OF TRUSTEES HELD AT THE VILIAGE HALL
JANUARY 3, 1961
President Lams called the meeting to order at 8:21 P.M. with roll cai]
the following trustees present: Airey, Casterline, Ekren, Gaw, Norris
and Schlaver.
,-- Trustee Norris, seconded by Trustee Casterline, moved that the minutes
minutes of the previous meeting of December 20th be approved as corrected.
The President put the question, the deputy clerk called the roll, with the
following response: Ayes, Trustees Airey, Casterline, Ekren and Norris.
Pass, Trustees Gaw and Schlaver. Whereupon the President declared the
motion carried.
Trustee Gaw, seconded by Trustee Ekren, moved that the Following
bills for the period to January Brd be approved for payment:

Trustee Airey, seconded by Trustee Casterline, moved that the
Board concur in the appointment of President Lams, appointing Richard Young
as a member of the Plan Commission to December, 1964. The President put

Trustee Norris read the following letter from Brickman Home

Gentlemen:
In accordance with the request of the Village Beard of Trustees
expressed at your regularly scheduled meeting on the 20th of December, 1960,

we wish to advise you that in accordance with ou~ Letter of Intent
to the Village of Mount Prospect dated November 14, 1958, we will
complete the improvements in Forest Avenue, in accordance with the
plans and specifications referred to in the above mentioned agreement,
during the coming paving season when directed by the Village Engineer.
We wish to further advise you that a contract dated November 28, 1958
exists between this company and the Skokie Valley Asphalt Company for
the paving work on Forest Avenue.
We trust that this statement of intent will allow you to ~-~
accept the improvements which have been installed in Unit #2 of this
subdivision to date.

Mount Prospect accept the public improvements in Randview Highlands
Unit #2 except for Forest Avenue. The President put the question, the

declared the motion carried.
Mr. Appleby read the following letter from Consoer, Townsend &

A final inspection of the water, sewer and paving improvements
constructed to serve the subject subdivision has been made by Mr. David
Creamer and Mr. William McManamon of this Company.
These improvements have been constructed in substantial con-
formance to the contract plans and specifications and are hereby recom-
mended to the Village of Mount Prospect for acceptance.

Trustee Schlaver, seconded byTrustee Ekren, moved that the Badger Meter Co~
Village Manager be authorized to accept the proposal made by the Water Meter
Badger Meter Company to supply water meters at the same price as contract
last year. The President put the question, the Clerk called the roll,
with the following response: Ayes, Trustees Airey, Casterline, Ekren,
Gaw, Norris and Schlaver. Whereupon the President declared the motion
carried.
Trustee Caeterline reported that the Police Department is New Police Cars
starting to receive it's new squad cars.
Trustee Casterline read the following memo from Chief George
Whittenberg regarding one-way traffic on East Highland Avenue:

Subject: Northeast Home Owners' Highland Avenue Request of Dec. 16, 1960
In regard to the request of the Northeast Home Owners'~ Association to make
Highland Avenue a one-way street for east-bound traffic only, I have given
this situation very careful consideration. I have watched traffic at
different times of the day and find that the best solution would be to have
the street widened to the full width from Rand Road west to Main; or if
a one-way is to go in, the one-way should be from Main Street east to Elm
Street only. If a one-way would continue through to Rand Road, I feel we
would be setting up a hazard at the intersection of Rand and Highland.
Traffic driving northwest on Rand intending to turn left to go west on
Highland would be in the Rand Road eastbound lanes before they would see
the "ONE-WAY, DO NOT ENTER" sign, and with fast Rand Road traffic bearing
down on them, this could possibly eause a serious accident.
If the eastbound one-way would end at Elm, traffic could then come in
from Rand and at Elm could turn south to Memory Lane and then continue
on west to jog back to Highland on Main.
The best solution would be to pave Highland to the full width, and
eliminate the one-way.

Trustee Casterline then made the following motion, seconded by
Trustee Norris: In view of the recommendations of the Northeast Homeowners
Association and the research and opinions of Chief of Police Whittenberg,
I move the Village Manager be authorized and directed to install signs to
provide for one-way traffic eastbound on Highland Avenue from Main to
Elm Street.
The President put the question, the Clerk called the roll, with the
following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw, Norris
and Schlaver. Whereupon the President declared the motion carried.
Reference was made to traffic survey by Mr. Thomas Haskett, Traffic
assistant to Village Manager, regarding number of children crossing
Rte. 83 at different points in order to attend St. Raymond's School. The f
Beard decided to take no action at this time.
Trustee Airey, seconded by Trustee Gaw, moved that the Village of
Mount Prospect Zoning Board of Appeals hold a public hearing with respect Zoning
to the following proposed amendment to the Zoning Ordinance: Ordinance

Delete the following from Sec. 6, R-3 District, · 3:
"General hospitals for humans, orphanages, homes for
aged and similar institutions, with sleeping rooms
in number not exceeding one for each 500 square feet
of lot area."

Trustee Airey, seconded by Trustee Gaw, moved that the Board

Zoning Trustee Airey took up the zoning case of Sal Di Mucci, 60-20,
Case 60-20 southwest corner of Golf Road and #83, stating that the Judiciary
Di Mucci Committee would recommend annexation and rezoning to B-1 subject ~
certain agreements and covenant running with the land similar to other
shopping centers previously annexed. These agreements would be concerned
with 10-inch sewer main, development of entire area within a 3-year --
period, sufficient parking area, amount of area given B-3 zoning for
gas station and bowling alley and donation of land or its 'equal con-
sideration for public use. Trustee Airey, seconded by Trustee Ekren, -'
moved that the Village Attorney be authorized to prepare the necessary
ordinance, covenants and agreements for annexation and rezoning of
property described in Zoning Case 60-20.
The President put the.question, the Clerk called the roll, with the
following response: Ayes, Trustees Airey, Casterline, Ekren, Gaw,
Norris and Schlaver. Whereupon the President declared the motion
carried.
Snow - In regard to a proposed ordinance requiring snow removal,
sidewaks Trustee Airey suggested that the Village Manager contact the City of
Park Ridge to check their arrangement for allowing private contracts
for snow removal from sidewalks.
Village-owned Trustee Airey, seconded by Trustee Ekren, moved that bids be
property taken for sale and removal of house at 20 S. Emerson St., former
library- Christ Busse property, next to library. The President put the question,
the Clerk called the roll, with the following response: Ayes, Trustees
Atrey, Casterline, Ekren, Gaw, Norris and Schlaver. Whereupon the
President declared the motion carried.
County Zoning Trustee Airey, seconded by Trustee Norris, moved that the
Di Mucci Village Manager be a~horized to represent the Village at Zoning Board --
of Appeals of Cook County hearing on January llth in the Village Hall;
Docket 117, request for special use consisting of shopping center,
multi-family and single family dwellings at the southwest corner of
Busse Road and Golf Road. This motion carried by acclamation.
Charities - The Village is a member of the Combined Appeal organization;
Combined Trustee Casterline was appointed unanimously to represent the Village
Appeal at their next meeting on January 18th.

The following changes in the minutes were introduced by motion
of Trustee Airey on January 17, 1961:
Trustee Airey took up the zoning case of Sal Di Mucci,
60-20, southwest corner of Golf Road and #SB, stating that the
Judiciary Committee would recommend annexation and rezoning to
B-1 subject to certain agreements and covenant running with the
land similar to other shopping centers previously annexed.
These agreements would be concerned with 10-inch water main,
development of entire area within a B-year period, sufficient
parki~ area, variation under B-1 zoning for gas station and
bowling alley, donation of land or its equal consideration for
public use and proper drainage throngh the Des Plaines sewer
system.
Trustee Airey, seconded by Trustee Ekren, moved that the Village
Attorney be authorized to prepare the necessary ordinance,
covenants and agreements for annexation and rezoning of property
described in Zoning Case 60-20.
The President put the question, the Clerk called the roll, with
the following response: Ayes, Trustees Airey, Casterline, Ekren,
Gaw, Norris and Schlaver. Whereupon the President declared the
motion carried.

Mr. Chester Busse asked for a clarification of the zoning given C. Busse
him in his zoning Case 60-10, Ordinance #717. His property is zoned Zoning Case
Industrial with B-3 variation allowing gasoline pumps; he wishes to add 60-10 , Ord.
residence quarters as allowed in Zoning Code under Industrial classifi- #?17
cation. This matter was taken under advisement by the Board for reply
at the next meeting.
Following is letter of opinion from Robert Downing, Village Attorney:

Village of Mount Prospect
Dear Mr. Appleby: Re: Chester Busse
Inquiry was made with respect to the possibility of issuing a
building permit for property owned by Chester Busse to allow the erection
of a dwelling unit over a service station located on said property.
It is understood that at the present time the property is zoned
in the I-1 Industrial District. It is also understood that the use of
the property is not an industrial use but a business use. It is also
understood that by Ordinances 475 and 717 variations have been granted
to the property owner to use the property for certain business or commercial
uses inconsistent with the industrial zoning.
Under the business zoning residential uses are not permitted.
Inasmuch as the property is now used for business purposes with variations
specifically having been granted, it would appear as though a building
permit for dwelling purposes which might be permitted under the industrial
I-1 District could be rejected on the basis that the property is now used
for business purposes. The property owner, by his own action, estopped
himselffrom uses permitted under the Industrial District.

Mr. Earl Iversen, (Zoning Case 59-21), plaintiff in Court Case Iversen
against Village regarding triangular lot at Lincoln and Elmhurst) arose court case
and asked what the Board wished to do with respect to his case. Mr. Downing
replied that inasmuch as the complaint had been dismissed with the recom- at 8B &
mendation that the Board use their judgment in the matte~ the Board's view Lincoln
remained the same; a reasonable sum of approximately $1,000 is offered for
this property if Mr. Iversen wishes to accept. Mr. Iversen stated that he
would not accept that amount; he thought $5,000 would be more fair considering
the many years of taxes and upkeep he had had on this property.
Trustee Norris, seconded by Trustee Casterline, moved for adjournment,
and the meeting was regularly adjourned at lO:B5 P.M.
