MINUTES OF A REGULAR MEETING
OF THE PRESIDENT AND BOARD OF
TRUSTEES I ELD IN THE MUNI CI1JL
BUILDING, MOUNT 'PROSPECT, ILLINOIS
ON TUESDAY, DECEMBER 4, 1951
The meting was called to order by kresident
Pendleton at 8:05 P.M. end the Clerk was then directed
to call the roll.
On roll call the following Trustees answered
"Present ": Bayne, Brown, Ibbotson, Lams, Lange, and
Viger. Absent: None.
The Clerk then read the minutes of the meeting of
November 13th. A motion was made by Trustee Brown,
seconded by Lange, that the minutes be approved as
read. The President put the question and the Clerk
called the roll with the following response: Ayes: A11;
Nays: None. Thereupon the President declared the
motion carried.
The following letter addressed to the Presi-
dent end Board of Trustees from William W. Townsend
of Consoer, Townsend & Associates under date of
December 3rd, 1951 was then read:

Gentlemen:
We submit herewith four (4) copies each of Long
Range Plan and One Year Construction Program,
December 4, 1951
resolution for adoption of the plans and resolu- 269
tion for request for funds.
All four (4) copies of the plans should be sent
immediately after adoption to J.P. Tuthill, District
Engineer of the Illinois Division of Highways
Three (3) copies each of resolution adopting the
plans and resolution requesting funds should accompany
the plans. The remaining copy of each resolution
should be retained for your files.
In your letter of transmittal, please state that one(1)
approved copy of the plan be returned to the Village
Engineer, giving our name and address.
Should any question arise, please call the writer
at any time.

Resolution No. 16 -51, a "Resolution regarding
Long Range Plan and One Year Construction Program for
Improvement of certain streets within the Village" was
then read. Ii motion was made by Trustee Lange, seconded
by Lams, that the resolution be adopted. The President
put the question and the Clerk called the roll with the
following response: Ayes: All; Nays: None. Thereupon
--- the President declared the motion carried and said
Resolution adopted.
The Clerk then read Resolution No. 17 -51,
appropriating 4175 from Motor Alel Tax Funds to pay for
Engineering Costs on Plans preparation for Long Range
Plan and One Year Program on Street Improvement. The
Motion was made by Trustee Bayne, seconded by Brown,
that the resolution be adopted. The President put the
question and the Clerk called the roll with the following
results: Ayes: All; Nays: None. Thereupon the President
.r_ declared the motion carried and said resolution adopted.
A motion was then made by Trustee Brown,seconded
by Ibbotson,- to authorize the Public service of Northern
Illinois to install a street light at Fairview Ave. and
Henry atreet. The motion was voted upon by acclamation,
whereupon the President declared the motion carried.
The Clerk then read the following from Consoer,
Townsend & Associates addressed to the President and Board
of Trustees under date of November 5, 1951:

Gentlemen:
We present herewith two (2) copies of Partial Payment
Estimate No. 1 in the amount of Four Thousand One
Hundred Eight -rive Dollars 04,185.00) in favor of
H -H Electric Company for work performed to date on
subject improvement and recommend that it be raid.

A motion was then made by Trustee Lams, seconded
by Lange, to authorize payment as recommended by Consoer,
Townsend & Associates for work performed to date by
H.H. Electric Company. The President put the question
and the Clerk called the roll with the following response:
Ayes: All; Nays: None. Thereupon the President declared
the notion carried.
December 4, 1951
2 1 0 A motion was then made by Trustee Lams, seconded
by Lange, to authorize the payment of 410.00 to the
Illinois Municipal League to help defray expenses of
a test case of a Social Security Enabling Act. The
President put the question and the Clerk called the roll
with the following results: Ayes: All; Nays: None.
Thereupon the President declared the motion carried.
The Clerk then read Ordinance No. 352,
entitled "AN ORDINANCE TO ESTABLISH A TAX RATE FOR THE
GARBAGE FUND FOR THE VILLAGE OF MOUNT PROSPECT", . A
motion was made by Trustee Bayne, seconded by Viger,
that the ordinance be passed. The President put the
Question and the Clerk called the roll with the follow-
ing results: Ayes: All; Nays: None. Thereupon the Poi
President declared the motion carried and said ordinance
passed and approved.,.
The Clerk then read Ordinance No. 353
entitled "AN ORDINANCE TO ESTABLISH A TAX RATE FOR THE
LIBRARY FUND FOR THE VILLAGE OF MOUNT PROSPECT." The
motion was made by Trustee Bayne, seconded by Viger,
that the ordinance be passed. The Eresident put the
question and the Clerk called the roll with the follow-
ing response: yea: All; Nays: None. Thereupon the
/President declared the motion carried and said ordinance
passed and approved.
The Clerk then read Ordinance No. 354,
entitled "AN ORDINANCE TO ESTABLISH A PLAYGROUND AND
RECREATION CENTER FUND FOR THE VILLAGE OF MOUNT
PROSPECT." A motion was made by Trustee Bayne, seconded
by Viger, that the ordinance be pas:ed. The President
put the question and the Clerk called the roll with
the following results: Ayes: All; Nays: None. There-
upon the President declared the motion carried and
said Ordinance passed and approved.
The Clerk then read Ordinance No. 355
entitled "AN ORDINANCE TO ESTABLISH A TAX RATE FOR THE
POLICE PENSION FUND FOR THE VILLAGE OF MOUNT PROSPECT."
A motion was then made by Trustee Bayne, seconded by
Viger that the Ordinance be passed. The President
put the question and the Clerk called the roll with
the following results: Ayes: All; Nays: None. Thereupon
the President declared the motion carried and said
Ordinance passed and approved.
The Clerk then read ordinance No. 356,
entitled "AN ORDINANCE TO ESTABLISH A PUBLIC BENEFIT
FUND FOR THE VILLAGE OF MOUNT PROSPECT." A motion was
made by Trustee Bayne, seconded by Viger, that the
Ordinance be passed. The President put the question
and the Clerk called the roll with the following
results: Ayes: All.; Nays: None. Thereupon the Presi-
dent declared the motion carried and said ordinance
passed and approved.
The Clerk then read Ordinance No. 357
entitled "AN ORDINANCE TO ESTABLISH A TAX RATE FOR THE
GENERAL CORPORATE FUND FOR TIM VILLAGE OF MOUNT PROSPECT."
The motion was made by Trustee Bayne, seconded by Viger,
that the ordinance be passed. The President put the
question and the Clerk called the roll with the following
response: Ayes: All; Nays: None. Thereupon the President
declared the motion carried and said ordinance passed
and approved. .
The Clerk then read Ordinance No. 358,
entitled, "AN ORDINANCE TO ESTABLISH A TAX RATE FOR THE
ROAD AND BRIDGE FUND FOR THE VILLAGE OF MOUNT PROSPECT."
The motion was made by Trustee Bayne, seconded by Viger,
that the ordinance be passed. The President put the
question and the Clerk called the roll with the following
response: Ayes: All; Nays: None. Thereupon the President
declared the motion carried and said ordinance passed
and approved.

A motion was then made by Trustee Lams, 2?"
seconded by Bayne, to distribute free auto vehicle
stickers to Village Board Members, Village Employees and
Members of the Fire Department, as in former years. The
motion was voted upon by acclamation, whereupon the
President declared the motion carried.
The meeting was recessed at 9:70 P.M.
The meeting was reconvened at 10:30 P.M.
The Clerk then read SUMMONS 51 Circuit
Court of Cook County.
A motion was made by Trustee Lams, seconded
by Lange, to authorize the Village Attorney to rile an
appearance and answer on behalf of the Village on or
before December 17, 1951. The 'resident put the question
and the Clerk called the roll with the following results:
Ayes: All ; Nays: None. Thereupon the President declared
the motion carried.
A motion was then made by Trustee Bayne,
seconded by Brown, that the -Board of Trustees concur in
the recommendations of the honing Commission, and that
the Village Attorney be instructed to draw up the necessary
ordinance, to allow rezoning from Residential to Business
the following properties:
U. Lots 17, 14, and 15 in Morningside Gardens Sub -
division. Lots 10 and 11 in the resubdivision of
Lot 7 in Block 21, Busse's pastern Addition
Subdivision.
The President put the question and the Clerk celled the
roll with the following results: Ayes: All; Nays; None.
Thereupon the President declared the motion carried.
The Clerk then read the following letter from
the Village Attorney, Mr. crank M. 0peka, under date of
November 14th, 1951:

Mr. Robert Bayne

Mount Prospect, Illinois
Dear Mr. Bayne:
I have checker the Atwood situation relating to
Block 7 in Randview Highlands and find that the
original plat which was recorded as Document o.
9365227 on August 7, 1926 and appearing in Book 270
of Plats at Page 46, shows a public alley 16 feet in
width in the rear of all of the lots facing Foundry
Road. The remainder of the subdivision showed only
an easement in the rear of the lots.
I have been unable to locate any vacation of this
public alley. Consequently, you are advised that a
public alley exists subject to the full jurisdiction
and control of the Village Board.
To make doubly Sure, it might he advisable to
cheek the Village records to see if there was any
vacation of said alley since 1926. The records in
the County Recorder's office do not show any such

There being no further business to come before
the meeting, a motion was made by Trustee Viper, seconded
by Lange, that the meeting be adjourned. The motion was
voted upon by acclamation, whereupon the President declared
the motion carried and meeting regularly adjourned.
