The Closed Session was convened in the Village Hall second floor conference room at
9:10 p.m. to discuss Litigation. Present were: Mayor Gerald L. Farley; Trustees
Timothy Corcoran, Paul Hoefert, Richard Lohrstorfer, Dennis Prikkel, Michaele Skowron
and Irvana Wilks. Staff present included: Village Manager Michael Janonis, Assistant
Village Manager David Strahl, Village Attorney Everette Hill, Village Prosecutor Lance
Malina, Attorneys for the Village and Police Department defendants Betty Knight, Terry
Ekl, Chuck Hervas, Bill Kurnik and Jim Sotos.
Litigation
Attorney Betty Knight provided a summary of the activities to date since the Martinez
verdict and highlighted what role each attorney was to fulfill as part of the Appeal
process. She stated Motions have been filed to Stay the decision without Bond or
Injunctive Relief and are awaiting the Hearing with the Judge on that Motion. She
stated that the discussions among the various attorneys that have signed on to the
Case have confirmed the fact that this is a very strong Case for Appeal.
Medrano Case
She stated Discovery is to close on February 11 and they are all working on the
statistical information and finishing up depositions. A pre-trial Hearing is set for next
week. Legal questions and pre-trial conference scheduled for February 18. The trial
date has been set for March 13.
Moser Case
There has been no trial date set and minimal discovery has taken place to date.
Attorney Buzz Hill stated the information regarding the Department of Justice
investigation has been a basic inquiry and it may be possible to hire an independent
investigator to do the work that a Department of Justice review would do anyway.
Village Manager Janonis stated that settlement remains an option for consideration,
however, he does not know how much it would cost at this point. He stated the option
for settlement might be attractive to the Village for any number of reasons including
insurance coverage, overall cost of litigation, bad publicity and risk of more punitive
damages to individual defendants.
Attorney Jim Sotos summarized a settlement offer from Plaintiff Attorney Hunt.
Settlement numbers were extremely preliminary and have not been analyzed.
Attorney Hill stated that there is continuing discussion regarding the Village's insurance
carrier and what level of coverage the Village may expect for these cases.
General consensus was to consider settlement if Village objectives could be met
with a reasonable settlement.
Village Manager Janonis stated that he will attend the pre-trial conference on
February 18 to explore settlement options.
Motion made by Trustee Prikkel and Seconded by Trustee Corcoran to move into open
session.
The Closed Session adjourned at 12:41 a.m.
