HomeMy WebLinkAbout12/21/1954 VB minutes 4 � l ,� MINUTES OF A REGULAR ME aING OF THE PRESIDENT AND BOARD OF TRUSTEES, HELD IN THE MUNICIPAL BUILDING, MOUNT PROSPECT, ILLINOIS ON TUESDAY, DECEMBER 21, 1954 The meeting was called to order by President Lams at 8:20 P.1 . add the Clerk was then directed to call the roll. On roll call, the following Trustees answered "Present ": Ibbotson, Schlaver, Willer and Wright. Trustees Viger and were absent. The Trustees having previously received copies of the minutes of the meeting held December 7, 1954, a motion was made by Trustee Willer, seconded by Wright, that the minutes be approved as submitted. The President put the question, the Clerk called the roll, with the following results: Ayes: All; Nays: None. Thereupon the President declared the motion carried a` d said minutes approved. 4 A motion was made by Trustee Schlaver, seconded by Filler, that the Treasurer's Report for the period ending November 30, 1954, be approved and placed on file. The President put the question, the Clerk called the roll, with the following respense: Ayes: All; Nays: None. Thereupon the President declared the motion carried. A motion was then made by Trustee Biller, seconded by Aright, authorizing the Village Engineers to obtain bids pertaining to the drainage problem correction in Northwest Meadows in vicinity of Withorn Lane. The motion was voted upon by acclamation, where- upon the President declared the motion carried. 5 Dec. 2 1 19 assessments on the following vacant real estate: 463 Lot Four (L) in Block Twenty- three (23) in Busse's Eastern Addition to Mount Prospect in the East One -Half (i) of Section 12, Town 41 North, Range 11. General taxes will be paid up to date and the same applies to drainage taxes. We will produce a bidder who will bid not less than thirty -five per cent (35 %) of the principal and we hereby agree to pay all expenses including attorney's fees and the sum of 05.00 for distribution fees, hereby indemnifying the Village against any expense in this connection. Silverthorne A motion was teen made by Trustee Willer, seconded by Schlaver, that the Village Attorney be authorized to prepare a resolution covering foreclosure proceedings, as requested, subject to approval by Leonard C. Meade. The President put the question, the Clerk called the roll, with the following response: Ayes: L11; Nays: None. Thereupon the President declared the motion carried. The following petition was then read: November 17, 1954 President and Board of Trustees Village of Mount Prospect Village Hall Mount Prospect, Illinois Gentlemen: As attorney for Harold 0. Meisenheimer, the owner of the legal title, and Kenneth R. Whitton, as contract purchaser of the real estate hereinafter described, I respectfully request that said real estate be rezoned from its existing residential use to its original commercial use. A motion was then made by Trustee Bright; seconded by Willer, that the Village Clerk be authorized to notify the M "t. Prospect State Bank that the paving of Maple Street, between Henry and Gregory, has been accepted by the Board of Trustees. The motion was voted upon by acclamation, whereupon the President declared the motion carried. A motion was made by Trustee Willer, seconded by Schlaver, authorizing a deposit of .n500.00 with Edward M. Koza, Master in Chancery, to secure costs of suit of Dimucci vs. Village of Mount Prospect case, No. 54518279. The President put the question, the Clerk called the roll, with the following response: Ayes: All; Nays: None. Thereupon the President declared the motion carried. The motion was voted upon by acclamation, whereupon the President declared the motion carried. The following letter was then read; Chicago, November 29, 1 954 Board of Trustees Village of Mount Prospect Mount Prospect, Illinois.+ Gentlemen: On Friday, November 26, at 8 :00 P.M., the Zoning Commission, with all members present, conducted hearings on two parcels of property. The legal description, as published in the Mount Prospect Herald November 11, 1954, was as follows: Parcel No. 1 Lot 33 in Block 22 in the Resubdivision of Lot 7, in Block 21, Lots 12 to 19 both inclusive in Block 22 and Lots 12 and 13 in Block 23, in Busse's Eastern Addition to Mt. Prospect in the East 2 of section 12, Town 41, Range 11, East of the Third Principal Meridian in Cook County, Illinois. Parcel No. 2 Lots 7, 11, 9, 24, 25, 2P, 29, 30, 32, 33, 51 and 52 all in Maplewood Heights, being a subdivision of the East 15.00 chains of that part lying North of Railroad, of Southeast (uarter CO of Section 12, (except the Southerly 66 Feet for road) also of Block 26 in Busse's Eastern Add-_ tion of Mount Prospect, in East Half (I) of Section 12, '^1 all in Town 41 North, Range 11, East of the Third Principal Meridian, Request for each parcel was for rezoning from R -1 Residence to B Business. The petitioner for Parcel No. 1 was Mr. William <tnnen. He presented Torrence certificates indicating ownership of property involved. Parcel No. 2 was presented by Mr. Harold Ahbe. Torrence certificates of ownership were also exhibited by him. It was the unanimous decision of the Commission that both parcels, as above described, should be rezoned as requested. All of the property involved is on the Yerthwest Highway and many of the adjoining lots are presently zoned for business. The Dec. 21, 1954 Commission believes that the property in question is 467 best suited for business purposes. There were no objections to the zoning requests for either parcel. Yours truly, 6.1w. A motion was then made by Trustee Willer, seconded by Wright, to concur in the recommendations of the Zoning Commission and that the Village Attorney be authorized to prepare an ordinance covering rezoning of thig property. The President put the question, the Clerk called the roll, with the following response: Ayes: X11; Nays: None. Thereupon the President declared the motion carried. A letter under date of December 9th, from Harris Brothers Co. was then read. This letter referred to the securing of a Building Permit for the property at 228 W. North- west Hwy., with the understanding that the property would be used to erect 3 or possibly 4 model garages for display purposes A motion was then made by Trustee Wilier, seconded by Wright, that the request be denied, and that the Village Clerk be instructed to so inform the Harris Brothers Co. The motion was voted upon by acclamation, whereupon the President declared the :notion carried. Summonses No. 54S18765 and 54417018 were then read and a motion was made by Trustee Willer, seconded by Wright, that the Village Attorney be authorized to file an appearance and answer in these cases. A letter under dst e of December 15th, frIm Pastor Stevens of the South Church, requesting permission to place church signs on theouthesst corner of Northwest Hwy. boor and south Emerson Street and the Southeast corner of Elmhurst Rd. and West Sha -Bonee Trail, was then read. A motion was then made by Trustee if :right, seconded by ?filler, that this permission be granted, with the understanding that the signs will be erected under the supervision of. the Police Chief. The motion was voted upon by acclamation, thereupon the Pres- ident declared the motion carried. A motion was made by Trustee Schlaver, seconded by Ibbotson, that the audit of the water department funds for the fiscal year ended July 31, 1954, be approved and placed on file. The President put the question, the Clerk called the roll, with the following response: Ayes: All; Nays: None. Thereupon the President declared the motion carried. A motion was then made by Trustee Echlaver, seconded by Ldright, that in accordance with the ammended Water Ordinance, the 45.00 Water Deposit be refunded to party as recommended in Collector's Report of December 21, 1954. The President put the question, the Clerk called the roll, with the following response: Ayes: All; rays: None. Thereupon the President declared the motion carried. A motion was then made by Trustee 1.►i_ller, seconded by Schlaver, that the especial Assessments Report, for the period ended November 30, 1954, be approved and placed on file. The motion was voted upon by acclamation, whereupon the President declared the motion carried. A motion was then made by Trustee Schlaver, seconded by ' to approve for payment the bills as listed for the month of November 1954, with the exception of the bill in the amount of 0_ for the Fischer and Porter Co. The President put the question, the Clerk called the roll, with the following results: Ayes: All; Nays: None. Thereupon the President declared the motion carried. Dec. 21, 1954 A letter under date of December from the Village Ehgineers to Air. Sai.i, T. Winston, recommence n ` payment in the amount of $6,51 to Milburn Brothers, (� Inc., for the Va -Pella Ave. paving project, was then read. A motion was then made by Trustee Schlaver, seconded by Wright, to concur in the recommendations of the Village Engineers and that the Villa 'e Clerk be authorized to so advise the City National Bank and Trust Co. of Chicago. The President put the question, the Clerk called the roll, with the follow ng response: Ayes: All; Nays: None. Thereupon the President declared the motion carried. A motion was made by Trustee Willer, seconded. by Wright, authorizing the President and Village Clerk to sign the Sanitary District of Chicago's Permits No. 1954 -181, 1954 -191, 1954 -185, on behalf of the Village. The motion was voted upon by acclamation,; whereupon the President declared the motion carried. A motion was then made by Trustee Willer, seconded by Wright, to request the Mount Proqp ect Zoning Commission to hold a public hearing onthe proposed rezoning from R -1 Classification to B Classification of the Village property where No. 5 Nell is being drilled. This property is legally described as "the East 218.26 Feet of the South 215 Feet of the West 575.43 Feet of the Northwest quarter of the Northeast quarter of Section 34, Township 42 North, Range 11, East of the Third Princtipal Meridian, in Cook County, Illinois." The President put the question, the Clerk called the roll, with the following response: Ayes: All; Nays: None. Thereupon the President declared the motion carried. A motion was made lnry Trustee Schlaver, seconded by Ibbotson, to ao prove partial payment No. 3 to S. B. Geiger & Co., in the amount of $12,345.30, covering Water Works Improvements, Well No.5. This payment was recommended by Village Engineers under date of December 8, 1954. The President put the question, the Clerk called the roll, with the following results: ;yes: All; Nays: None. Thereupon the President declared the motion carried. There being no further business to come before the meeting, a motion was made by Trustee Wright, seconded by Ibbotson, that the meeting be adjourned.
