HomeMy WebLinkAboutRes 19-45 12/04/1945 FI O: 12 -4 -45 Dahlgren A RESOLUTION TO FORECLOSE THE LIEN OF SPECIAL ASSESSMEITS OF CERTAIN PROPERTIES IN TIC VILLAGE OF MOUNT PROSPECT. :- n n * * WHEREAS, ordinances have heretofore been adopted providing for the construction of certain water, sewer, sidewalk and paving improvements in Prospect Park Country Club Subdivision in the Village of Mount Prospect, Cook County, Illinois; and t IEREA.S, special assessments were levied to pay the cost of said work and pursuant to the statute applicable thereto said rrovem.ents were constructed and the report of cost and completion was op in manner and form provided by law; and WHEREAS, certain installments of said special assessments levied against individual lots have not been paid and are now past due and delinquent; and WHEREAS, the President and the Board of Trustees find that it will be for the best interests of this Village that said spe- cial assessment liens be foreclosed. NOW, THEREFORE, Ee It Resolved by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That the special assessment liens against the lots set out in the schedule hereto attached marked ( Exhibit An and hereby made a part hereof, be foreclosed. Section 2. That the attorney for the Village of Mount Prospect be and he is hereby authorized and directed to prosecute said foreclosure suit as he may deem best, and to cooperate with the States Attorney of Cook County, in procuring the foreclosure of the lien of the general taxes upon said lots, if any there be, which this Board hereby requests that the States Attorney fore- close; and further, to cooperate with the officials of the Weller Creek Drainage District or any other district, in procuring the foreclosure of the lien of drainage benefit assessments upon said a lots, if any there be, which this Board hereby requests said Drainage Districts to foreclose; that said attorney is hereby authorized to file suit for foreclosure or to join in any suit or suits for foreclosure instituted by the States Attorney to fore- close the lien of general taxes and to tare such other steps as he deems proper to procure the prompt sale of said property to satisfy said tax liens. Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 4. That this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 7'tl day of December, 1945. APPROVED this )I day of Decembe , 1945.
