The Closed Session was convened to discuss Litigation 9:43 p.m. Present were: Trustees Timothy
Corcoran, Paul Hoefert, Richard Lohrstorfer, Dennis Prikkel, Michaele Skowron and Irvana Wilks.
Absent from the Closed Session was Mayor Gerald Farley. Staff present included: Village Manager
Michael Janonis, Assistant Village Manager David Strahl and Village Attorney Everette Hill.
Litigation
Village Manager Janonis provided a review of the material that he is providing to the Village Board.
Among the material provided is a copy of the proposed Injunctive Relief Order submitted by the
plaintiffs attorney in the Martinez v. Mount Prospect Case. There is a copy of a Motion for
Reinstatement, a copy of the State Statute regarding Punitive Damages, a Summary of the racial
make-up of the Department, a copy of the Officer Performance Standards, a copy of the Harassment
Policy provided to all employees, a summary of the community out-reach activities the Village has
undertaken the last several years, a listing of the recommended defense attorneys for the various
staff members included in the lawsuit. He also provided an overview of the estimated cost and
attorney assignments.
There was extensive discussion regarding the material presented and the status of the Martinez
Appeal and the other two pending cases. Village Attorney Hill stated that a number of attorneys
have brought forth ideas regarding the process of defending the other two cases and the Appeal of
the Martinez Case. Village Manager Janonis stated that he is still in discussions regarding the
insurance provider to determine the details of the coverage.
Village Manager Janonis stated that even though the Village is moving forward to defend these
cases aggressively, it is still possible to settle at any time with the plaintiffs.
The Village Board directed the Village Manager to keep them closely apprised of the status of the
Cases.
The Closed Session adjourned at 11 :19 p.m.
