T~ustee Bergen read the following letter, dated March 20, 195g from Attorney Hofert to President Schiaver: Bar:mann case March 2~, 196~ ourt cases Dear President Schlaver: Re: Bartmann va Village of Mount Prospect Bartmann vs Village Case No. 63 S 31546 63 S 31546 On Friday, March 20, after two and one-half days of trial and the utilization of expert testimony of Eugene Baughman and Raymond Wright, we finished the trial of the above matter. Judge McKinlay indicated that the case had been well handled but felt that the Bartmanns were entitled to a per, mit. He felt conditions, however, should be placed on the issuance of same, said conditions to be as follows: (a) Complete fencing of the south, east and west portions of the property pretty much as Bartmann had proposed in his last offer. He fe~t that a gate secured by locks for maintenance purposes only was reasonable and should be allowed. (b) No loud speakers. (c) A limitation on the hours of the use of the light and provisions to prevent light spillage on adjoining properties, the exact nature of which he would discuss with Mr. McGuinn and myself at a conference. (d) Sewer hookup as a condition to.occupancy of the premises. It should be noted that all conditions mentioned above could have been securedby negotiation prior to:trial, but following my instructions, we proceeded to trial as directed. .I would recommend that the Building Depa~t-ment in the future not give out building permit cards to applicants but that the same be posted on the property by the Building Superintendent or his assis- tant. Once the building permit cards are issued the possibility of retracting acts becomes extremely limited. The result of this trial was expected and as the Village Board was made aware of prior to its commencement. Sincerely, Edward C. Hofert, Village Attorney Mr. Tom Wolfe of 610 N. Pine expressed interest in this case as his property was close to area involved. P~oblem of removal of model garages from Wille Lumber Co. Building property along Northwest Highway was referred to the Building Commit- tee. These buildings were slated to be removed as of last December. Trustee Bruhl, seconded by Trustee Ekren~ moved to accept Finance financial statement from James King re application of funds on the sale of the waterworks and sewerage fund bonds as of February 29, 1964 pending audit. This motion carried by acclamation. Trustee Ekren read the following letter from the Plan Com- Colonial Hts. mission: Ninth Addition March 10, 1964 Gentlemen: The Plan Commission recommends the approval of the plat of Colonial Heights 9th Addition which is attached hereto. N. Fletcher dated January 30, 195q and identified as Job No. 6q-8 as approved by this Board be granted subjectto compliance with all Village ordinances. Trustee Casterline explained that arrangements had been made with Elk Ridge Mr. Salvatore Di Mucci to plant %-mess in Elk Ridge Villa Subdivision~ Villa trees and Mr. Di Mucci had placed money in escrow to cover the cost~ also that The Village will replace 6q diseased Trees about the Village. Trustee Casterline, seconded by Trustee Ekren, moved that the Village Manage~ be authorized to shop upon behatf~of the Village, and to contract for the subject parkway trees. Swanson, Architect: Building on Pine Street 20 March 1964~ Dear Mr. Appleby: Re: PUblic Works Building Space Review This letter is in response to the direction of the Board of Trustees '- at their meeting of February 25, 1964. At that meeting I was di- rected to recommend to the Village the best possible utilization of the building space provided for by the present plan. I have reviewed the plans with Mr. Memmeter and we discussed items for consideration. The basic present plan is composed of two areas. The first area is an open one-level space that will be able to function in a flexible manner to solve future requirements. ~The second area is an office, repair, storage and~employee space. This area is in two levels and compact along one wall. This compact area should function well for our intended use. The basic idea of a compact utility area combined with an open area will make the over-all space usable in a full and flexible mannem. Sincerely, Robert C. Swanson Trustee Casterline, seconded by Trustee Busse, moved that the plans for the Village of Mount Prospect Public Works Building be approved and public notice for bids be placed listing April 21 at 8:00 P.M. as the time of bid opening. Trustee Casterline explained that Mike Worley, student at Streets Princeton, who lives on We Go Trail, asked permission to paint home numbers on curbs, as has been done previously by students. The Board indicated that they were favorable to allowing this enterprise, that this should be done under the supervision of the Village Manager. Mr. Appleby explained that the area upon which rests the Zoning Watem Department and future Public Works Building is at present zoned iCase 64-I~ I-l, which is a non-conforming use as far as municipal buildings are ~ concerned. Trustee Ekren, seconded by Trustee Busse, moved that property belong- lng to the Village on Pine Street between Central Road and N6rthwest Highway be appealed for rezoning to B-2 to the Zoning Board and that notice of such appeal be published as required by law. This motion carried by acclamation. iVilla~e Trustee Casterline, seconded by Trustee Ekren, moved to ad- !insurance vertise bids as of April 2nd for insurance needs, to be ready at the Board meeting of April 21, with recom~endations returned to the Board for their April 28 meeting. March 24, 1964 Trustee Ekren, seconded by T~ustee Busse, moved to approve Street light~ expenditure for electricity to allow the erection of a 20,500 lumen mercury vapor light on apprqximately every second po14 from Elm Street east along Northwest Highway to Mount Prospect Road, as per suggestion of Public Service Company. Upon ~oll call: Ayes: Bergen Busse B~uhl Casterline Ekren Absent: Phillips Motion carried. This will increase the Village's light bill by about $109 per month. Village Manager Appleby informed the Board that an extension Utility of time until April 17 at 2:00 P.M. has been granted by I.C.C. on the rate case hearing of the Utility Sewer & Water Company rate case. This matter was referred To' the Water Committee. Trustee Bruhl, seconded by Trustee Ekren, moved to approve expenditure to send Mr. Eugene Martin to The 30th annual National Zoning Planning Conference to be held in Boston April 5-9. President Schlaver made the following proclamation: President ~ Schlaver WHEREAS the month of March! 1964 has been designated by the President proclamation of the United STates and the Governor of Illinois as Cancer Control Month, AND WHEREAS The Northwest Suburban area offices of the American Cancer Society have been located in Mount Prospect since 1954 in a decade of faithful service toward control of this killer of mankind, AND WHEREAS a campaign to raise funds for education~ research and service in this never-ending fight will be staged in Mount Prospect, IT IS MY PLEASUR~ through the authority vested in me as president of the Village of Mount Prospect, Illinois TO HEREBY PROCLAIM April 13-19 as Cancer Control Week in Mount P~ospect and to ask the residents of The Village to give generously for this most worthy cause.
