MINUTES
CLOSED SESSION
FEBRUARY 5, 2002
The meeting was called to order at 6:03 p.m. by Village Manager Janonis, in the Village Hall second
floor conference room. Present were: Trustees Timothy Corcoran, Paul Hoefert, Richard
Lohrstorfer, Michaele Skowron, Irvana Wilks and Michael ladel. Staff present included: Village
Manager Michael Janonis, Assistant Village Manager David Strahl, Police Chief Richard Eddington,
Finance Director Douglas Ellsworth and Village Attorney Everette Hill.
Motion made by Trustee Wilks and Seconded by Trustee Skowron to appoint Trustee Timothy
Corcoran as Mayor Pro Tem for the meeting. Motion was approved.
Motion made by Trustee Corcoran to move into Closed Session and Seconded by Trustee Wilks.
The Closed Session was convened at 6:04 p.m. to discuss Litigation.

Approval of Minutes of April 17, 2001. Motion made by Trustee Hoefert and Seconded by Trustee
Skowron. Trustee ladel abstained. Minutes were approved.
Minutes of May 8, 2001. Motion made by Trustee Hoefert and Seconded by Trustee Wilks. Minutes
were approved.
Minutes of June 5, 2001. Motion made by Trustee Hoefert and Seconded by Trustee Skowron.

Romero Class Action Lawsuit

Village Manager Janonis stated that there is a tentative Settlement Agreement, which has been
formulated and is now before the Board for final approval. Village Attorney Hill stated that the
insurance company has been under pressure to settle the Case and is willing to link the settlement
with the closure letter, which is anticipated from the Department of Justice. The insurance provider
for the Village has agreed to a conditional approval of this settlement in closed session for future
approval in an open session. The insurance company then will take over the defense of the case
utilizing the Village's self-insured retention level and bill back to the Village the maximum exposure
of $240,000. The insurance provider will be responsible for all other expenses at the point of
settlement agreement.

Consensus of the Village Board was to support the settlement as proposed and authorize
Mayor Pro Tem Corcoran to sign a confidential settlement agreement that will be retained
until the Department of Justice Letter is completed and approved at which time the
settlement will be approved in open session.
Egeberah vs. Vil/aae of Mount Prospect
Village Manager Janonis stated there has been a settlement demand for $6 million but the plaintiff
has stated that she would settle for $4.5 million. He provided an overview of the case on a strategic
basis and reminded the Village Board it would be prudent to counter with some type of settlement
offer but recognize that the likelihood of settlement may be remote due to the excessive demand by
the plaintiff.
Consensus of the Village Board was to authorize staff to offer up to $100,000 towards the
settlement of this case but start the settlement offer at $30,000 for consideration.
There was no other business discussed in Closed Session and the meeting adjourned at 6:57 p.m.
No action was taken.
