The Closed Session was convened in the Senior Center Conference Room at 10:04 p.m. to discuss
Litigation and Collective Bargaining. Present were: Mayor Gerald L. Farley; Trustees Timothy Corcoran,
Paul Hoefert, Richard Lohrstorfer, Dennis Prikkel, Michaele Skowron and Irvana Wilks. Staff present
included: Village Manager Michael Janonis, Assistant Village Manager David Strahl, Village Attorneys
Everette Hill and Jim Sotos.
Litigation
Village Manager Michael Janonis stated that he wanted to update the Village Board regarding
settlement discussions, the possible impact of insurance coverage, Village representation for the
defendants and a statistical overview of the arrest data to date.
Village Attorney Jim Sotos stated that based on the statistical information entered into the system so
far, it is clear that no systematic racial profiling is taking place. He stated that based on the number of
tickets to Hispanics, the percentage is approximately 18%.
Village Attorney Everette Hill stated that there is a settlement conference scheduled for February 23
with the presiding Judge. He stated that such settlement conferences are quite routine leading up to the
eventual Court date itself. He also laid out a number of options for the village Board to consider regarding
all three Cases and what the proposed impact might be.
After much discussion, the Village Board reached consensus to offer $750,000 to all three
plaintiffs provided the plaintiffs that are currently employed leave the Village's employ. The
village Board also reached consensus on retaining the current legal defense team for the Class
Action defense.
Collective Bargaining
Village Manager Janonis advised the Board that the Police and Fire Labor Contracts are to expire the
end of April and discussions are about to commence.
Motion made by Trustee Skowron and Seconded by Trustee Hoefert to move into open session.
The Closed Session adjourned at 12:20 a.m.
