MINUTES
CLOSED SESSION
APRIL 10, 2001
A Motion was made by Trustee Michaele Skowron and Seconded by Trustee Prikkel to move into
Closed Session. The Closed Session was convened at 6:18 p.m. by Mayor Farley to discuss
Litigation. Present were: Trustees Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Dennis
Prikkel, Michaele Skowron and Irvana Wilks. Staff present included: Village Manager Michael
Janonis, Assistant Village Manager David Strahl, Village Attorney Everette Hill, attorneys Terry Ekl
and Jim Sotos.
Litigation
Village Manager Janonis stated that there are three general areas that he wanted to advise the
Board on. The first was an update regarding the recent articles in the newspaper alleging a possible
settlement in the Class Action Suit. The second area was to explore possible settlement options that
the Board may have an interest in and the third area is the Department of Justice investigation
update.
Attorney Jim Sotos stated that the recent newspaper articles were summaries of negotiations which
typically occur in closed chambers. He acknowledges the attorney made a mistake by not realizing
that he was in open court when he made his comments. He also summarized the Village's chances
in prevailing in the Class Action Suit and what a possible settlement option could be structured as.
He stated the insurance company representatives will be present at an upcoming settlement
conference. Such a settlement conference is standard procedure in all Suits. Mr. Sotos stated that
based on the proposed settlement options available, he would recommend serious consideration by
the Village Board in order to dispose of this Suit. He stated this cost estimate is worthy of
consideration due to the cost! benefit of trying the Case.
Attorney Terry Ekl provided an update regarding the Department of Justice investigation. He stated
the Case is currently being directed out of Washington and the decisions regarding whether to move
forward on the Case will be coming from Washington. He would not recommend any type of political
push to possibly resolve this investigation. He stated he will continue to follow up with the
Department of Justice and inform them whether there is a conclusion to the Class Action Lawsuit.
Motion made by Trustee Prikkel and Seconded by Trustee Wilks to adjourn the Closed Session.
Motion passed. The Closed Session adjourned at 7:32 p.m.
