President Schlaver called the meeting to order at 8:19 P.M.

Trustee Gaw reported that stub end of Lancaster Avenue which Vacation of
ends at the golf course lies between the properties of Ralph Adams and Lancaster S1
John Ostrem, who are willing to purchase and improve this piece of stub
property. He then read the following letters:

agreed to the vacation of a street requested by Ralph Adams in the
following action taken at our regular meeting, June 10, 1962:

at the regular Board Meeting of June 11~ 1962~ agreed
to the Vacation of Lancaster Avenue from Lincoln Street
south to the property line Of the Mt. Prospect Country
Club with the provision that the property owners,
R. Adams and J. Ostrem connect to the sewer and grade
to Lincoln Street at no cost to the Mt, Prospect Park
District.

Gentlemen:
The undersigned, Ralph E. Adams, as the owner of Lot 6,
and John W. Ostrem, as the owner of Lot 5, Northwest Country Club
Subdivision, whose lots are abutting that part of Lancaster Avenue
lying south of Lincoln Avenue, reqqest that the Village vacate said
Lancaster Avenue which adjoins said properties.
Each of us a~ree to pay the Village the sum of $1000 for
such vacation.
Ir'is our understanding that the Park District has no
objection to this vacation if the contour oft, our lots and the ease-
ment to be. vacated is not Changed to the detriment of the drainage
situation on their adjoining Mount Prospect Country Club property.
We agree that if the contour is changed, adequate drainage to the
e lstlng storm sewer Will be established to insure complete satis-
faction to all parties involved. As you know~ the primary reason for
this reqqest to vacate is.to correct the drainage situation that has
been most troublesome to the undersigned property owners, the Village
and the Country Club over the past two years since the drain tile to
Weller Creek has apparently become clogged.
Since this proposition has been under consideration for so;
long, we would appreciate your early action on this request so we
may take immediate steps to correct these problems.

Village auditors be authorized to do a special addit of the water system Water
as of July 31, 1962 as per the request of Chapman $ Cutler in reference audit
to water works expansion program of the Village.

Trustee Bruhl mentioned the garbage situation, giving reminder garbage
that all cuttings are to be tied for easy handling, and all trash and
grass clippings to be put into metal garbage cans. This is to live up
to the Village's side of the contract.

100 East Prospect, Zoning Case 62-13.
Zoning Case Trustee Ekren, seconded by Trustee Bickley, moved to concur
62-14 in the opinion of the Zoning Board of Appeals re. Case 62-14 to grant
B-3 zoning to the Standard Oil Company at their station at Main and
Foundry, and that the Village Attorney prepare the necessary ordinance
to effect this rezoning.

Zoning Case Trustee Ekren, seconded by Trustee Phillips~ moved to concur
62-15 in the opinion of the Zoning Board of Appeals re Case 62-15 to grant
Calta- B-3 zoning to Paul Caltagirone for his restaurant at 302 West Northwest
girone Highway, which is currently non-conforming use in I-1 zoning, and also
moved that the Village Attorney prepare the necessary ordinance.
Discussion followed. Trustee Bickley stated that the Board had arrived
at agreement with Mr. Caltagirone that there would be no drinking of
liquor at bar to be installed, that drinks will be served by waiters
at the tables only, for a period of one year.. Mr. Caltagirone, who was
accompanied by his attorney, arose and said that was correct~ that
he did agree to this.
Mr. and Mrs. Charles Kimball and Mr. Gilbert Liebenow protested allowing
this rezonlng. Trustees Casterline and Gaw indicated they were not in
favor of anything that would aid the use of this l~q~or license.

Mr. Myer Engler of Consoer, Townsend returned with his
recommendation for award of paving contract, 18-CS. Paving contract
18-CS
Trustee Gaw, seconded by Trustee Phillips, moved to accepz th&.recom-
mendation of the Village Engineer to award the contract to Allied Asphalt
Paving Company subject to submission from them of statement showing all
uncompleted contracts awarded them and all low bids pending, and subject
to approval of the State Highway Department.

Trustee Casterline left the meeting at 9:40 P.M.
Trustee Gaw, seconded by Trustee Ekren, moved that bid deposit
checks of the two low bidders he"retAined until approval of contract
by the State of Illinois, when they shall be returned, and that check
of high bidder be returned immediately. This motion carried by
acclamation.
President Schlaver read letter from Mayor Gibson of Elk Grove Elk Grove
Village giving thanks for our fire protection during their recent Village Fire
fireman's strike. Dept.

Village of Mount Prospect contract
Dear Sir: Re: Fire Protection Service Contract between Village
of Mount Prospect and Prospect Heights Rural Fire
Protection District
We wish to advise you that the Board of Trustees of the Prospect
Heights Rural Fire Protection District has entered into a contract with
the Prospect Heights Volunteer Firemens Association providing for the
resumption of fire fighting services by those volunteers in the District.
You will recall, no doubt,that during the negotiations with the
Board of Trustees of the Village, the Trustees urged that some permanent
arrangament be developed as soon as the District Trustees could con=
veniently do so in order to avoid encroaching upon the ability of the
Mt. Prospect Five Department to render service to its other contracting
parties, and this the District Trustees agreed todo.
It appearing now that the volunteers will resume operations in
Prospect Heights at 12:01 A.M. on Wednesday, Agusut l, 1962, we respect-
fully ask that your Board of Trustees permit our Board of Trustees to
caneel and terminate the contract presently in force between the Village
and the District, effective as of midnight, July 31, 1962.
We have enclosed herewith our check payable to the order of the
Village in the amount of $1,500, the same representing the pro rata portion
of the contract considemation for the first three months of the contract
year less the $1,000 which was advanced when the contract was executed.
It would be appreciated if you would communicate with us and
advise us of your position in this connection.

Fire Protection District be cancelled as of July 31, 1962.

A Attorney H~ofert re~rted on his trip to Springfield
Weller iu regard to Weller Creek drainage with engineer, Mr. Reh.
Creek The State indicated their permit to Arlington Heights for
drainage connection did not imply approval but that the interests
of the State were satisfied. Mr. Rah gavecopinion that if there
is another 2 o 5 year rain the flooding will be even greater in
areas already affected, tha maximum ef6ected to be felt in
Des Plalnes at the Golf Road bridge. Meeting was then set up
with representatives of Arlington Heights, their attorney, Jack
Siegal, representatives of Des Plaines and their attorney;
President Schlaver, and Messrs, Appleby, Hofert and Reh. Everyone
indicated willingness to come to amicable agreement on drainage.
Another meeting was set up for this coming Tuesday, with represen-
tatives from the Metropolitan Sanitary Commission. The idea of a
retention pond will be explored, and possible appointment with the
governor to ask for funds for~ the First Stage of Relief. These
funds were appropriated but frozen for use. We will try for
(1) an interim solution to the flooding (2) release of frozen funds,
and (3) to seek appropriation of new funds to carry out other
Relief Stages 2, 3, 4 and 5, which go successively up the stream.
We shall try to achieve amicable settlement because this problem
is manifest to s~veral communities.
MFT Trustee Bruhl, seconded by Trustee Ekren, moved to file
Audit audit report received from the Division of Highways covering receipt
and disbursement of Motor Fuel Tax funds for January l, 1980 and
ending December 91, 1961, NOs. 17 and 18. This motion carried by
acclamation.
Weller Mrs. Broadbent arose and asked if any official reports
Creek had been received from the Board of Health re contamination in
Weller Creek. Mr. Appleby replied that the Sanitary District and
the Cook County Board of Health had been notified of this condition
and were asked for bacteriological reports. No reply had been
received fro~ the Board of Health, but reply was received from the
Sanitary District stating that they were watching the gates
upstream closely To see that they remained closed.
Adjournment was by acclamation at 10:05 P.M.
