were absent. 1 The clerk then read the following communication from the President: July 21, 1945 Mr. Roy E. Schlemmer, Village Clerk Village of Mt. Prospect, I11. Dear Mr. Schlemmer: Will you please call a special meeting of the Village Board of Trustees to be held at the Village Hall, July 26, at 8 P.M. This meeting is for the purpose of acting upon certain resolutions in connection with the settlement of the suit against Chris. Busse and his Sureries. Very truly yours Signed: M. B. Pendleton President Village of Mt. Prospect, 111. Trustee Welsh, chairman of the Judiciary Committee, read the decree of Judge McGoorty in the Superior Court case, Mt. Prospect vs. Christian D. Busse, et al., No. 40- S- 16547. 471 The following letter was then read; July 14, 1945 Mr. M.B.Pendleton, President, Mount Prospect, Illinois Dear Mr. Pendleton: Re: Mary F. Howie, et al, vs. Mt. Prospect -No. 37 S 4082 Judgment was entered in the above entitled cause in the Superior Court of. Cook County recently. I have advised Mr. Henry 0. Nickel, the attorney who represented you in the above entitled cause, that if he is successful in settling the case of Village of Mount Prospect vs. Christian D. Busse, et al, #40 S 16547, with the defenants' sureties, and the judgment in the above entitled case will be paid in cash, that it is agreeable tb me to pay Mr. Nickel toward his fees 10% of the total amount of the judgment entered in the Howie case. As you know, I have already made substantial concessions but in order to effectuate an immediate settlement and payment of the judgment in the Howie case, I am willing to make this further allowance. Yours very truly, Signed: Leonard C. Mead A motion was made by Trustee Welsh, seconded by Trustee Mott that the Board accept the proposal made by Leonard C. Mead, attorney for the judgment creditors in the case of Mary F. Howie et al, Superior Court No. 37 -S -4082, to pay toward the attorney fees in the settlement of the case of�Mt. Prospect vs, Christian D. Busse et al, No. 40- S- 16547, 10% of the total amount of the judgement entered in the Howie vase. Ayes: Hartwig, Lams, Mott and Welsh. No Nayes. Memorandums of agreement for release by and between the Village of Mt. Prospect and Christian D. Busse, et al, were read, signed and the official seal of the Village affixed thereto. It was moved by Trustee Welsh and seconded by Trustee Hartwig, that the Village Treasurer be and he is hereby authorized to pay out of the funds re- ceived from the sureties in settlement of the case of Mt. Prospect vs. Christian D. Busse, et al, No. 40- S- 16547, and out of the General Corporate • Funds as authorized by a resolution of this date, the following ,judgments: - To: Leonard C. Mead, attorney for the judgment creditors in the case of Mary F. Howie, et al, Superior Court No. 37-S -4082 $14,673.56 To: Christopher F. Jones, Attorney for the judgment creditors in the case of John J. Kuebler, et al., Circuit Court No. 42- C- 11,470, principal amount $ Less 10% discount 174.92 Net amount 1,574.32 To: Christopher E. Jones, Attorney for the judgment creditors in the case of L. L. Cook, et al., Circuit Court 11110 r No. 36 -0- 13946, principal amount $2213.22 Less 10% discount 221.32 Net amount 1,991.90 To Gerald R. Gorman, Master in Chancery. 100.00 To: Mr. A. Zurakov, assignee, American National Bank & Trust Company of Rockford, judgment creditor, Superior Court, case No. 44 -S -6289, principal sum of judgment $5788.07 Amount Of discount allowed 503.80 Net amount 5,284.27 cont. 472 IT IS FURTHER MOVED that the Village checks hereinabove authorized to be paid to the respective parties be delivered to Henry 0 . Nickel, Attorney for the Village, to be delivered by hiip to the aforesaid parties upon receiving satis- factions in full° in each of the above mentioned cases. Ayes: Hartwig, Lams, Mott, and Welsh. No nayes. 7-}` A resolution entitled "RESOLUTION AUTHORIZING TRANSFER OF SPECIAL ASSESS - MENT SURPLUS CASH TO GENERAL CORPORATE FUNDS" was read. It was moved by Trustee Hartwig, seconded by Trustee Welsh that the resolution be adopted and placed on file. Ayes: Hartwig, Lams, Mott and Welsh. No nayes. There being no further business to come before this meeting, it was moved by Trustee Welsh, seconded by Trustee Mott that the meeting be adjourned. Motion carried. 0.%. woo
