Lowe The Closed Session was called to order at 7:46 p.m. by Mayor Gerald Farley. Present at the Closed Session were: Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Dennis Prikkel, Michaele Skowron and Irvana Wilks. Staff present included Village Manager Michael Janonis and Assistant Village Manager David Strahl. The purpose of the Closed Session was to discuss Property Acquisition. Sale of Property Village Manager Janonis provided an overview of the proposed triangle redevelopment draft plan presented to staff recently by Norwood. He stated the triangle is bounded by Busse/Northwest Highway and Route 83. He stated this is a concept plan presented by a private developer without direct Village financial assistance. The Village would, however, provide assistance by contributing all or some of three Village-owned properties located in the triangle. Board members suggested additional discussions with Continental Bakery to confirm their intentions and to determine whether they had an interest in the triangle location and what a master plan would look like. Board members also felt any structure should be flexible enough for other options if the proposed development as defined changes in the future. Negotiations Update- Fire Department Assistant Village Manager Strahl provided a general overview of the status to date. He stated negotiations have been ongoing since April of 2000 and informed the Board that Police and Fire Department employees are not allowed to strike but must go to arbitration at impasse. He stated that while an impasse is quite likely, we have yet to declare an impasse due to movement on various articles necessary to construct a Contract. One of the items the Union has recently proposed was a change in the disciplinary procedures. They have proposed that all employees have the options to submit any discipline to either arbitration or the BOFPC. Currently, the Fire Chief may discipline a Firefighter up to five days without BOFPC Hearings, however, employees may appeal the Chiefs discipline to the BOFPC. Terminalions may only be handled by the BOFPC after a Hearing initiated by the Fire Chief. The proposed change in the discipline procedure as submitted by the Union would allow discipline to immediately be rendered by the Fire Chief whereby an employee would be off without pay until the arbitration hearing occurs. If the Hearing Officer decides that the employee is entitled to back pay and/or reinstatement that would be required. The Village negotiators have suggested an option allowing discipline by the BOFPC to be appealed either to Court such as the current program or to arbitration after a BOFPC decision. Such a proposal would require two Hearings but it would preserve the BOFPC authority at the initial disciplinary level. He stated this is a mandatory subject of bargaining which is eligible for arbitration at the point of impasse and the Illinois Supreme Court has ruled in 1988 that this a mandatory subject of bargaining. Comparable communities are split about 50-50 regarding the BOFPC or arbitration choice. The thought was instead of having an Arbitrator possibly make the substantial change as desired by the employees a middle ground could be initiated as evidenced by the proposal from the Village. Village Board members supported the suggestion by staff regarding the option of Arbitration after a BOFPC ruling and suggested discussion take place with the BOFPC Chairman to advise him of the negotiation requirement. Motion made by Trustee Hoefert and Seconded by Trustee Prikkel to return to open session.
