MINUTES
CLOSED SESSION
AUGUST 8, 2000
The Closed Session was called to order at 10:01 p.m., by Mayor Gerald Farley in the
conference room of the Senior Center. A roll call was taken. Present were: Trustees Timothy
Corcoran, Paul Hoefert, Richard Lohrstorfer, Dennis Prikkel, Michaele Skowron and Irvana
Wilks. Staff present included Village Manager Michael Janonis. The purpose of the Closed
Session was to discuss Litigation and Personnel.
Litigation
Village Manager Michael Janonis reviewed with Board members a Legal Opinion from Village
Attorney Everette Hill regarding the merits of a threat of litigation by the property owners at 791
Rand Road. Given that the property in question was already the subject of a 1973 Court
Decree declaring the Village's Zoning to be null and void, Mr. Hill felt it prudent for the Village to
consider the legal implications of rejecting the Petitioner's request for Rezoning. Mr. Hill's Legal
Opinion was prompted by a discussion he had with the property owners' attorney.
The Village Board reviewed Mr. Hill's Opinion and discussed the legal position of the Village in
this matter. At the end of the discussion, the Village Board directed the Village Manager to
obtain more information regarding the history of the property, including when it was annexed to
the Village and the original Zoning designation that attached upon Annexation. They also
requested more information regarding the 1973 litigation.
Personnel
The Village Board undertook the annual performance review of the Village Manager. The
Village Manager was excused from the room at 11 :05 p.m. Each Board member had been
asked to fill out a rating instrument prior to the Closed Session. Mayor Farley had compiled all
of the scores and comments and Board members considered same as a whole. There was
extensive discussion regarding events which had transpired over the past twelve months and
the manner in which the Village Manager and staff had responded to same. Overall, the Village
Board was pleased with the Manager's performance.
The Manager returned to the Closed Session at 11:45 p.m. Village Board members expressed
their views both individually and collectively. Mayor Farley indicated that after considerable
deliberation, the Board had decided to award an increase in salary to the Village Manager from
$112,000 to $116,500, increase the Village contribution to his Deferred Compensation Plan by
$1,000 and grant a $10,000 bonus. Mr. Janonis expressed his appreciation for the support
shown by the Village Board.
There being no further business, a Motion was made by Trustee Wilks and Seconded by
Trustee Prikkel. The Closed Session was adjourned by unanimous vote at 11 :57 p.m.
