Janonis MINUTES CLOSED SESSION JANUARY 5,1999 The Closed Session was convened at 9:45 p.m. by Mayor Farley to discuss litigation and Property Acquisition and litigation. Present were: Trustees George Clowes, Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Daniel Nocchi and Irvana Wilks. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl and Community Development Director William Cooney. Litiqation Village Manager Janonis provided an update regarding the RJN Appeal. He stated that the Judgment has been upheld but disagreed with the damages and how the formula was determined for the damage. He stated the Village must refile in a short period of time and has two options available. The Village can go back to Trial Court and prove up the amounts may have the option of getting $100,000-$150,000 less plus the expense of Trial. Once remanded back to Court, the Appeal Bond is released. The second option is to file with the Supreme Court for $3,000-$4,000, the Bond remains in place. The Court may not consider the Case but it is a newer area of law. He suggested making at least one application to the Illinois Supreme Court for consideration. Village Board direction was to file with the Supreme Court. Property Acquisition Village Manager Janonis provided an update regarding property acquisition negotiations. The gas station at the corner of Central and 83: The Village is awaiting Tax information as part of the loss of income argument that Norb has presented to the Village Board. Carriage House acquisition: Manager Janonis stated that he has informed Gail that the triangle redevelopment is not a high priority though it is unlikely that any acquisition by the Village will take place. Meersman building: Manager Janonis stated that he has been informed by the Meersmans that they are not interested in selling the property to Seawart for consolidation purposes.
