JANONIS VILLAGE CLERK CAROL A. fiELDS Village af Mount: Prospect: MINUTES CLOSED SESSION ~ JULY 23, 1996 The Closed Session was called to order at 9:32 p.m., in the conference room of the Senior Mount Prospect. Illinois 60056 NEW AREA CODE 847 Phone: 708 / 392-6000 Fax: 708 / 392-6022 TOO: 708 / 392-6064 Citizens' Center, 50 South Emerson Street, for the purpose of discussing Litigation, Personnel and Property Acquisition. Present at the Closed Session were: Mayor Gerald L. Farley; Trustees George Clowes, Timothy Corcoran, Richard Hendricks, Paul Hoefert and Irvana Wilks. Absent from the meeting was Trustee Michaele Skowron. Also present were: Village Manager Michael Janonis and Assistant Village Manager David Strahl. Due to Trustee Skowron's absence, Trustee Wilks made a Motion, which was seconded by Trustee Clowes to defer consideration of the Closed Session Minutes of July 9, 1996. By roll call vote of Mayor Gerald Farley; Trustees Clowes, Corcoran, Hendricks, Hoefert and Wilks, consideration of said Minutes were deferred. Litigation Village Manager Michael Janonis informed Board members that the Judge in the RJN Case had decided to allow limited depositions to be taken of Trustees Clowes, Corcoran and Hoefert, as well as Mayor Farley. The apparent scope of the depositions was limited to whether the Trustees had been informed of alternate solutions proposed by RJN and whether comments were made to third parties suggesting that RJN was responsible for professional malpractice. Mr. Janonis indicated that he would work with Village Attorney' Everette Hill to coordinate the location and times for these depositions. Mr. Janonis discussed general aspects of the progress of the litigation. B,uzz Hill remains confident that the Village has a very strong case. He also indicated that the apparent reason why RJN was unwilling to talk seriously about settlement is that their errors and omissions insurance coverage could have a deductible that is close to $500,000. Since this is the approximate amount of the claim, there appears to be little incentive on the part of either the insurance company or RJN to press for a settlement. Personnel Village Manager Janonis reviewed with Board members a number of Personnel decisions which had recently taken place. These included the termination of an Electrical Inspector for cause; a probationary Police Officer who subsequently filed a Discrimination Claim with the State Equal Employment Opportunity Commission; termination of a probationary Firefighter who also filed a Claim under the Americans with Disabilities Act; and, finally, there was discussion regarding the termination case before the Board of Fire and Police Commissioners regarding a 19-year veteran of the Fire Department. In each instance, Mr. Janonis reviewed the particulars of the reasons for dismissal, how the matters were handled and the present status of any claims pending against the Village. Mr. Janonis indicated that staff would continue to monitor these cases and would report back any change in status to the Village Board. Land Acquisition Board members revisited the general subject of property acquisition in the downtown redevelopment area. Various Board members restated their positions regarding aggressive pursuit of various properties in the downtown. After a brief discussion, Board members decided that any detailed discussion regarding any particular properties should wait until a full Board was present. There being no other business discussed, there was a Motion by Trustee Hoefert and Seconded by Trustee Wilks that the Closed Session adjourn. On a roll call vote of Mayor Farley; Trustees Clowes, Corcoran, Hendricks, Hoefert and Wilks, the Closed Session adjourned at 10:17 p.m. No action was taken or further business discussed, the Committee of the Whole meeting adjourned at 10:20 p.m. MEJ/rcc
