MINUTES
CLOSED SESSION
JUNE 5, 2001
The Closed Session was convened at 6:55 p.m. by Mayor Farley to discuss Litigation. Present were:
Trustees Paul Hoefert, Michaele Skowron, Irvana Wilks and Michael Zadel. Absent from the Closed Session
were: Trustees Timothy Corcoran and Richard Lohrstorfer. Staff present included: Village Manager Michael
Janonis, Assistant Village Manager David Strahl and Village Attorney Everette Hill.

Village Attorney Hill advised the Board that the Chicago Tribune has sent a letter to the Village stating they
plan on appealing the Village's denial to provide the traffic stop data that has been gathered regarding the
racial makeup of individuals who are stopped at traffic situations. Attorney Hill feels that the data should
remain exempt for public disclosure because it is preliminary data and it has been compiled at the request of
an attorney or Court, which meets the standard of exemption. He feels that once the matter is concluded,
then the information could easily be considered public.
The Village Board recommended that the information not be released at this time.
Attorney Hill provided an update regarding the Case of Joe Garcia VS. the Police Pension Board. He stated
this is the case where a Police Officer is claiming that he did not receive a Disability Pension as retaliation for
participation in the Martinez Lawsuit. The Circuit Court has reviewed the Pension award under Administrative
Review and has sustained the Pension Board's decision. There are limited issues that can be brought up in a
Federal Case and the Pension Board argument will relate to the fact that this Case has already been litigated.
Village Board members recommended that they remain advised of the situation as this Case.
Attorney Hill updated the Village Board regarding the Romero Lawsuit. He stated that the Plaintiffs'
attorneys are willing to settle as proposed by the Village. He stated there is an extensive discussion ongoing
with the Village's insurance carrier regarding when deductibles apply and how any funding of a settlement
might be structured. He stated that if an agreement cannot be worked out regarding the deductible as part of
the overall settlement, he will return to the Village Board for additional authorization regarding final payout.
Attorney Hill updated the Village Board regarding the Hendricks vs. Village of Mount Prospect Case. He
stated that a Motion to Dismiss has been filed but even if the Case is dismissed, the Plaintiff will likely be
allowed to refile since he is acting as his own attorney. He will update the Village Board as this Case
progresses.
The Closed Session adjourned at 7:35 p.m. and convened into open session of the regular Village Board
meeting. No action was taken.

The Closed Session reconvened at 9:00 p.m. with a continuation of the discussion earlier in the evening and
adjourned at 9:35 p.m. No action was taken.
