Case 62-23
AN ORDINANCE GRANTING A SIDE YARD VARIATION SO AS
TO PERMIT THE BUILDING OF A SINGLE FAMILY RESIDENCE
WITHIN FIVE FEET OF SIDE YARD LINE AS TO PROPERTY
LOCATED IN THE VILLAGE OF MOUNT PROSPECT.
Mr. Eugene Martin, Chairman of the Zoning Board of Appeals, arose and
stated that he wished to report that the Zoning Board denied the .
application for variation on the technical ground of no hardship
'proved, and that they withheld recommendation on the zoning because
of lack of information. .
Mr. Hofert stated That Mr. Martin was going to write a letter requesting
further information on the subdivision plans. He stated that Mr. Ruud,
attorney for Mr. Di Mucci, promised to provide the information requested
by the Zoning Board.
Mr. Hofert stated two reasons for allowing the variation ~if the Board
chose:
August 28, 1962
1. A new zoning classification R-A, prescribing 7200 sq. ft. zoning
lots, 60 ft. wide, with 5 ft. side yards.
2. A legal hardship can be determined because this is building
weather and failure to approve the variation would delay
the build~r~;.
Attorney Hofert pointed out that this variation is intended to serve as
a stop gap measure until the R-A classification goes into use and the
property can be re-classified.
Mr. Ruud then stated that he felt he had presented a complete case.
Mr. Martin disputed this.
