MINUTES
EXECUTIVE SESSION
SEPTEMBER 20, 1994
The Executive Session was called to order at 12:11 a.m.(September 21), in the
conference room of the Senior Citizens Center, 50 South Emerson Street, for the purpose
of discussing Litigation. Present at the Executive Session were: Mayor Gerald Farley;
Trustees George Clowes, Timothy Corcoran, Richard Hendricks, Paul Hoefert, Michaele
Skowron and Irvana Wilks. Also present were: Village Manager Michael Janonis,
Assistant to the Village Manager David Strahl and Finance Director David Jepson.
Litigation
Trustee Corcoran asked Village Board members to confirm the general consensus that
as the Village's representative to SWANCC he should vote in favor of pursuing the
litigation. This concurring vote would be conditioned upon a reiteration that there would
be caps on the attorneys' fees. Trustee Corcoran indicated that he would recommend
that regardless of the outcome the Agency should consider the feasibility of selling the
landfill site particularly if the Suit were successful. The recommendation would also
include some statement that the Transfer Station should be retained and its utilization
maximized.
Trustees Clowes and Hendricks restated their opposition to any further litigation in the
matter. Trustee Wilks indicated some hesitancy but saw the value of the litigation as it
related to giving the Agency leverage to negotiate additional long-term contracts for the
disposal of Agency waste.
After some discussion, it was the consensus of Board members that Trustee Corcoran
should vote in favor of the litigation with the above-stated reservations.
Mr. Janonis also apprised Board members that a Judge in the Third District Court had
refused to follow the Village's Parental Responsibility Ordinance and would not order the
mandatory $1,000 fine for delivery of alcohol to a minor.
Mr. Janonis indicated he had discussed the Case with Attorney Everette Hill and Mr. Hill
was of the opinion that the Judge would be presiding over the Village Court call for some
time to come and that his refusal to follow the Ordinance would have a deleterious effect
on our enforcement efforts. Mr. Hill felt that the fact situation of the case made it an
excellent choice for an Appeal. Mr. Janonis indicated that he concurred with Mr. Hill's
opinion that the Village should Appeal the decision of the Judge.
After brief discussion, there was a consensus of the Board to Appeal the Judge's ruling
in this case. The Village Manager was directed to instruct Mr. Hill to proceed.
Trustee Hendricks objected to discussion of the Appeal in Executive Session because he
did not feel that it fell under the heading of Litigation. Mr. Janonis stated it was his
opinion that it was a proper subject for an Executive Session.
There being no other business discussed, on a Motion by Trustee Hoefert and Seconded
by Trustee Wilks, the Executive Session was adjourned at 12:30 a.m.
