MINUTES
CLOSED SESSION
APRIL 16, 1996
The Closed Session was called to order at 9:14 p.m., in the conference room of the
Senior Citizens' Center, 50 South Emerson Street, for the purpose of discussing
Personnel and Litigation. Present at the Closed Session were: Mayor Gerald L. Farley;
Trustees George Clowes, Timothy Corcoran, Richard Hendricks, Paul Hoefert, Michaele
Skowron, and Irvana Wilks. Also present were: Village Manager Michael Janonis and
Assistant Village Manager David Strahl.
Village Board members reviewed Minutes of the Closed Session from the April 2, 1996
meeting. The Minutes were approved unanimously by a roll call vote of Mayor Gerald
Farley; Trustees Clowes, Corcoran, Hendricks, Hoefert, Skowron and Wilks.
Personnel
Mayor Farley distributed evaluation instruments for the Village Manager to all Board
members. He asked that completed evaluation forms be returned to his office by
April 30. Thereafter, the Mayor would summarize the results and review with Board
members.
Village Manager Michael Janonis informed Board members that negotiations with the
Public Works Union were ongoing. Discussions were moving at an extremely slow pace.
Mr. Janonis asked Board members to refrain from engaging in discussions with either
Union members or the media.
Village Manager Michael Janonis indicated that he was in the process of finalizing an
offer for a Finance Director. Village Manager briefly reviewed the search process and
indicated that all of the final candidates possessed the requisite skills to successfully fill
the position.
Village Managerinformed Board members that Fire Chief Ed Cavello had notified him that
he was applying for the Fire Chiefs position in the Village of Winnetka. Mr. Janonis
explained that Chief Cavello's interest in the Winnetka job was not because of
dissatisfaction with Mount Prospect but rather represented an opportunity to enhance his
income by retiring from Mount Prospect. drawing a pension and earning a salary as the
Fire Chief of another community. Mr. Janonis indicated that this is a common practice
among Police and Fire Chiefs and is perfectly allowable under current State law and
pension rules.
Brief discussion among the Board indicated that they would be sorry to see Chief Cavello
go but they felt that offering the Chief a similar arrangement would not be in the best
interest of the Village.
Litigation
Mr. Janonis updated Board members regarding the pendency of a Declaratory Judgment
Suit against Concord Development for a proposed development on the unincorporated
parcel at Wolf and Kensington Roads. Mr. Janonis indicated that his most recent
discussions with Concord Development indicated that they had planned to withdraw their
application before the City of Des Plaines and not proceed with the project. However,
they were experiencing some difficulty because of certain contractual arrangements which
they had with the property owner.
Board members directed the Village Manager to monitor the situation closely and if there
were any indication that the project was moving forward, he should immediately move to
perfect the lawsuit.
The Village Manager briefed the Board on the status of the Addison Court lawsuit. He
indicated that attempts were still being made to have the property owners along Addison
Court annex to the Village as part of the settlement that would see the Village fund a
\; trV major portion of storm water improvements which would relieve periodic flooding in the

. \~...lL. area. The 1983 lawsuit is based on an inadequate storm water drainage system resulting
in damage to certain properties on or abutting to Addison Court. Mr. Janonis reminded
Board members that the Village was joined in the suit in the late 1980s when the Village
forcibly annexed the area. While the Village had absolutely no hand in causing the
flooding or worsening the condition, the Judge in the case had refused to dismiss the
Village out. Mr. Janonis indicated he would keep Village Board members abreast of any
new developments.
Trustee Hendricks asked about the need for official Board action on the Concord
Declaratory Judgment. After consulting with Village Attorney Buzz Hill, it was determined
that it would be proper, in order to keep an element of surprise, to have the Board ratify
the action of filing Suit at the next Board meeting immediately after said filing.
There was no other business taken up during the Closed Session. On a Motion by
Trustee Corcoran and Seconded by Trustee Hoefert, on a roll call vote, the Closed
Session ended at 9:51 p.m.
No action was taken or further business discussed. On a Motion by Trustee Wilks and
Seconded by Trustee Clowes, the Board meeting adjourned at 9:53 p.m.
