Trustee Phillips, seconded by Trustee Bickley, moved that Trustee Pres.pro Ekren act as President Pro Tem. This motion carried by accl~m~tion, tom Trustee Casterline, seconded by Trustee Phillips, moved for approval as submitted of the minutes of March 7, 1962. Trustee Casterline, seconded by Trustee Bickley, moved for approval of the hills as of March 13th as follows~ General $ 2,392.80 bills Garbage 6,582. ~6 Parking System Revenue 383 · 50 Water, operation 1,705.37 $11,064.13 Upon roll call: Aves Absent Bickley Casterline Gaw ' Ekren Phillips Bruhl Motion carried. Trustee Bruhl arrived at 8:20 P.M. Trustee Casterline of the Building Committee gave recommendation that Jerry's Restauran~ on Rand Road be allowed to erect sign (described signs in minutes of March 7) inasmuch as permit had been requested and Sign ordered some weeks before passage of the Sign Ordinance. Trustee Casterline, seconded by Trustee Bruhl, moved that approval be granted for variation To allow erection of sign as applied for by Jerry's Restaurant on Rand Road. March 2~, 1962 ,469 Trustee Ekren read the following memo: To: Judiciary Committee - Trustees Ekren, Bickley, Phillips Zoning From: Harold Appleby, Village ~ager Ord. In his letter of February 21st Attorney Hofert quoted a section from the Zoning Ordinance as follows: "Front Yard: There shall be a front yard having a depth of not less than twenty-five (25) feet, except where forty (40) percent or more of the frontage on one side of the street is improved ~-~ with buildings that have observed a front yard line having a variation in depth of not more than twenty-five (25) feet, in which case no building shall project beyond the average front yard so established." Mr. Hofert commented: "I do not believe that the regmaltion cited in the 'Zoning Code of Mo~mt Prospect is a proper or legal provision, since the front yard may in many cases have to be established by averaging the front yards of other properties not directly in question. In a case that I have handled and in my legal research conducted thereto, I found the Courts have indicated that such a provision is not a legal provision because it requires a man to determine his setback by going on t~ethe properties of others, which may therefore promote unlawful trespass." Perhaps it would be well to have the section "Front Yard: There shall be a front yard having a depth of not less than 25 feet". If variations from such a set-back were desired, applicants could apply to the Board of Appeals for variations. Harold Appleby Tz~tee Bickley, seconded by Trustee Phillips, moved that the Village Attorney be requested toprepare a tentative ordinance, that this tentative ordinance be published, and that hearing be held before theZoning Board of Appeals regard to change in Front Yard requirements. Upon roll call: Ayes: Bickley Bruhl Ekren Phillips Casterline Absent: Gaw Motion Carried. Trustee Ekren reported that required street sig~s in Funk's trees Mount Prospect Gardens had been installed by the Village, and mentioned Funk's Mt. that the planting of trees yet remained to be done. Prospect Gardeus Trustee Bickley, seconded by Trustee Bruhl, moved that the Village Manager secure prices to plant trees in the Fus~k,s Mount Prospect Gardens area as per plat shown. NanagerAppleby read the following letter from the Chicago Federmtion of Aged and Adult Charities: Charities March 7, 1962 Dear Mr. Appleby: As customary our Federation is now making prepararions for the Annual Tag D~y solicitations. The day and date selected for the year 1962 is Tuesday, May 8th. We earnestly solicit your permission to tag within the jurisdictional limits of the Village of Mount Prospect~ on the last date mentioned, for this worthy cause. March ~N, 1962 It would be most kind of you to advise us prior to March 17th, as our Federation committee meets on March 19th, and the undersigned would be in a position to inform them at that time. Charities Cordially yours, tag day Margaret Frey, Location Secretary Trustee Casterline, seconded by Trustee Bruhl, moved that the above organization be informed that the Village is agreeable to their plans for a tag daY and that the Village Manager so inform them that ~aesday, May 8th be-allowed. Manager Appleby reported that footing of the bridge across Weller Weller Creek at Emerson has been Undercut by flood waters and will need repair; Creek he will discuss this matter further with the Street Committee and try to Bridge find out who may be responsible for these repairs. Question of installation of sidewalks on Pine Street between sidewalks Central Road and Northwest Highway was referred to the Street Committee. Pine St. The matter of lease from Chicago & Northwesteru Railway and for bus shelter at Emerson and Northwest Highway was referred to the bus shelter Public Building & GroUnds Commlttee. This bus shelter was erected by the Women's Club and given to the Village. Plat of Colonial Heights Second Addition Subdivision (outside Colonial Hts Village) was referred to the ~lan Commission for study regarding change Sub in lots. Trustee Casterline read the following memo: Signs in To Bldg. Committee from Village Manager March 7, 1962 Golf Club Sub Section B of Section 9.505, MUnicipal Code (Sign Ordinance) Districts reads as follows: "Signs in Golf Club Districts. 1. In Golf Club Districts, only ene (1) sign may be erected on the property used as a golf course, which sign shall not exceed 128 square feet in surface area, and shall not exceed fifteen (15) feet in height with a clearance of four (4) feet from the ground to the bottom of the sign. 2. Signs shall be set back fifty (50) feet from the lot line. 5. Advertising signs shall not be erected in Golf Districts." The following is quoted from a memorandum from Mr. Payne to the Mount Prospect Park Board of Commissioners. M~rch lB, 1982 52 signs "I advised Mr, Schlaverand ~r. Hofert that the park board had directed me to ask that the new sign ordinance be amended so that we might erect a rustic type sign at the Mt. Prospect Country Club about two feet off the ground rather than four, and with a setback of only 25 feet from the lotline, since we are planning a sign about three feet by five feet rather than the 128 square foot limitation provided by the ordinance. I was assured that the ordinance in stating "only one sign may be erected on property used as a golf course" did not mean that we could not erect directional signs such as "Parking Lot", "Director's Office", "Pro Shop", "Restaurant". Trustee Casterline, seconded by Trustee Bruhl, moved that the Village Attorney be requested ~o prepare amendment to the Sign Ordinance providing for the indicated request from the Park District.
