Full ET:37,--L- -_,-- 75_, 0 MINUTES DLall'CS [. 1 " ` ('c CLOSED SESSION SEPTEMBER 20, 2005 The Closed Session began at 8:54 p.m. in the Village Hall Executive Conference Room, 50 South Emerson Street, by Mayor Pro Tem Paul Hoefert. The purpose of the Closed Session was to discuss Litigation and Personnel. Present were: Trustees Timothy Corcoran, John Korn, Richard Lohrstorfer, Michaele Skowron, and Michael Zadel. Absent from the Closed Session was Mayor Irvana Wilks. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl and Village Attorney Buzz Hill. Litigation Pag Primeco Lawsuit ‘„h Village Manager Janonis provided the Board with information regarding the settlement offer concerning Primeco and the Infrastructure Maintenance Fund (IMF). The wireless providers brought Q suit claiming the IMF was unconstitutional because the wireless providers do not use the right -of- way. The Illinois Supreme Court agreed and the wireless providers suited to recover the funds f already collected by the municipalities. Q a Consensus of the Village Board was to accept the settlement offer in the amount of $266,473.20, Mitroff Lawsuit 2. Village Attorney Hill provided his assessment regarding the proceedings related to this filing and the three claims that are being brought forward in the suit. -? Consensus of the Village Board was to consider further discussion with the complainant regarding options. ` j l, L° Resident John Friis, One North Lancaster Village Manager Janonis wanted to bring the Board up to date on existing property maintenance n issues and complaints at this address and the fact that a long -form complaint would be filed for 1 Housing Court on October 20. e Village Attorney Hill left the meeting at 9:52 p.m. u • 1 2 ii— a Personnel <r w ell Ti age anager anonis stated that he wanted to ask the Village Board if they were comfortable ,C with some anticipatory hires to get the Traffic Unit started based on the availability of quality d g i,,,_ i individuals that are currently available on the eligibility list before they are hired by another agency. Consensus of the Village Board was to move forward with the anticipatory hires. Adjournment There being no further discussion, the Closed Session adjourned at 10:03 p.m. and moved into open session at 10:04 p.m. and there was no further business.
