RESOLUTION NO. 12-57
WHEREAS it is in the best interests of the Village
of Mount Prospect, Cook County, Illinois in order to promote
the general welfare, morals and safety of the residents of
the Village of Mount Prospect that the Board of Trustees
of said Village adopt Rules and Regulations for the Police
Department of the said Village.
Now therefore Be It Resolved by the President and
Board of Trustees of the Village of Mount Prospect, Cook
County, Illinois, the following are hereby adopted as the
Rules and Regulations of the Police Department of the
Village of Mount Prospect, Cook County, Illinois:
SECTION I. The following Rules and Regulations are hereby
established and adopted for the government of the Police
Department of the Village of Mount Prospect:
Paragraph 1. The general administration and control
of the Police Department is vested in the Chief of Police
who shall be responsible for the government, efficiency,
training, and general good conduct of the department.
Paragraph 2. ABSENCE. In the absence of the Chief
of Police from the Village of Mount Prospect, or in case
of his inability to act, then the officer next in command
shall have and be permitted in such case to exercise the
powers and duties and discretion as hereinafter stated.
Such officer shall be particularly careful to carry out
the orders previously given by the Chief of Police. SuCh
orders shall not, except in the cases of exjreme emergency,
be countermanded or set aside, and when such action is taken
he shall report in writing to the Chief of Police his
reason in each instance.
Paragraph 3. ORGANIZATION OF ~IHE DEPARTMENT. The
Police Department of the Village of Mount Prospect shall
consist of one Chief of Police, Captain, and such Lieutenants,
Sergeants, Patrolmen and such additional special officers as
may be approved by the Village Board from time to time.
Paragraph 4. ORDER OF COMMAND. During the temporary
absence of the Commanding Officer when no other provision is
made by competent authority, the command devolves upon the
subordinate present next in seniority to such Commanding Officer.
The Command seniority is determined, first, by rank, and second
by continuous service in the rank. The relative rank in
position and order of command, of Police Officers of the
Department, shall be as follows:

1. Chief of Police
2. Captain
3. Lieutenants
4. Sergeants
5. Patrolmen
6. Special Officers
Definition of terms:
1. Officer: An Officer is a member of the Police
Department above the rank of Patrolman.
2. Commanding Officer: Commanding Officer is a
man in charge of the department or division
thereof.
3. Superior: A Superior is any member of the
Police Department above the rank of Patrolman.
4. Police Officer: Police Officers are all persons
who are members of the Police Department, regard-
less of rank.
Paragraph 5. CHIEF OF POLICE. The Chief of Police
shall be specifically charged wi th the supervision 0 f all
members of the department and shall be held strictly
responsible for the conduct, and efficiency of all such
members for the general good order of the department, and
shall be responsible to the Village President and the
Board of Trustees. He shall have regular hours of duty
during each working day. The Chief of Police shall have
a thorough knowledge of all sections of the Village of
Mount Prospect, and when going on duty shall immediately
familiarize himself with all police business transacted
since his last tour of duty. It shall be the duty of the
Chief of Police to inform the Commanding Officer coming on
duty of all importan t matters which have occurred and which
may require attention. The Chief of Police shall diligently
inquire into all complaints and charges of laxity or mis-
conduct in the performance of duty by members under his
command and shall take such steps as set forth in these
rules and regulations, or as he may deem necessary when
not in conflict with these rules and regulations.
The Chief of Police in the exercise of his duties
shall have the power to establish and enforce rules and
regulations for the government of the members and employees
of the department, which rules shall, however, be consistent
with the ordinances of the Village of Mount Prospect and the
laws of the State of Illinois.
It shall be the duty of the Chief of Police to cause
the public peace to be preserved and to enforce all ord-
inances of the Village of Mount Prospect of which the
police department must take cognizance. The Chief of
Police shall receive and give proper attention to complaints
of all persons referred to him and perform such other
duties as may be required from time to time prescribed by
the rules and regulations.
The Chief of Police shall have full power and
authority to reprimand any member of the Police Department,
and to file charges against any member or members of the
Police Department with the Board of Fire and Police
Commissioners for a hearing, for non-conformance with
these rules and regulations.

The Chief of Police shall have custody and control of
all books, records, machines, tools, apparatus, or equipment
of every kind necessary for the use of the department.
Further, all the following rules and regulations which
are applicable to the members of the Police Department are
also applicable to the Chief of Police.
Paragraph 6. CAPTAIN. The Captain shall have general
charge and control of all shifts and shall enforce all orders,
rules and regulations of the department. He shall also
perform all other duties assigned to him and observe a rigid
maintenance of discipline.
The Captain shall supervise and direct the work of all
Patrolmen and shall see that they make daily reports of the
work performed by them.
The Captain shall see that no partiality or favoritism
is shown any patrolman under his command.
The Captain shall see that all Special Orders and
instructions that may be issued from time to time, by the
Chief of Police, are read and thoroughly explained to his
subordinates, and then posted on the bulletin board.
If the Captain shall be absent from duty, on sick leave,
or for any other reason, his duty shall be performed by the
Lieutenant, with the approval of the Chief of Police.
In the absence of the Chief of Police, for any reason,
the Captain shall be acting Chief of Police.
Paragraph 7. LIEUTENANTS. Lieutenants of police shall
be specifically charged with the supervision of all members of
the Department during their hours of duty and shall be held
strictly responsible for the conduct and efficiency of all
such members and for the general good order of the Department
during their tour of duty. They shall have such regular hours
of duty as may be prescribed by the Chief of Police. The
lieutenants shall have a thorough knowledge of all sections of
the Village of Mount Prospect and When going on duty shall
immediately familiarize themselves with all police business
transacted since their last tour of duty. It shall be the
duty of the lieutenant relieved to inform the Commanding Officer
coming on duty of all important matters which have occurred
and whi ch may require attention. The lieutenants shall
diligently inquire into all complaints and charges of laxity
or misconduct in the performance of duty by members under
their command, and shall submit a written report of such
investigation to the Chief of Police.
The Lieutenants shall receive and give proper attention
to complaints of all persons referred to them and make such
reports and keep such books and records as are required, and
perform such other duties as may be required from time to time
by the Chief of Police.
The Lieutenants shall at all times wear regulation uniform
in keeping with the specifications of the department, unless
otherwise ordered by the Chief of Police, or unless their
duties are such that uniform is not proper.

Paragraph 8. SERGEANTS. A Sergeant of Police is charged
with executing the proper performance of patrol and other
police duty from the members of the department assigned to
patrol duty under him during his hours of duty. He shall
have such hours as may be prescribed by the Chief of Police,
or Commanding Officer.

Sergeants shall particularly and thoroughly familiarize
themselves with all subjects pertaining to the duties of
patrolmen and assist and instruct patrolmen under their super-
vision in the proper discharge of their duties. Sergeants
shall make themselves thoroughly acquainted with the capabil-
ities of patrolmen under their supervision and impartially
report in writing to their commanding officers every case of
misconduct, incompetency, neglect of duty or any violation of
the rules and regulations on the part of such patrolmen.
Failure to report will be sufficient for disciplinary action
before the Board of Fire and Police Commissioners. Sergeant,
during his tour of duty or otherwise specified by his oom-
manding officer, Shall inspeot all men going on duty, paying
particular attention to their personal appearance, their
uniforms, revolvers, and other police equipment. They shall
observe the personal appearance of all men reporting off duty.
Sergeants at the conclusion of their tours of duty shall
submit reports in writing, or verbally as to their squadfs
activity, and the activity of the men under their command,
and other pertinent information. In the arent no sergeant is
available, the Senior Officer will be held responsible and it
shall be his duty to make out the neoessary reports as out-
lined in the duties of Sergeants. The reports shall include
the condition of the cars or motorcycles used, the condition
of the radio, report on all complaints investigated, and all
other matters pertaining to the efficient operation of the
department. The duties of Sergeants and Lieutenants herein-
before set forth shall not relieve them from performing such
patrol duty as may be necessary or requested by a senior
officer.
Paragraph 9. PATROLMEN. Every Patrolman, in carrying
out the functions of the Police Department, namely, the
preservation of the pUblic peace, the protection of life and
property, the prevention of crime, the arrest of violators of
the law, the proper enforcement of all the laws and ordinances
of which the department takes cognizance, shall be consistently
direct in their efforts to accomplish that end intelligently
and efficiently, and shall hold themselves in readiness at all
times to answer the calls and obey the orders of their superiors,
and shall be accountable to their superior officers for the
general conditions of the Village during the hours assigned to
th em..
All original appointments shall be for a probational
period of one year. Continuance in service shall be dependent
upon the conduct of the appointee and his fitness for the
performanoe of the duties to which he is assigned as indicated
by the quality 0 f hi s work and the reports and recommendations
of his superior officers. If during the said year the appointee
proves unfit, he will be dismissed from the service by the Chief
of Police with the approval of the Commission and shall not be
entitled to appeal from such dismissal.

Patrolmen, unless otherwise ordered, shall wear the
regulation uniforms in keeping with the specifications,
including materials, designated and adopted by the depart-
ment and approved by the Board of Trustees.
Patrolmen assigned to squad or motorcycle duty shall
at the completion of their tours of duty, check the vehicle
used and see that the same is left in a clean condition and
refueled and ready for the incoming shift.
Paragraph 10. MEN ASSIGNED TO DESK DUTY. Men assigned
to desk duty shall wear the regulation uniform adopted for
their rank and work such hours as may be assigned to them by i
the Chief of Police. They shall see that their radio licenses "
are posted in a conspicuous place and carry their identificatioa
cards on their persons at all times.
Men assigned to desk duty shall at no time leave their
post without qualified relief even if it is necessary to call
the squad in from the street. They shall answer all alarms
as quickly as possible, and shall dispatch the squads, and,
or motorcycles, on duty giving them a short and correct
description of the complaint and, whenever possible, notify
the squads, and, or motorcycles that the complaint is urgent
if such is the case.
Men assigned to desk duty shall inform the squads or
motorcycles of any calls or lookouts when the regular calls
are made.
Men assigned to desk duty shall keep accurate typewritten
reports of all complaints received, in numerical order, and a
correct record of all calls made from the police listing all
contacts on the daily report sheet. They shall also keep a
record of all radio messages on the radio log provided for
such purposes.
Paragraph 11. FIRE PHONE. On fire calls the desk man
shall p.ick up the receiver and immediately note the location
and any other conversation. If help is needed, he will
immediately blow the siren for fire or inhalator assistance.
He shall then remain at the special fire phone answering
calls from the firemen, giving them the location of the fire
or complaint.
Desk men shall also make note of the time the alarm
was received and the fire department shall report when they
return to quarters. Desk men shall dispateh all available
squads and motorcycle men to the scene of the fire or
inhalator call. The location of the fire is not 1he be given
out to anyone but village officials and firemen, except by
order of the Fire Chief.
Men assigned to desk duty shall failihfully ..
follow the duties outlined for them on the particular shift
they are assigned to and keep and maintain all such records
as may be required from time to time by their Commanding
Officers.

Paragraph 12. RESIGNATION. All members of the Police
Department shall give fourteen (14) days notice in writing to the
Chief of Police or Commanding Officer of their intentions of
resigning from the Police Department.
Any member leaving the department without due notice
as aforesaid shall be disqualified from every again becoming a
member of the Police Department. However, before any resignation
is accepted all equipment and property belonging to the Village
of Mount Prospect must be returned to the Commanding Officer.
Paragraph 13. POLICE OF'FICER' S RESPONSIBILITY. It :
shall be the duty of each member of the Police Department to I
abide by these rules and regulations and the rules and regulationF
:as< established by the Board of Fire and Police Commissioners !
of the Village of Mount Prospect. ;

Paragraph 14. OFFENSES. Any member or officer who shall
be guilty of one or more of the following offenses, shall be
subject to the penalties provided in the Board of Fire and
Police Commission's Rules contained in Rule 13 of said Rules
which offenses are the following:
Section 1. Drinking any kind of intoxicating liquor
while on duty.
Section la. Entering any place where intoxicating
drinks are sold while on duty, except in the
immediate discharge of duty.
Section lb. Drinking intoxicating liquor while in
uniform at any time.
Section 2. Intoxication.
Section 3. Conduct unbecoming an officer or employee
of his Department.
Section 4. Immoral Conduct.
Section 5. Neglect of duty.
Section 6. Violation of any criminal law.
Se cti on 7. Inattention to duty.
Section 8. Incapacity or inefficiency in the service.
Section 9. Disobedience of orders.
Section 10. Disorderly Conduct.
Section 11. Leaving post without being regularly
relieved.
Section 12. Leaving district or station without
permission while mn reserve duty.

Section 15. Using coarse, profane or insolent
language to a superior officer or to any other
member of the department.
Section 16. Insubordination or disrespect toward a
superior officer.
Section 17. Using coarse, profane or insolent
language to a citizen.
Section 18. Wilful maltreatment of a person
Section 19. The unlawful use of any weapon.
Section 20. Making a false official report.
Section 21. Neglect to wear full uniform during tour
of duty, or while attending to any official Department
matter.
Section 22. Receiving a bribe ofmoneyo;r other
valuables.
Section 23. Receiving or accepting a fee, reward or
gift from a person arrested, or from a friend in his
behalf, while in custody or after disposition.
Section 24, Publicly criticizing the official action
of a superior officer.
Section 25. Communicating or giving out information
concerning the affairs of the Department, wi thout
the consent of the Chief of Police.
Section 26. Neglect to pay within a reasonable time
a just indebtedness incurred while in the service.
Section 27. Refusing to give number of official badge
or name when requested.
Section 28. Neglect to furnish a person arrested with
a receipt for all property taken from him, except
when held for evidence.
Section 29. Neglect to turn over all property recover.....

officer or other appropriate person without delay.
Section 30. Assigning anticipated salary to any
person or persons.
Section 31. Using the equipment of the Department or
of the Village for any private or personal purposes
whatsoever.
Section 32. Neglect of an officer to make a full
report of any damage to Police equipment in writing,
to the Chief of Police, with a copy to the Board of
Commi ssioners.

Paragraph 15. In addition to the rules and regulations
as established by the Village Board, the laws of the State of
Illinois, ordinances of the Village of Mount Prospect, and
Federal Laws pertaining to and affecting police officers shall
be the governing factors in the conduct of all members of the
Police Department, who shall at all times be subject to the
same.
SECTION II. Tha tit shall be the duty of the Chief of
Police and Chairman of the Police Committee of the Board of
Trustees to enforce the foregoing Rules and Regulations.
SECTION III. That a copy of the foregoing Rules and
Regulations shall be delivered as promptly as possible by the
Chief of Police to each member of the Police Department.
SECTION IV. These Rules and Regulations are in addition
to the Rules and Regulations which may be adopted from time to
time by the Board of Fire and Police Commissioners of the
Village of Mount Prospect.
These rules shall become effective July 1, 1957.
