President Schlaver called the meeting to order au 8:12 P.M.

approve the minutes of September 22nd as submitted, minutes

Trustee Ekren, seconded by Trustee Busse, moved to approve
Zoning Case ordinances annexing and zoning property owned by Mr. Salvatore
64-13 Di Mucci at 405 West Golf Road (Case B~-%3~. Attorney Simon
T. Lawton, representing certain n~i~hbors, particularly Mr.
Carponelli, protested passage of this ordinance on the grounds
that publication of the zoning notice was not legal, that the
Mt. Prospect Independent as of March 5, 19B4w~*o~ld not be recoE-
· nized as a newspaper of general circulation in the area affected.
Mr. Lawton asked that t~s zoning notice be republished and
given another hearing.
Attorney Hofert reminded the Board that he had communicated
with them in August regarding this matter, explainin~ that
the Board's procedure in an effort to be fair to both news-
papers attempted to ~ive equal valuation of le~al~advertising~
that he would advise them to err rather on the si~e of informxng
by advertising zoning hearings in both papers. Trustee Ekren
and Busse then withdrew their mow. ion to pass annexation and
zoning ordinances ~re 405 West~od_f Road, and moved, instead,
that notice of zonin~ hearil~E fo~ Case 6~-13 be republished
in both newspapers, to be paid for by the Village, with certified
copies to be sent to all Board ~embe=s.

PresidenZ Schlaver cautioned any member of the Zoning Board
who is affected by this hearing to abstain from taking any
action in regard thereto. The Trustees also pointed out that
action had been delayed a~ the Zonin~ Board's request, that
plenty ~ time had been allowed for objections.
Trustee Casterline, seconded by Trustee Bergen, Zoning, 19~
moved that all notices of zoning hearings he published in
both The Mount Prospect Herald and the Independent henceforth.

Mr. Stuart Paddock, publisher of the Mount Prospect Herald,
declared To The Board that his firm did not desire To cast
aspersions on therother paper,~hat they believed in competition.
The question of notification of legal objectors in zoning hearings
was referred to the Judiciary Committee.
Trustee Ekren, seconded-by Trustee Busse, moved to Water Main
concur with the recommendation of the Village Engineer that
the firm of Bowler & Di Paolo he awarded contract to install
water main along Highland, Rand and Kensington Road, as
They were the qualified low bidder.

to allow expenditure of $~Pffor purchase of compound water
meter to be installed at Fire STation ~2 inadvertently omitted
from the specifications of The contractor.

Fire Prevention Week and promised To bring the contest-winning Fire
children to the next BoardmeeTing.
Trustee Busse read The following letter from Sheriff
Richard Ogilvie: Police
September 30, 1964
Dear Mr. Busse:
I am writing you to commend the activities of Sergeant Ralph J.
Doney of The Mount Prospect Police Department. Sergeant Doney
October 6, 1964
acted above and beyond ~he call of duty in assisting Chief
Alex Mac Arthur in subduing a prisoner who recently attemp-
ted to escape from the Niles Court.
I understand that in the course of assisting Chief Mac
Arthur, considerable damage was done to Sergeant Doney's __~
suit. If he will send us a bill for the damages, we will
he most happy to see he is reimbursed.
Again congratulations to the Mount Prospect Police Depart-
ment for the fine assistance given to us hy Sergeant Doney.

Chief Wbittenberg explained that Sergeant Doney collected
for his damaged clothing on the spot from the prisoner's
attorney, that therefore it would not he necessary to
accept Mr. Ogilvie's offer.
Trustee Bergen., seconded by Trustee Casterline,
Building moved that the VillageSttorneyhe directed to prepare
ordinance amending Chap. 6, Paragraph 6 of the Building
Code establishing Paragraph 6-Baasff611o~s:
"Any person, firm or corporation who erects, con-
structs or sells any house, dwelling place, busi-
ness establishment-or other type building within
the village limits and which was erected under a ~
building permit issued hy the Superintendent of
Buildings, shallbefore transferring possession
to said structure to any other person, firm or
corporation for the ultimate use as a dwelling
place, business establishment or for any other
occupancy of said premises hy human beings,
either:
1. Secure an occupancy permit from the Super-
intendent of Buildings, certifying that such
building conforms to the provisions of the
Building and ZoningCodes, or
2. Notify said person, persons, firm or corpo-
ration, classified as the ultimate users as
aforesaid, in writing, that such occupancy
permit has not been issued."

line and Mr. Voss on a new ELGIN Street King when we demon-

should have bids from us in your file dated March
5, 1963 and Feb. 5, 1964. We agree~ with Mr. Caster-
line ~o hold. to the prices previously bid and further-
more if you decide on the six-cylinder engine, this
bid would be $200.00 cheaper Than the previous prices
submitted to you.

upon recommendation of the Street Superintendent.

Later in the meeting, Trustees Casterline and Ekren ~mend-
ed the above motion by adding "in accordance with lease-
purchase plan to be arranged with a local bank". This
motion carried by acclamation.
Trustee Casterline read the following memo from
the Village Engineer:

ublic Works "Employer's MuTual of Wausau, who is insuring The Village's
Building buildings against fire, has rec°~mended That all windows
(garage) on That face Wille's lumber yard be glazed with wire glass. This
Pine Street is for The pre~e6Tion of The buildin~ from an exterior
fire which could break The glass and start a fire inside.
The fact That T~e building is sprinklered does not affect
This iTom. Wire glass on This wall will Therefore affect
our insurance rating. I have asked The contractor for
The additional cost for wire glass."

Zoning Case Zoning Board:

Re: Zoning Case 6~-3~, heard September 25, 196~
Petitioner: Chicago Title ~ Trust Co., Trust #~6791
ATTorney: Kenneth Meyer, Des Plaines
This is a request for rezoning from B-2 To B-3 of property
(Lot 11) located at The northwest corner of Golf and Elm-
hurst Roads.
Three legal objectors were present, abutting on The north
side~ The wes~ side and across ElmhursT Road To The east,
and strongly objected ~o This rezoning. There were numerous
other objectors, allresidenTs, of The immediate area. The
President of The Country CluhTerrace Home Owners AssociaTion
presented The objections of his group of about 200 homes
in The area.

ne of the petitioners' witnesses admittpd under questioning Zonin~ Case
by members of the Zoning Board that the property could be 64-34
developed as it is presently zoned, namely B-2. The pro-
perry was rezoned in September, 196~ from R-i, primarily
on the sworn testimony and promises of the petitioner in
that case that the property would be developed as a medical
center only.
The Zoning Board of Appeals ,agreed that the
requested rezoning would:
1) Have a detrimental effect on the value
of the R-1 Residential area on three
sides of the subject property,~
2) Constitute spot zoning.
3)Increase the congestion in public streets
(two major highways) unreasonably.
4) E~danger the public safety.
$) Increase the hazard of fire.
6) In other respects impair The public health,
safety, comforts, morals and wela~e' of the
people.
The Zoning Board Appeals, Therefore, voted 6-0 to deny This
petition for rezoning as requested.

President Schlaver readproclamaTion declaring
Halloween as UNICEF day.
Trustee Casterline asked that before replacing
certain thorn trees in Country Club Terrace Subdivision, Trees
opinion be obtained from property owners abutting to see
about the~ nuisance value.
