MINUTES
EXECUTIVE SESSION
DECEMBER 18, 1990
The Executive Session was called to order at 10:33 p.m., in the second floor Conference
Room of the Senior Citizens Center, 50 South Emerson Street, for the purpose of
discussing pending litigation. Present at the Executive Session were: Mayor Gerald
Farley; Trustees Ralph Arthur, Mark Busse, Timothy Corcoran, Leo Floros, George Van
Geem and Don Weibel. Also present were Village Manager John Dixon, Director of
Planning and Zoning Dave Clements and Village Attorney Buzz Hill.
The first item of discussion of the Executive Session was a comment by the Mayor
concerning matters in Executive Session; in particular, that they are privileged information
and should not be released until the Board has an opportunity to release those matters
in a regular course of events of review of Executive Session Minutes.
The second item of discussion was the Snuggery /Disconnect Lawsuits and; specifically,
the review of the four points that their attorney has presented as settlement for these
Suits. The first item was concerning rezoning to 1-1 of the entire area of the Disconnect;
the second item was a period of time that the property owners would be barred from
Disconnection proceedings; the third item was the closing hours for the Snuggery and the
operation of the beer garden and the fourth item was the stipulation that the Snuggery
would plead guilty and pay to the Village $5,000 in lieu of closing. The Board discussed
in detail all four of the points and gave direction to the Village Attorney for further
discussions with the Snuggery attorney in an attempt to try to resolve these matters in
settlement discussions.

The third item discussed was an agreement presented to the Village by the Elk Grove
Township Rural Fire Protection District indicating that the Village would not use the
matter of the dismissal of 86-CH-0050; that is, those 26 single-family residences that were
double taxed while in the Village for Fire Protection District services when in fact
services were not provided by the Fire Protection District. Action was taken on this
matter in open session authorizing the Mayor and/or Manager to sign the Agreement
with minor modifications.

The fourth item discussed was an update by the Village attorney on the Artfield Builders'
Case. The Mayor commended attorney Hill for his abilities to turn a hostile Judge into
one that had an understanding of the issues from the Village's viewpoint. Mr. Hill made
the Board aware of the concern of the attorney for Artfield Builders on unrelated
matters concerning vandalism at his clients' properties. Mr. Hill indicated that we would
cooperate in any way that we could.
The Executive Session was adjourned at 11:20 p.m.
