SPECIAL CLOSED SESSION
FEBRUARY 29, 2000

Mayor Farley called the meeting to order at 6:40 p.m., in the Conference Room of Village Hall. A roll call
was taken. Present were: Mayor Gerald L. Farley; Trustees Timothy Corcoran, Paul Hoefert, Richard
Lohrstorfer, Dennis Prikkel and Michaele Skowron. Absent from the Closed Session was Trustee Irvana
Wilks. Motion made by Trustee Hoefert and Seconded by Trustee Skowron to move into Closed Session
to discus Litigation. Motion was approved. Staff present included: Village Manager Michael Janonis,
Assistant Village Manager David Strahl, Village Attorneys Everette Hill and Jim Sotos.
Litigation
Village Manager Michael Janonis provided a Case status. He also provided an update regarding the
Appeal process for the Martinez Case and stated the Medrano Case is scheduled for trial on March 13.
No dates have been set yet with the Moser Case except for a Disclosure date of March 31.
Village Attorney Hill stated that he is involved in ongoing discussions with the Village insurance carrier
and expects to go to HELP to obtain some additional funds in case settlement is ordered. He also
highlighted the outstanding Attorney fees to date.
Attorney Jim Sotos provided a summary of possible settlement offers with appropriate mechanics
regarding how such a settlement would be divided among the various plaintiffs. He stated the benefit of a
settlement is that it avoids the Injunctive Relief Order that is currently in place regarding the Martinez
Case.
Consensus of the Village Board was to offer a settlement in the amount of $900,000 for all three
plaintiffs provided the two Officers that are currently employed give up their employment as part
of the settlement in a reasonable timeframe.
Motion made by Trustee Prikkel and Seconded by Trustee Hoefert to move into open session at
9:36 p.m. Motion was approved.
Village Board returned to open session at 9:37 p.m. All Trustees were present except for Trustee Wilks.
Mayor Farley announced there was no official action to be considered as the result of the Closed
Session.
A discussion took place regarding the proposed meeting with the Menards' representatives on March 2 in
which elected officials would be present at the meeting with the residents.
Motion made by Trustee Hoefert and Seconded by Trustee Skowron to adjourn the meeting. There being
no further business, the meeting adjourned at 9:45 p.m.
