Trustee Phillips read aloud the contents of contract drawn up Fire between the Village of Mount Prospect and Prospect Heights Rural Fire Prosp Protection District, wherein the Village Fire Department will furnish protection tc Prospect Heights for a year, Trustee Phillips, seconded by Trustee Bickley, moved that ~is contract be approved by the Village Board and that the President a~ Clerk be asked to sign same. Trustee Ekren, seconded by Trnstee Bruhl, moved for adoption of Res. #7-82: Res, 7-82 A RESOL~TION REQUESTING T~E C0~PERATION OF THE VILLAGE OF ARLINGT(N HEIGHTS IN THE FLOOD CONTROL OF WELT.~R CREEK Upon roll call: Ayes: Bickley Caw Casterline Ekren Br~hl Phillips Mo%inn carried. President Schlaver read letter from Wm. F. Wilson, 717 Cathy Lane Cathy Lane asking that Cathy Lane from Busse %o Central Road be made a dedicated street. This matter was turned over to the Judiciary Committee. Trustee Ekren stated that it was the consensus of the Board that it was desirable to annex territory south of Golf Road as far as the Annexation Toll Road; that the Board was agreeable to allowing certain concessions approx. B25 to be made that this might be accomplished. He then read the following acres in tentative agreement which when entered upon will be signed by Mr. Sal Elk Grove T~ di Mucci and the Village: 1. Lot sizes are 80 x 120. 2.The streets are 28 feet wide, the. main thoroughfares are B2,foot streets, with 80 foot dedication. B. The plat that you present for zoning will include: single family dwelling, apartments, and commercial 4.T~o liquor license~commitments will be given you, f~om the Village of Mount Prospect. 5. The application for building permit will eliminate the portion, "No error or omission in either plans or application, whether said plans or appli- cation has been approved by the Building Committee or not shall permit or relieve the applicant from constructing the work in any other manner than that provided for in all the ordinances of the Village of Nount Prospect relating thereto." In addition, the robber stamp, "authorization to replace or repair damage, etc.~ will be omitted. 8. The Village of Mount Prospect will have the option to purchase the Utility Sewer & Water Co., five years from the dat~ of annexation, at the rate of $800 per metered cus~tomer or $$50 per water customer and $250 per sewer customer. '~hen the Village makes this said p~rchase, they will assume all liability and responsibility, if any, of a contract existing between Citizens Utility Co. and Utility Sewer & Water Go. The Village will also buy water from Utility Sewer & Water Co., if they need it at a point of interconnection, for ten cents mark-up per' 1000 gallon water above Utility Sewer & Water Co. cost. The Village will connect to your lines. The boundary shown on the Utility Co.'s Plat Service Area shall be respected at all times. Y. A cash bond will not be required. 8. Building permit fees will be the actual cost of the building construction. 9. The Village will accept a performance bond for public improvements. The contractors will provide this bond to you and you i~turn will give this bond and your personal letter of guarantee for the work. 10. Fire hydrant rentals. The Village will maintain, repair and replace May 22, lg82 hydrants, if and whenever necessary, and will pay a $10- cash rental for wa%er usage. 11. You will present your plat for annexation and your Utility Sewer and Water plat. This shows yourU~ility territory. 12. If you have any building permits from the County, we will honor them. 13. Upo~ ~completion of the annexation and the recording of the plat, the Village w~ll issue you as many building permits as you toque.ire.. 14. The Village guarantees there will be no extra c~arges, other than: Building permit, Builders License and Engineering hourly expense fees. 15. You will conform %o the 1960 National Building C:ode. 16. Spot Survey - - a deviation up to 10" will be permitted bef.ore variation. 17. Sidewalks will bi 4' width, 4" depth. 18. Minimu~ side yard requirement will be 5'. 19. The builder will determine which side for a garage and driveway. 20, Gutters .shall be eliminated from ~he ~ordinance. 21. UnsAtiSfactory work. Inspectors shall give at least 10 working, days notice in writing of the specific violation for correction before issuing a stop work order. 22. The Village of Mount Prospect shall inspect streets,curbs or sidewalks with their own engineer. The fee is to be $10- per hour for actual time spent inspecting the Job. There shall be no other charges. The Village ,Till eliminate the 1% ,charge er any other charge that ~ay be in the By-Laws or Ordinances. 23.. At the time the permit is issued, the Builder shall pay. $20 for~ trees ~er house, and the installation-will be made by the Village. 24. ~he Village will gr~ant, a 25-year franchise, if. necessary, to your Utility C om~ar~. Attorney Hofert explained that Mr. Di Mucci has had the opportunity~ to annex these properties to either Des Plaines or Arlington. Heights, or to leave in the County under the same ter~ but' because he is a resident of Nount Prospect desired that this territory~ be made a part. of }~oumt Prospect. . .. Trustee Ekren, seconded by Trustee Bickley, then moved that the af~re- maid agreement be approved as a condition of properties hereinbefore mentioned. May 22~ 1962 Trustee Ek~en brought up claim from Chester Busse wherein he Car Wash - stated he was allowed to erect a car wash on East' Prospect by the Chester Busse Board in June of 1969 (see minutes) and desires to pick up his building permit. Attorney Hofert pointed out that the property is presently zoned I-l, under which classification there is no car wash; however, the previous Board had voted to allow Mr. Busse the car wash and there was subsequent action cf a variati on. Mr. Franzen, attorney for Chester Bnsse, stated that his client would like to keep the I-1 classification rather than request B-3 be=ause it might allow ~reater latitude at a later date. Trustee Bickley stated that he had questioned the Southeast Civic Association about his business because they had entered objections in a prevTeus hearing, but had now withdrawn because of apartment b~ffer zone and intended installation of sidewalk along Prospect Avenue. After more discussion, Trnstee Phillips, seconded by Trustee Casterline, moved '~hat the Building Depa~'tment be instructed to issue' permit~ for car wash facilities ~o Chester Busse if the building me,ts the building code; and to direct the Village Attorney to take steps necessary to set up a car wash (or auto laundry) as a special use in the I-1 District. Trustee Ekren read the following letter Of May 1 from the Plan Green Acres Co~aission: Sub 'The Plan Comissiun to who~ was referred the plat of Green Acres Subdivision Unit #1 recommends the approval of the plat subject to dedication of land for public use and all Village ordinances. Schlaver: This letter will confirm our conversation relative to the allocation to the Park District of some of the Lots in Unit 3 of Green Acres Subdivision. Considering the number of homes that will be developed in this area during the next three years, it is important that a playground area be set aside for the children living close'by. It is our intent to give this property to the Village of Mount Prospect for this purpose. The tentative plat for the SchvaIJe & Knuth property adjoining Green Acres to the west is ready at this time,' While they made a cash contribution to the Park District when starting their Sunset Ridge Development, per. haps they would allocate some of their lots adjoining Unit 3 so that the property given by Green Acres and them WOUld be contiguous. Trustee Ekren read the following document from the Park~ District: Park District MOUNT PROSPECT PARK DISTRICT vacation of streets LI~NS MEMORIAL PARK in park on May 1§, 1982 Northwest ~e the President and side Beard of Trustees of the Village ef Mount Prospect ~ ~PE T I T I ON: Whereas, the Mount Prospect Park-District has acquired for~use for park pmrposes certain property within the Village of Mount ~Pros~pect, which property is now known as the Northwest-side Park, and through which park are certain public roadways dedicated for public usage known as Evanston Avenue and Rammer Avenue, both af which streets are approxi- mately BgB feet more or less from Isabella Street to Gregory Street and Davisson Avenue, which extends south approximately 486.88 feet on the~ east side from the south side of Gregory Street, and Whereas, the Mount Prospect Park District is constructing a swimming pool on the said park property and it is in the public interest and will promote the public safety of the residents of the village if May 22, 1962 the public streets are vacated in accordance with the plans indicated on the attached plat of vacation, The President and Board of Commissioners petition the President and Board of Trustees of the Village of Mount Prospect to pass an ordi- nance to vacate the streets i~dicated on the attached plat of vacation.
