Trustee Bruhl, seconded by Trustee Phillips, moved for the adoption of Res. 31-63: Res. 31-63 Finance DESIGNATION OF DEPOSITORY This resolution designates Mt. Trustee Casterline a~ivedat 8:27 P.M. Trustee Bruhl presented the appropriation ordinance for Finance the fiscal year beginning May first in the amount of $1,BS0~009, budKet - and explained to the public the way in which it was put together, appropriation Attorney Hofert explained that the law requires the Village to pass an appropriation ordinance in sufficient detail to properly advise the taxpayer regarding the expenditures and that the Village cannot legally spend any funds unless they are first appropriated. July 23, 1963 Trustee Bruhl, seconded by T~ustee Phillips, moved for Ord. 923 the adoPtion of Ord. 923: Appropriation ordinance AN ORDINANCE making' appropriations to defray the expense of the Village of Mount Prospect for municipal purposes designated as the "Annual Appropriation Bill" for the period beginning May 1~ 1963 and ending April $0, 1964. Upon roll call: Ayes: Bruhl Bergen Casterline --~ Ekren Phillips Absent: Bickley -Motion carried. signs Tmustee Bergen read letter from the operator of the Texaco station at the northwest corner of Emerson and Northwest Highway asking for variation in sign ordinance to allow erection of a Texaco sign 52'10" high. Trustee Bergen reported that the Architectural Co~ittee and Building Department recommended denial of ~erection of this sign, and then moved, seconded by Trustee Casterline, to deny variation to allow erection of the Texaco sign. Upon roll call: Ayes: Bruhl Bergen Casterline Ekren Phillips Absent: Bickley Motion carried. Trustee Bergen read letter to Mar Don Construction Co., Building attention M~. Rosenbaum, dated July 17th, from the Building Super- intendent, directing that firm to Board up damaged and vacant houses along Weller Lane. Mr. Carney stated that Mar Don Construction Co. had replaced some of the broken glassy had done some painting and fixed up the fronts a bit. Two of the buildings are locked but one house can be entered. Mr. Carney added that he has sworn out a warrant for Mr. Ros~nbaum's arrest but was given to understand said person was away on vacation. Trustee Ekren, seconded by Trustee Bruhl, moved for the passage of Ord. 924: Ord~ 924 Annexatinn AN ORDINANCE ANNEXING PROPERTY TO THE VILLAGE OF Ricketts property MOUNT PROSPECT, WHICH PROPERT~ CONSISTS OF ABOUT THREE ACRES ON NORTH MAIN STREET RUNNING EASTWARD TO RAND ROAD, BETWEEN HIGHLAND AND FOUNDRY. Schlavsr Absent: Bickley Motion carried Trustee Ekren~ seconded by Trustee Phillips, moved for Ord. 925 the passage of Ord. 925: ~ Zoning AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE RELATING TO pROPERTY ON NORTH MAIN STREET RUNNING EASTWARD TO RAND ROAD, BETWEEN HIGH- LAND AVENUE AND FOUNDRY ROAD. Upon roll call: Ayes: Bergen Bruhl Casterline Phillips Ekren : ~ Absent: Bickley Motion carried. Ordinances 924 and 925 annex and zone property mentioned in Zoning Case 63-17, owned by Mr. Ashley Ricketts. Trustee Bergen ques- tioned the broad use of B-3 zoning allowed in this case; Attorney July 23, 1963 ofert pointed out that the only cure lay in re-defining the business Zoning uses and setting up more categories. Tmustee Ekren reminded the Board that this problem has been before them for some time and that if the rest of the Board would co-operate he would be glad To secure the help of Mr. Baughmann on this matter. Trustee Ekren, seconded by Trustee Phillips, moved for the passage of O~d. 926: Ord. 926 Villa Sweden AN ORDINANCE ANNEXING CERTAIN PROPERTIES IRREGULAR Annexation IN SHAPE AND HAVING AS SOUTHERNMOST BOUNDARY RAND ROAD; LYING GENERALLY BETWEEN GOLF LANE ON THE SOUTHEAST, EUCLID AVENUE ON THE NORTH AND LYING WESTERLY OF MEADOW LANE, COOK COUNTY, ILLINOIS. Upon roll call: Ayes: Bergen Bruhl Casterline Phillips Ekren Absent: Bickley Motion carried. The zoning appeal for the above proper=y is scheduled for August 16th, Case 63-24, Hane Realty. Trus%ee Ekren, seconded by Trustee Phillips, moved for Res. 32-63 the adoption of Res. 32-63: Colonial Heights Water ~ Sewer A RESOLUTION DIRECTED TO THE RESIDENTS OF COLONIAL HEIGHTS AS TO WATER AND SEWER RATES. Upon roll call: Ayes: Bmuhl Casterline Ekren Phillips Pres. Schlaver Nays:~Bergen~ Absent: Bickley Motion carried. Discussion was held regarding Special Assessment program Spec. Assess. for paving of Kenilworth Avenue and vacation of Thayer Street in Kenilworth Ave Centralwood Subdiv~si0n; pointing ou~ that plans had been drawn improvements twice by Consoer, Townsent & Associates for this improvement; that Mr. Delgado's contract for erection of a nursing home lapsed after his death and the owner wishes ~o use this tract for R-~ apartments; that Mr. Di Mucci had been willing to donate a portion of his area for a tot lot To be run by the Park District; Mr. Di Mucci stated at this point that he had no~ ye~ come to an under- standing with Mr. Charles rayne of the Park Board on this matter. Attorney Hofert explained that the new plans drawn byConsoer, Townsend showed Thayer Street as improved, but he understood the Village's plan was to vacate this street. President Schlaver asked that the decision to vacate Thayer Street ben,reached at the next meeting. Trustee Ekren read th~ following letter f~om the Plan Commission: Colonial HeiEhts July 23, 1963 7th Addition President and Board of Trustees Gentlemen: The Mount ~ospect Plan Commission recommends that the attached plat of Colonial Heights 7th Addition be approved subject ~o the utility easements being reserved to the Village as well as July 23, 1963 to the Illinois Bell Telephone Company and to the Commonwealth Edison Company. Millem Amtesian Well Company, as follows: July 28, 1963 "Village of Mount Prospect Mount Pmospect! Illinois Gentlemen: Ruming 1962, at the time the pipe and the Byron-Jackson submemsible pump and motom assembly in the Village of Mount Pmospect's Well No. 6~ located on~ Foundry Road in Randhurs~ Shop- ping Center, was being memoved by J. P. Millem Amtesian Well Co. fop repair, the assembly was dmopped into the well hole. The pipe was removed, but it was impossible to memove the Byron- Jackson pump and the motom fmom the hole hefome the present pump was installed. Subsequent to the fomegoing the J. P. Millem Amtesian Well Company entemed into a settlement with the Village whemein the J. P. Millem Amtesian Well Company gave to the Village an off-setting allowance fop womk done on the well to compensate the Village fop the loss fop the pump descmibed above. In addition the J. P. Millem Artesian Well Company agmeed with the Village that they should deepen the well past the pump to the Mount Simon formation which the well company was in the pmocessing of doing when the Village~ due to an ememgency water condition~ is- sued a change omder limiting the dmilling to the Galesville fommation so that an immediate pmoduction of water would be fomthcoming. It is the view of the J. P. Millem Amtesian Well Company that if they had be~n permitted to complete the dmilling to the Mount Simon stmats they would not have dislodged the pump afore- mentioned and it is 'understood between the pamties that it will be difficult to affix fault if the pump is dislodged by a subse- quent dmilling by persons othem than the J. P. Millem Company. In view of the foregoing uncertainty, it is advantageous .for both the Village and the J. P. Millem Amtesian Well Company to stmike a settlement now regarding the fumthem deepening of the well and the J. P. Millem Amtesian Well Company agrees that if the July 23, 1963 Village agrees not to press any claim against it in the future the Water J. P. Miller Artesian Well Company promises that if the bore is further deepened by J. P. Miller Artesian Well Co., or by any of its affiliated companies, and should interference again occur from the Bymon-Jackson pump and motor during the next ten (10) years ~.~ after date of this agreement, this interference willbe removed at the expense of J. P. Miller A~tesian Well Company. Work is to com- i mence within thirty (30) days after receipt of written notice of interference, and is to be pressed diligently until the interfer- ence is removed. If said work is not so commenced, or done diligently, the village shall have the option to contract with others, in which event J. P. Miller Artesian Well Company shall bear the expense. The Pmesent rate fo~ drilling was $13.00 per foot for 15-1/4~ hole, and the present hourly ra~es for other work performed on the site are: 2 man crew for bailing sand from well, using rig and equipment, per hour ---$18.00 4 man crew for pump work, using tools and equipment, per hour ---$33.00 Trucking - fla~ bed trucks, per mile --- .25 pickup truck, per mile --- .16 tractor and trailer, per mile--- .40 J. P. Miller Artesian Well Company agrees that the above rates, adjusted to reflect the change in the Engineering News- Record Con, ruction Cost Index, which index is presently 900.95, will be used at the time the work is called for. In the event that J. P. Miller Artesian Well Company or any of its affiliated companies ape not retained to deepen the well bore, this agreeement and its guarantee shall be of no further force and effect, and no responsibility attached as a result of such interference. Miller ~tesian Well Company letter of July 23, 1963 be accepted regarding the assumption of liability concerning future drilling to the Mount Simon stratum in Well 6, and that the Village President be authorized to sign on behalf cf the Village. Moehling and William Lasina, from the Zoning Board of Appeals Docket 558 of Cook County, to be held August 9 at 10:00 A.M. in the Conference Room, Suite 1407, 130 North Wells St., Chicago. The Village Attorney was asked to attend this meeting. July 23, 1963 ater Tmeasurer James King inquired as to what mates should rates he charged fo~ water to ~esidents outside the Village who fo~= merly paid rheim hills to Cook County Wate~ Company, and was told To ohamEe them the old mates (as cha~ged.by that company) fo~ the fomthcoming watem billing. Building Mm. Lloyd Nom~is inquired of the BoaPd as to why build- ing constmuction figumes showed the avemage price pe~ home in Mount P~ospect to be lowem than in su~oundinE communities. He was told that the Building Depamtment would have the answer at the next meeting. Sewers MP. Joseph Moome, 6t6 Prospect Mano~ complained of flooding in his area du~ing the mecent stor~as, and TPustee Ekmen pointed out that this had been a flash flood and the entiPe Vil- tage had been hit equally.
