August 21, 1962 ~lla~e Plan Trustee Casterline read an ordinance amending the Official Village Plan and Particularly Article II, Subdivision Regulations Thereof. Trustee Casterline, seconded by Trustee Bruhl, moved that this ordinance be referred to ~he Plan CommisSion for study and recommendation. Ord. 858 Trustee Casterline, seconded by Trustee Phillips, moved for buildin~ the passage of Ord. 856. code AN ORDINANCE AMENDING MOUNT PROSPECT BUILDING CODE OF 1957 AS AMENDED Mr. Douglas Carneyt Building Superintendent, stated that the 1960 Boca Code which is used in this ordinance is being used all over the nation and in towns in our vicinity and that it is an up-to-date code. Upon roll call: Ayes: Bickley Bruhl Gaw Casterline Phillips Motion carried. building Mr. James Wax, Chairman of the Architectural Committee, reported that three apartment buildings will be built on the northeast corner of~Centrat~and Main instead of the five as previously planRed. They also'have plans for 72 efficiency one-bedroom apartments along the railroad tracks at Prospect Avenue and Mt. Prospect Road. There are 100 new apartments going up in our village at this time. He also congratulated the Randhurst building people on the way the lessees have come in and asked for permits having their plans and specifications well prepared. Trustee Bruhl, seconded by Trustee Bickley, moved for the Ord. 858 passage of Ord. #858: Street & Bridge tax levy AN ORDINANCE PROVIDING FOR THE LEVY OF AN ADDITIONAL TAX FOR STREET AND BRIDGE PURPOSES FOR THE FISCAL YEAR.COMMENCING MAY 1, 1962 AND ENDING APRIL 30, 1963 FOR THE VILLAGE OE MOUNT PROSPECT, COOK-COUNTY, ILLINOIS Upon roll call: Ayes: Bickley Bruhl Gaw Casterline Phillips Motion carried. Well #6 Trustee Phillips reported on a meeting with himself, David Creamer, Water Supt., James King, Village Treasurer, Richard Schlaack of J. P. Miller Artesian Well Company, and Arthur Lewis of Consoer, Townsend g Associates, and reviewed the possibility of rehabilitating Well #6. A copy of this ~Dport is enclosed with the minutes, together with a copy of letter from R. C. Schlaack of the J.~ P. Mi, ller Artesian Well Company. Trustee Phillips, seconded by TruStee B~ckley, moved that the proposal as presented by the Village engineers and as per specifications stated by the Artesian Well Company be accepted. August 21, 1962 Trustee Phillips read the following suggested Ordinance Water connection Revision: Charges SECTION 23.302 PARAGRAPHS 1 and 2 "Section 23.302. Charges - Connection Rental Maintenance. "The charge for connecting all water meters, including a flat rental and charge for ordinary maintenance and repair during the life thereof, shall he established hy the Village Superintendent of Water. "The charge for connecting a 2" or larger turbine, compound or line meter, including s flat rental, shall be established by the Village Superintendent of Water, and the cost and expense of necessary maintenance and repairs made hy the Village during the life. of the said meter shall be dharged to the consumer when incurred. (Amended hy Ord. #595 passed and approved 1-1~-58 and published in the Municipal Code 1-23-58)." Truste~ Phillips, seconded hy Trustee Bickley, moved to direct the Village Attorney to draft the necessary ordinance based on the Village Engineers recommendation. Trustee Phillips~stated that he had received Approval No. 570-1962 from th~ Department of Public Health: for the water main to the Thunderbird Bowling Alley, copy of which is on file. Trustee Phillips, seconded by Trustee Casterline, moved that the above approval he accepted. Motion carried by acclamation. Trustee Rhillips stated that he had received Approval No. $69-1962 ~ from the Department of Public Health for the North Side School,.copy of which is on file. Trustee Phillips, seconded by Trustee Bickley, moved that the above approval be accepted. This motion carried by acclamation, Trustee Bickley reported that our police had made the firet shop= police lifting arrest in Randhurst, and that three teenagers were caught painting the brick wall a~ Prospect High School. He reported that there would be a poliee meeting on Monday, Aug. 2~th at 8 o'clock to consider bids for new cars. Trustee Bickley referred to Manager Appleby's letter on street Hatlen sire et lights for Hatlen Heights stating that the Public Service Company recommended lights 19 lights and 2 on Central Road. Trustee Bickley, seconded by Trustee Bruhl, moved to accept Village Manager Appleby's recommendation on the street lights for Hatlen Heights and that he meet with the Public Service Company to determine the cos=. This motion carried by acclamation. Trustee Gaw stated that he had received a petition signed by all Maple Dri~ but two of the'people li~in~ on South Maple between Lonnquist and Golf Road to change the name of the street from Maple Street to Maple Drive and also to erect an entrance of lannon stone with lights thereon. Attorney Hofert s~ggested that the two people who were vacationing and didn't sign the petition.write a letter agreeing =o this. This matter was referred to Village Attorney Hofert, Trustee Gaw presented a proposed ordinance for the Board of Health Board of prepared by the present Board of Health. Copies of this proposed ordin- Health ance were given to all trustees for study. Res. 17-62 Truszee Gaw, seconded by Trustee Phillips, moved for the MFT passage of Res. 17-62, that the following streets be improved under the Motor Fue~ Tax Law. President Schlaver reported that the crowds at the opening Center of Randhurst Shopping Center were greater than anticipated. He complimented the Police and. Fire chiefs for their work at this opening. Weller Creek President Schlaver gave report on Weller Creek Drainage meeting, copies bf which were given to the t~ustees; the next meetinE to be held on August 29, 1962 in the Mount Prospect Village Hall. Village President Schlaver referred to report given to trustees prepared by Engineer Joseph Vavra~ Bernard R. Hemmeter and Richard S. Fountain, who comprise the committee appointed =o make recommendation for a Village Engineer. This report included job specifications of four candidates for the position. The President asked The board to meet with him on Tuesday, Aguust 28th, to consider this report. Colonial Trustee Bickley, seconded by Trustee Phillips, moved to Hts. 4th refer the plat of Colonial Heights, ~th Addition to the Plan commission. Add'n This m~tlon carried by acclamation. Trustee. Bruhl, seconded by Trustee Bickley, moved that the Elk RidKe plat for Elk Ridge Villa Unit #8 be referred to the Plan Commission. Villa #3 This motion carmied by acclamation2 Village Plan Attorney Hofert referred to $ proposed ordinance amending the R-A zoning official village plan and particularly Article II, Subdivision Regu- district lations thereof, and asked for authorization to' publish this tentative ordinance to establish a new zoninE district - R-A, which would make the minimum land area per dwellin~ unit 7200 sq. ft. with a width of 60 ft. per lot, and to change the R-1 Bulk requirements so that the lot area per dwelling would be 8,125 sq. ft. with a lot width of 65 ft. on inside lots and 75 ft. for corner lots. Trustee Bickley, seconded by Trustee Phillips, moved that authority he given to the clerk =o publish this tentative ordinance. Upon roll call: Ayes: Bickley Bruhl Casterline Gaw Phillips. Motion car~&ed. AuKust 21, 1962 Attorney Hofert reported the-filing of a lawsuit by a person Court Case - known as Nelson againstthe village. Said suit requires issuance of Nelson building permit to construct residence which would have separate quarters for mother-ln-law. It appeared that Mr. Nelson secured a building permit for a house which showed from the plan to have two separate units, one for the owner and one for another party; that the Building Department issued the permit onthe ground that this building was essentially a single family residence since the mother-ln-law was to occupy it. Subsequently the Building Department was alert to the possible danger that this building would be used as a rental type, whereupon the department issued a stop order; however, this did not occur until after the building was substantially erected. Mr. Hofert then stated that the attorney for the Nelsons agreed to a limited use of the building for the mother-in-law and agreed that covenant be drawn up so as to prevent its use for rental purposes outside of the family. Mr. Hofert recommended settlement and authority to consent to a court decree which would accomplish this. Trustee Bickley, seconded by Trustee Casterline, moved that authority be given the Village Attorney to enter into covenant decree. Upon roll call: Ayes: Bickley Bruhl Casterline Gaw Phillips. Motion carried. Trustee Phillips, seconded by Trustee Bickley, moYed that the Board hold a Special Meeting on Tuesday, August 28th, at 8:00 P.M. Motion carried by acclamation.
