Trustee Gaw, seconded by Trustee Casterline, moved for approval of bills as follows: General $22,016.26 bills Library 1,769.28 Library Bldg. Construc tion 6,390.02 Water operations 1,958.11 $32,133.67 Upon roll call: Ayes: Biokley Ekren Gaw Oasterline Phillips Absent: Bruhl Motion carried. Trustee Ekren, seconded by Trustee Bickley, moved that Attorney Dog Hofert, with the aid of Prosecuting Attorney Crooks, submit draft of new Ord. dog licensing ordinance for study by the Board. Upon roll call: Ayes: Bickley Ekren Gaw Casterline Phillips Absent: Bruhl Motion carried. Trustee Gaw, seconded by Trustee Casterline, moved for approval Financial of the Financial Report for January from the Treasurer's Office and that ,Report it be placed on filed. This motion carried by acclamation. Trustee Bickley read the following letter dated February 15, 1962, from Elk Grove Village: Police Dept George Whittenberg, Chief of Police Mount Prospect, Illinois Dear Chief Wbittenberg: Thank you very much for coming to our assistance last Friday evening. It was important that the Board of Trustees and I meet with our entire Police Department. However, this would not have been possible without your gener~s co-operation. You and your men, by manning posts for us, protected the Village and enabled us to conduct a meeting which we are sure will result in a better Police Department in Elk Grove Village. Please do not hesitate to call upon Elk Grove when we can be of assistance to you, so we can in part repay your generous co-operation. Yours truly, James R. Gibson, President Elk Grove Village February 20, 1962 442 County Zoning Village Manager Appleby referred to County Zoning Board Docket #307, request for reduction in minimum lot area in Wheeling Township. The Board decided to take no action on this as it was barely within the 1½-mile limit. Mr. Appleby also referred to County Zoning Case, Docket #306, request for side yard variation on 250 lots in Elk Grove Township, 82 acres bounded on the west by Busse Road, on the North in part by Willow Lane, on the East by Linneman Road and on the South by Common- wealth Edison Company right of way. This was referred to the Judiciary Committee. Hearing is to take place in the County Building on February 28th at lO:BO A.M. Lombardo suit Trustee Phillips, seconded by Trustee Biokley, moved that the :62-C-2280 Village Attorney represent the Village in suit of Michele and Ermelinda Lombardo, 108 East Northwest Highway vs Village of Mount Prospect et al, Case #62-C-2280. Upon roll call: Ayes: Bickley Gaw Ekren Casterline Phillips Absent: Bruhl Motion carried. Randhurst President Schlaver announced that the Randhurst Shopping Center was having a dome-laying ceremony at 11:00 A.M. to B:O0 P.M. on March 1 and would like interested officials to attend. Subdivision Attorney Hofert sppke of the suit by Glenviewand Park R.idge plats and Park Forest against ruling of the County Attorney, wherein consent 1½-mi. limit of Villages within 1½ miles is no longer required for approval of sub- rule division plats. The Board indicated it would support this suit in any way it could. President Schlaver read the following letter from the Northwest Homeowners League: Northwest Homeowners February 15, 1982 League President and Board of Trustees Mount Prospect, Illinois Gentlemen: This is to advise you that the new Chairman of our Council Committee and therefore the official representative of the Northwest Home Owners League, to the meetings of the Mount Prospect Village Board of Trustees, is G. Michael Mokate. Mr. Mokate replaces Jack McHugh, who found it nemessary to resign this post due to business pressures. Mr. Mokate heads a committee, members of which will work closely together in order to give us efficient and topnotch liason with the Village Board. Very truly yours, Joe Moore President Sohlaver read the following letter from Peterson & Wengerhoff, Architects: Village Hall Addition ~February 20, 1962 Village of Mount Prospect Mount Prospect~ Illinois Gentlemen: Re: Municipal Buildin~ Addition & Alterations An inspection of the above captioned buildin~was conducted on Monday, February 19, 1962. The purpose of this inspection was to deter- mine the amount of work still remaining to be completed or corrected in accordance with our check lists of December 29, 1961 and January 24, 1962. This latest inspection showed that the following items still remain uric ompleted: February 20, 1962 443 1. Install access panel in Police' Garage ceiling. Village Hall 2. Repair gas leak in Boiler Room. Addition 3~ Correct installation of radiation covers in Village Manager' s office. 4. Check temperature ~control of unit heater at Fire Department entrance. 5. Install grille at Hose Tower heating unit. 6. Install protective hood over intake louver to Police Department air handling unit. With the exception of these few items, the work has been satis- factorily completed in accordance with the plans and specifications. The normal one-year guarantee and warranty covering equipment and installation will normally take care of the relatively minor adjustments in temperature control which are usual during the initial .months of operation of a system of this nature. Therefore, in view of the minor nature of the items still to be completed, it is our recommendation to the Village that Custer Construction Company be paid the monies due~ them under their contract, subject to payment of sub-contractors and receipt' of waivers of lien. Wengerhoff Attorney Hofert recommended that payment be made to certain subcontractors having no involvement whatever with Suit by Lombardo, to be paid direct from the Village Treasurer, and any subcontractors involved in the suit to have payment withheld until outcome is decided. Mr. Hofert asked for letter from Custer Construction 0o. agreeing to this. The following includes the contractor and sub-contractors involved in the suit: $2,596.01 - Custer Construction Co. 107.80 - Ted Sirek Excavating 818.00 Lundsberg Co. 1,850.00 - Ceisal & McGuire $5,371.81 Mr. George Hitchcock, President of Custer Construction, demurred, stating that theabove subcontractors have nothing to do with the suit, and that the insurance com~n~ is obligated to take care of eve~ybhing. Mr. Hofert replied, "The Home Insurance Company has not indicated anything which wo~ld lead me to believe that they would assume responsibility at this time. Are you will to have the subcontractors other than the ones named above paid direct?" Mr. Hofert then explained that direct payment would forestall liens against the Village for this work. Mr. Hitchcock felt that too much importance was paid to the impending Lombardo suit, that the actual amount cf damage was not over $200 and that the insurance company would take care of everything. Mr. Appleby raised the point of payment to National Heat & Power, stating that the air conditiGning system had not been checked out at all. Mr. Kahn of that company replied that it was not feasible to turn it on until the weather warms up, that the system is guaranteed for a year, and that adjust- ments will be made after it is turned on, as has been done with the heating system. Trustee Ekren, seconded by Trustee Bickley, moved that the Village of Mount ProsPect pay subcontractors listed herein direct as stated in Attorney Hofert's recommendation, and that amount of $5,371.81 be withheld, payment of this to be discussed at a future date.
