Lowe Village of Mount Prospect 100 South Emerson Street Mount Prospect, Illinois 60056 MINUTES CLOSED SESSION JULY 17, 2001 [,S'(!IJ[1[1 Umg[U~&@~ : 1ID~j]'[g ,~...a"'~l9 The Closed Session was convened at 9:24 p.m. by Mayor Farley to discuss Property Acquisition, Personnel and Litigation. Present were: Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Michaele Skowron, Irvana Wilks and Michael Zadel. Staff present included: Village Manager Michael Janonis, Assistant Village Manager David Strahl and Village Attorney Everette Hill. Property ACQuisition Trustee Hoefert stated that he has recently received a confirmation from Bank One that there may be some interest in selling the building to the Village. He stated the conversation can best be classified as a level of interest and will get back to the Village in order to consider further discussion. He stated the Bank still wants to retain a presence in the building and Trustee Hoefert will report back any further discussions. Personnel Village Manager Janonis stated that Chief Eddington is prepared to promote Kevin Condon to Deputy Chief and to fill the two Commander positions with Sergeants Wagner and Dahlberg. He stated he is supportive of these recommendations for promotion and wanted to provide the information to the Board prior to the promotions being official. He also stated there appears to be a Pension question regarding Tom Daley. The Police Pension Board is questioning the wage that should be calculated regarding his position since the Deputy Chief wages do not track after Daley was put in the Acting Chief position. This is an issue between the Pension Board and Daley at this point but the Board will be kept updated if anything changes. Labor Negotiations Assistant Village Manager Strahl provided an update regarding the status of the Fire Contract. He stated that the Contract has been completed and currently is in the process of finalizing all the language in order to bring it for a Ratification vote before the members. He anticipates the Agreement coming before the Board sometime in August for final approval and implementation. Litigation Village Manager Janonis stated that the Elmhurst Accupressure business has filed for an Administrative Hearing in order to remain open. Village Manager Janonis stated the Village has filed Condemnation papers for Prospect Medical Center. Village Manager Janonis stated that the Settlement Agreement with former Officers Moser and Medrano allowed for the Village to pay each individual up to one year's worth of salary if they did not obtain any employment during that period. It came to the Village's attention that Moser had been working. This employment had been verified, therefore, the Village cut off his salary for the last two months before the period ended according to the Agreement. However, Moser's attorney has filed an emergency Motion to get the money returned and due to the amount of effort and legal expenses necessary to fight this, the Manager would request that the Village payout the final two months and move on. The Village Board supported the final payment to Moser. A Motion has been filed regarding Joe Garcia VS. the Police Pension Board stating that the Federal Court has no authority since the State has already ruled on this claim and we are awaiting a response. Village Manager provided an update regarding the discussions with the insurance providers regarding the settlement of the Romero Lawsuit. He stated that the insurance company is refusing to cover the second $250,000 SIR and due to the position the Village is in, it may be worthwhile to settle and absorb the additional cost since he does not feel that the Village is in a strong position to avoid the second deductible. Village Manager Janonis provided an update regarding the Department of Justice investigation. He stated there may be some movement to consider entering into a friendly Consent Decree with the Justice Department. Such a Decree would likely include the initiatives already implemented. The Department of Justice also has other options available including letting the Case go inactive for an indefinite period of time. He is concerned that any conclusion to the Department of Justice investigation be linked to the settlement of the Class Action Lawsuit.
