The petitioner, Shaun Cecala, is seeking approval of a Conditional Use to construct a circular driveway in the front yard for the property at 903 W. Isabella Street. The petitioner proposes to demolish the existing driveway and construct a circular driveway in the front yard. The Zoning Code requires Conditional Use approval for the circular driveway. The Planning and Zoning Commission conducted a public hearing to review the request on Thursday, May 27, 2010 and by a vote of 7 -0, recommended approval of a Conditional Use for a circular driveway for the property at 903 W. Isabella Street, with the condition that the lot coverage in the front yard does not exceed thirty -five percent (35 %) and that the existing parkway tree in front yard of the property is protected during construction of the driveway. Details of the proceedings and items discussed during the Planning and Zoning Commission hearing are included in the attached minutes. Please forward this memorandum and attachments to the Village Board for their review and consideration at their June 15, 2010 meeting. The minutes were approved 5 -0; with Mr. Donnelly and Mr. Foggy abstaining. Chairman Rogers introduced Case PZ- 07 -10, 903 W. Isabella, at 7:32 p.m. Ms. Andrade stated the Petitioner for Case PZ -07 -10 requested Conditional Use approval to allow the construction of a circular driveway for the property located at 903 W. Isabella Street. Ms. Andrade said the Subject Property is an interior lot located on the south side of Isabella Street. The Subject Property is zoned RX Single Family Residential and is bordered by the RX District on all four sides. The lot measures 110 feet wide by 180 feet deep. Ms. Andrade showed a picture of the existing structure on the property, which is a single - family home constructed out of brick, stone, and frame. Ms. Andrade stated the Petitioner proposed to demolish the existing driveway and construct a circular driveway. The Village Code required Conditional Use approval for a circular driveway. Ms. Andrade said the site plan submittlA by the applicant showed the proposed circaiai driveway. The circular portion of the driveway would measure twelve (12) feet wide in the front of the home and expand to fourteen (14) feet wide at the property line. It would connect to a standard eighteen (18) foot wide driveway that leads to the attached garage. The maximum lot coverage permitted in the front yard and overall on the subject property is 35 %. As proposed, the circular driveway would exceed the maximum lot coverage in the front yard by 2 %. Staff has discussed the lot coverage in the front yard with the Petitioner. The Petitioner has agreed to reduce the lot coverage by at least 104 square feet to comply with the maximum permitted lot coverage of thirty-five percent (35 %) in the front yard. Ms. Andrade said the proposed overall lot coverage for the property is approximately twenty-nine percent (29 %), which would comply with the maximum overall 35% permitted lot coverage. Ms. Andrade stated that it has been previous Village policy to support requests for circular driveways when the Subject Property fronts on an arterial street and /or the traffic volume is such that a circular driveway is necessary to resolve a safety conflict. However, recognizing that circular driveways are not always requested for a safety issue, but as part of a larger improvement project for a residential property; Ordinance 5547 passed on February 7th, 2006, which set forth the minimum requirements for consideration of circular driveways. This ordinance limits consideration of Conditional Use approval for circular driveways to lots that measure seventy-five feet (75') or greater. The circular drive portion of the driveway shall have a minimum turning radius of fifteen feet (15') and shall have a minimum width of 12 feet. Ms. Andrade said the Petitioner's proposed circular driveway would comply with the requirements for a circular driveway as required by Ordinance 5547. The Subject Property measures 110 feet in width and the circular drive portion of the driveway would measure 12 feet wide with a minimum turning radius of 15 feet. Ms. Andrade stated the standards for Conditional Uses are listed in Section 14.203.F.8 of the Village Zoning Ordinance. The section contains seven specific findings that must be made in order to approve a Conditional Use. Ms. Andrade said Staff reviewed the proposed circular driveway and found that it would not violate the Conditional Use standards of the Zoning Ordinance, and it would meet the minimum requirements listed for circular driveways as per Section 14.2215. Based on this analysis, Staff recommended that the Planning and Zoning Commission approve the motion, subject to the conditions listed in the staff report. Chairman Rogers swore in Russell Cecala, 903 W. Isabella, Mount Prospect, Illinois. Mr. Cecala stated that the original driveway was broken up and in disrepair, it needs to be replaced. He said there were issues with additional drivers in his household along with pedestrians who walk along the street. He thought a circular driveway would accentuate the house with curb appeal along with settling some safety issues. Mr. Cecala agreed with Chairman Rogers. He said he had no intention on using the circular driveway to park cars. Mr. Cecala reiterated that his main intention of adding the circular drive was for safety. There are a large number of pedestrians in the neighborhood with the proximity of the local school and park. Chairman Rogers said he would like to see some landscaping along the circular driveway to screen the asphalt pavement. Mr. Cecala stated that he intended to add additional landscaping to the property. Mr. Youngquist felt the request for the circular driveway was appropriate. He stated that the Petitioner built a significant addition to the Subject Property, but did not update the driveway at that time. Mr. Beattie asked how the Petitioner would reduce the lot coverage from 37% to 35 %. Mr. Cecala said he was able to reduce the width on the circular driveway and on the walkway from the house to the circular driveway. Chaiiman Rogers called for additional questions or comments; hearing none, the public hearing was closed at 7:43 p.m. Mr. Beattie made a motion, seconded by Mr. Donnelly to approve to approve a Conditional Use permit for a circular driveway for the residence at 903 W. PROSPECT Dear Mr. Cooney, We are in the process of a Conditional Use request to construct a circular driveway at our home at 903 W Isabella Street, Mount Prospect. The Planning and Zoning Commission has already voted unanimously that the Village Board Approve our request. The Village Board is scheduled to review our request, and a first reading of the ordinance, during their regular scheduled meeting on June 15, 2010. The second reading and final action by the Village Board will not take place until, at the earliest, July 6, 2010. We are asking that the Village Board waive the second reading and take final action at their June 15 meeting. We would greatly appreciate it if the board would grant this request so that we can confirm a date for construction with our contractor soon, so the project can be completed before August when the children return to school. ISABELLA ST / CONDITIONAL USE (CIRCULAR DRIVE) (CECALA RESIDENCE) BACKGROUND A public hearing has been scheduled for the May 27, 2010 Planning & Zoning Commission meeting to review the application by Shaun Cecala (the "Petitioner ") regarding the property located at 903 W. Isabella Street (the "Subject Property"). The Petitioner has requested a Conditional Use to allow the construction of a circular driveway. The P &Z hearing was properly noticed in the May 12, 2010 edition of the Journal Topics Newspaper. In addition, Staff has completed the required written notice to property owners within 250 -feet and posted a Public Hearing sign on the Subject Property. PROPERTY DESCRIPTION The Subject Property is an interior lot located on the south side of Isabella Street. The Subject Property is zoned RX Single Family Residence and is bordered by the RX District to the north, west, south, and east. SUMMARY OF PROPOSAL The Petitioner proposes to replace the existing driveway and construct a circular driveway in the front yard. The Village Code requires Conditional Use approval for a circular driveway. The attached site plan shows the circular driveway will measure twelve feet (12') wide by the front entrance and fourteen feet (14') at the property line. The circular part of the driveway will connect to a `standard' eighteen foot (18') wide driveway. As drawn on the Petitioner's site plan, the proposed driveway would exceed the maximum permitted lot coverage in the front yard by approximately two percent (2 %). The maximum permitted lot coverage in the front yard is thirty five percent (35 %). As proposed, the lot coverage in the front yard would be approximately thirty seven percent (37 %). Staff has discussed the lot coverage in the front yard with the Petitioner. The Petitioner has agreed to reduce the lot coverage by at least 104 square feet to comply with the maximum permitted lot coverage of thirty five percent (35 %) in the front yard. The proposed overall lot coverage for the property is approximately twenty nine percent (29 %), which complies with the maximum overall thirty five percent (35 %) permitted lot coverage. GENERAL ZONING COMPLIANCE The Subject Property does not comply with the Village Code requirements. The principal structure located on the property does not comply with the required forty foot (40') front yard setback. The existing front yard setback measures 39.83 feet. The section contains seven specific findings that must be made in order to approve a Conditional Use. The circular drive is listed as a Conditional Use in Section 14.803.A of the Zoning Ordinance. The following - list is a summary of these findings: • The Conditional Use will not have a detrimental effect on the public health, safety, morals, comfort or general welfare; • The Conditional Use will not be injurious to the use, enjoyment, or value of other properties in the vicinity or impede the orderly development ofthose properties; • Adequate provision of utilities and drainage and design of access and egress to minimize congestion on Village streets; and • Compliance of the Conditional Use with the provisions of the Comprehensive Plan, Zoning Code, and other Village Ordinances. It has been previous Village policy to support requests for circular driveways when the Subject Property fronts on an arterial street and /or the traffic volume is such that a circular driveway is necessary to resolve a safety conflict. The proposed circular drive portion of the driveway measures twelve feet (12') wide and has a turning radius of fifteen feet (15'). Also, the lot coverage in the front yard will be reduced to 35% to comply with the lot coverage requirement in the front yard. RECOMMENDATION PZ -07 -10 Planning & Zoning Commission Meeting May 27, 2010 Page 4 RECOMMENDATION The proposed circular driveway will not be harmful to the neighborhood character, does not violate the Conditional Use standards contained in Section 14.203.F.8 of the Zoning Ordinance, and will meet the minimum requirements listed for circular driveways (Sec. 14.2215). Based on the above analysis, Staff recommends that the Planning and Zoning Commission approve the following motion: "To approve a Conditional Use permit for a circular driveway for the residence at 903 W. My concern is where the end of the drive way will be and head lights. I really do not what our two driveways to empty into the street at the same place. I would also like you to take into account where the head light beams of cars that will idle in the driveway will or will not hit my house. What conerns me is that I really do not want to see headlights flashing into in our Family Room which is in the front of our house. They have 3 kids who are or will be driving and a parking lot in front of the house is also a potential. AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR PROPERTY LOCATED AT 903 WEST ISABELLA STREET, MOUNT PROSPECT, ILLINOIS WHEREAS, Shaun Cecala, ( "Petitioner "), has filed a petition for a Conditional Use permit for a circular drive for property located at 903 West Isabella Street ( "Property ") and legally described as: Lot 19 in block 7 in Arthur T. McIntosh and Company's Northwest Meadows, being a Subdivision in the East 1 /2 of Section 33, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. Specifically, the section states the following: A. Public Parks: No intoxicated person shall enter, be or remain in any public park, playground or swimming pool, nor shall any person bring into, sell, give away or drink any alcoholic liquors in any public park, playground or swimming pool. The term "alcoholic liquors" as used herein shall be defined by section 13.101 of this code. B. Public Streets, Alleys: It shall be unlawful for any person, to be in an intoxicated condition in or on any street, alley or other public place in the village. (1957 Code, 25.302; amd. Ord. 2218, 2 -3 -1970) The Village Attorney has reviewed this ordinance and has found it to be contrary to state law as expressed in Illinois Compiled Statutes 20 ILCS 301/25 -15. Accordingly, the Village Attorney has recommended Section 23.102 be amended as follows: A. Public Parks: 1. It shall be unlawful conduct for any person to appear in any public park, playground or swimming pool, manifestly under the influence of alcohol, narcotics or other drug to the degree that he or she (i) may endanger him /herself or other persons or property and fails to cooperate with a police officer or other intermediary person in being assisted to his /her home, a treatment facility or other health facility, or (ii) annoys or disturbs other persons in his/her vicinity 2. No person shall bring into, sell, give away or drink any alcoholic liquors in any public park, playground or swimming pool. AN ORDINANCE PERTAINING TO A DETERMINATION OF THE PREVAILING WAGE RATES WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, mechanics and other works employed in any public works by the State, County, Village or any other public body or any political subdivision or by anyone under contract for public works," approved June 26, 1941, as amended (820 ILCS 130/1); and WHEREAS, the aforesaid Act requires that the Village of Mount Prospect of Cook County investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workers in the locality of said Village of Mount Prospect employed in performing public works projects for said Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: To the extent as required by "An Act regulating wages of laborers, mechanics and other workmen employed in any public works by the State, County, City or any public body or any political subdivision or anyone under contract for public works," approved June 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics and other workers engaged in the construction of public works coming under the jurisdiction of the Village is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Cook County areas as determined by the Department of Labor of the State of Illinois as of June 1, 2010, a copy of which wage rates are on file in the Office of the Village Clerk. The definition of any terms appearing in this Ordinance, which are also used in the aforesaid Act shall be the same as in said Act. SECTION TWO: Nothing herein contained shall be construed to apply said general prevailing rate of wages as herein ascertain to any work or employment except public works construction of this Village to the extent required by aforesaid act. SECTION THREE: The Village Clerk shall publicly post or keep available for inspection by any interested party in the main office of this Village this determination of such prevailing rate of wages. SECTION FOUR: The Village Clerk shall mail a copy of this determination to any employer, and to any association of employees and to any person or association of employees who have filed, or file their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workers whose wages will be affected by such rates. Other Classifications of Work: For definitions of classifications not otherwise set out, the Department generally has on file such definitions which are available. If a task to be performed is not subject to one of the classifications of pay set out, the Department will upon being contacted state which neighboring county has such a classification and provide such rate, such rate being deemed to exist by reference in this document. If no neighboring county rate applies to the task, the Department shall undertake a special determination, such special determination being then deemed to have existed under this determination. LANDSCAPING Landscaping work falls under the existing classifications for laborer, operating engineer and truck driver. The work performed by landscape plantsman and landscape laborer is covered by the existing classification of laborer. The work performed by landscape operators (regardless of equipment used or its size) is covered by the classifications of operating engineer. A RESOLUTION REQUESTING CLOSURE OF A PORTION OF CENTRAL ROAD IN ORDER TO CONDUCT A PARADE WHEREAS, the Village of Mount Prospect desires to hold the annual Independence Day Parade on a portion of Central Road and Elmhurst Road (Route 83) in the Village of Mount Prospect on Sunday, July 4, 2009; and WHEREAS, said parade will require closure of that portion of Central Road between Northwest Highway and Busse Road, the curb lane of Westbound Central Road between Busse Road and Arthur Street, and Elmhurst Road (Route 83) between Northwest Highway and Golf Road; and WHEREAS, the State of Illinois requires that the Village assume all responsibility and liability involved in the closure of said State roadways. NOW, THEREFORE BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS A HOME RULE MUNICIPALITY: SECTION ONE: That the Village of Mount Prospect hereby requests the State of Illinois, Highway Department, to close Central Road between Northwest Highway and Busse Road, the westbound curb lane of Central Road between Busse Road and Arthur Street, and Elmhurst Road (Route 83) between Northwest Highway and Golf Road between the hours of 1:00 P.M. and 3:00 P.M. in order to conduct the annual July 4th Parade, a copy of which parade route and requested roadway closures is attached hereto. SECTION TWO: That the Village of Mount Prospect will assume full responsibility for the direction, protection and regulation of traffic during the time the detour is in effect and all liability for damages of any kind occasioned by the closure of the aforementioned roadways. SECTION THREE: That the Village of Mount Prospect will provide for efficient, all weather detour signs, to be maintained, conspicuously marked and judiciously patrolled by the Police Department for the benefit of traffic diverted as a result of the street closure requested herein. SECTION FOUR: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
